April 7, 2008 meeting minutes

Tom Wilson opened the meeting with the Pledge of Allegiance.
REPORT Susan Jones, Auditor reported that the Office is working to get values certified to the State, members of the PTABOA Board have been called in to finish putting on the property tax exemptions. Also met with the Brookville Lake Regional Waste District in putting on the 2007 Sewer Liens, these were not added to the system in 2007. We will be contacting Manatron and Union County on how to get these added.
Sharon Halcomb, Assessor reported on the changes with the Township Trustees, starting July 1, 2008, the trustees will no long be doing assessment duties. For several years they have only been doing the personnel property assessments, the real estate new construction has been done by her office or contracted out. She may need to hire additional help in her office to do the additional work that will need to be done in her office. The salaries paid out of County Funds will no longer be paid to the Trustees after this year, there would be funds available there and transferred to her budget. These salaries were read.
Rebecca Oglesby, Treasurer reported on the new changes with the tax statements and comparison statements, these will need to be approved by the State Board of Accounts. Also mentioned that she is looking into adding a new service to her office, she has working with Pay Trust Solutions out of Indianapolis. This service would provide taxpayers the use of credit cards to pay their taxes. The process would be no cost to the County, but fees would be charged to the customer. The charges range from $1.50 at the counter, $3.95 through the internet and 5% over the phone. Becky mentioned that Marlene Flaspohler, County Clerk is also interested in this service. Becky has a copy of the Contract and gave to Gene Stewart, County Attorney to review. Gene reviewed and said contract seems to be okay. Don VonderMeulen asked if payments are guaranteed and if there are other vendors, Becky said yes they are guaranteed and yes there are other vendors. It was also asked if the County could get out of the contract. Gene said yes, with a 30‐day written notice. The Board of Commissioners will take under advisement.
Eugene Stewart reported that he is working on the Ordinances that the Sheriff’s Department needs in place, should be done next week. A conference call is scheduled for Tuesday, April 8, 2008 @ 10:00 A.M. regarding REX Pipeline. The County is considering sharing the cost of legal/consulting services with Hoosier Hills Water. Tom Wilson reported he had received papers regarding the EPA Suit from Sean Riggs and had signed.
DUMP TRUCK Notice to Bidder asking for sealed Bids for a Highway Dump Truck to be opened on April 28, 2008 @ 2:00 P.M. Eric Roberts moved to advertise for Highway Dump Truck. Don VonderMeulen seconds. Tom Wilson, All in Favor. Motion carried.
Rene Stivers, Representing the Town of Brookville, reported that the Town would accept sewer from the County Park, Fair Grounds from across the Whitewater River, but not run the line. Roy Hall has been in contact with several organizations that are located across the river and they are interested in obtaining the sewer services. Rene recommendation is to work with a member from the different organizations to work on the project. Eric Roberts reported that the Fair Board has obtained a permit to put in a septic system, there are holding off until we know if the septic line goes in. Will need a letter of Intent from the organizations to the Town of Brookville who would want the service. Also, need to get with the Southeastern Indiana Regional Planning Commission for a Planning Grant.
DRAINAGE Joe Gillespie, County Surveyor presented plans he had prepared and met with Dick Schmid, Property Owner in regards to the Drainage Issues at Stavetown. Mr. Schmid feels that what is planned will correct the problem and is acceptable to him. The plan is to eliminate (2) 24’ pipes and replace with (1) 36’ pipe and replace part of it with an open drain.
Joe Gillespie also reported that Enhanced Telephone Communications (ETC) has requested to purchase Right‐of‐Way on Wildcat Lane, behind the Sunoco Station.
VFW Joe Gillespie presented a letter from Indiana Department of Natural Resources (DNR) in regards to the VFW purchasing property next to a Cemetery. DNR gave approval, with stipulations as stated in letter. Joe mentioned that the VFW is also looking at other property owned by the Town of Brookville, are in the process of getting an appraisal.
