MEMORANDUM & MINUTES
August 11, 2008 @ 9:00 A.M.

Tom Wilson opened the meeting with the Pledge of Allegiance.
BROOK HILL
DRIVE George Gillman presented a Letter to the Board of Commissioners requesting the County to accept Brook Hill Drive, a road in Brook Hill Estates Subdivision as a county road. In his letter he stated all guidelines for construction of this road have been met and approved by Franklin County authorities. The mandatory one year grace period, as stated in the guidelines, has now expired and further action is now necessary. There is a child that lives on this road and until the road becomes a county road, the school bus will not pick up this child. Don VonderMeulen will get with George Hartman, Brian DeFossett and Larry Franzman to review this road. We will make a decision at the next meeting.
REX/WHITEWATER
RIVER ADVISORY
BOARD This past Wednesday, August 6, 2008, the Whitewater River Advisory Board had met with Pete King, Attorney for the Hoosier Hills Water Corporation in regards to the REX Pipeline on what the Advisory Board can do for Hoosier Hills Water. The Whitewater River Advisory Board is an advisory board to the Area Plan Commission.
DOG BITE
ON JIM RUN
ROAD Amber Everman a volunteer at the Animal Shelter reported that there was a dog that had been attached by (3) other dogs that had not been on a leach, while their owners walked down the road. There was a family member in the Marcum Family that had been bitten while attempting to break up the dogs. The family wants the dog put down. The dog was only trying to defend itself after being attached by three dogs.
Tammy and Barbara Marsh was also present, they have filed complaints on the three dogs that have been loose and not being leached. They want to adopt the dog that was attached, it is not a danger. The Marsh’s have been feeding the dog for three weeks.
Tom Wilson reported the dog is in the pound and will evaluate. The dog will be taken to the Vet and given shots.
Terri and Keli Marcum owners of the three dogs that had attached the dog that had bitten on of them. There are wanting the dog destroyed. They were also told that there is a leach law, that they say they didn’t know about the law. Terri Marcum asked if they the Marsh’s would be liable for the doctor bills. Tom Wilson said that is a civil matter.
HIGHWAY ENGINEERS
WEEKLY REPORT
RAILFENCE BRIDGE 110 & 111 – George Hartman, Highway Engineer presented to the Commissioners