Gary Seale, Representing the VFW says we don’t have a commitment from anyone; they are interested in both the County and Town Property. Don VonderMeulen asked how much concern does the VFW have with the DNR conditions. Mr. Seale’s said they make sense. Don asked, basically your wanting to purchase the County Property. Gary said yes, but there’s the Public Hearing Process. Don asked if they are willing to take the risk, then he is willing to proceed. It was asked where they would get there water, Mr. Seale that had not be decided, had talked to the Conservation Club. It was said there water comes from the Senior Citizens well. The Commissioners will get with Cathy Pelsor.
FEDERAL AID BRIDGE PROJECTS ‐ George Hartman, Highway Engineer reported he had attended a Public Meeting on Monday, March 31st, 2008 regarding Federal Aid Projects with Federal Highway Administration. Kevin Loiselle, Farrar, Garvey & Associates, Brent Roberts, Butler, Fairman & Seufert and John Graf, Howard J Barth & Associates were also present to answer any questions regarding our current and proposed projects. Marty Hon also attended regarding Bridge No. 48, with the
proposed steel grid decking. George stated that he had received a phone call from Brandi Fischvogt requesting a letter to transfer surplus funds in Bridge No. 110 to our other current bridge projects. George had prepared a letter for the Commissioners to sign and a spreadsheet showing the bridge projects. The total surplus funds to be transferred are $486,823.20 and distributed as follows:
Railfence Bridge No. 110 $ 1,823.20 Railfence Bridge No. 111 $ 120,000.00
Enochsburg Bridge No. 73 $ 43,000.00 Blue Creek Bridge No. 94 $ 200,000.00
Pipe Creek Bridge No. 48 $ 122,000.00
John Graf recommended that funds be transferred for Railfence Bridge No.’s 110 & 111 and Blue Creek Bridge No. 94 and the others after projects are bid. Joe Gillespie, County Surveyor reported that the Right‐of‐Way for Enochsburg Bridge No. 73 will be approved after he submits additional information that had been requested. John Graf also reported that Railfence Bridge 110 for the Notice of Intent for the silt fence for soil erosion will need to be re‐advertised and will need copy of proof of publications.
Eric Roberts moved for Tom Wilson to sign Notice of Intent. Don VonderMeulen seconds the motion. Tom Wilson, All in Favor. Motion carried.
Eric Roberts moved to move $120,000.00 from Bridge 110 to Bridge 111 and not the rest. Tom Wilson seconds the motion. After much discussion and Tom Wilson talking to INDOT Officials, Eric Roberts moved to rescind previous motion and moved to sign letter prepared and presented by George Hartman. Don VonderMeulen seconds the motion. Tom Wilson, All in Favor. Motion carried.
PIPE CREEK BRIDGE NO. 48 – George had presented Minutes prepared by Farrar & Garvey & Associates of the Field Check Meeting that was held on March 12, 2008 at the project site, these are on file in the Commissioner’s Office and Auditor’s Office. Presented a revised Right‐of‐Way Sheet for Joe Gillespie to used in the Acquisition of Right‐of‐Way. Earth Explorations completed the soil boring for subsurface conditions. Farrar, Garvey & Associates had also submitted an Invoice for $5,130.00 for Engineering Services including design and environmental work. Presented a letter from the State Historic Preservation Officer, regarding Section 106 for the use of the steel grid decking. It will be considered an adverse effect. SHPO is willing to accept a Memorandum of Agreement to deal with the Adverse Effect.
BRIDGE INSPECTION PHASE I – Farrar, Garvey & Associates had presented a LPA Voucher and Invoice for $1,244.00 to receive 80% ($1,075.20) Federal Highway Funds reimbursement through INDOT .
FAIRFIELD‐CAUSEWAY BRIDGE NO. 144 – Weiss, Jansey & Elsnor will complete the Phase I Critical Inspection in June 2008.
SNOW HILL COVERED BRIDGE NO. 102 – Received Invoice from Farrar, Garvey & Associates for $3,000.00 for Professional Services.
BLUE CREEK BRIDGE NO. 94 – John Graf, Joe Gillespie, Brian DeFossett and George had met at the project site last Wednesday, April 2, 2008 to determine the feasibility of having Franklin County Highway Department paving the north approach to the proposed bridge.
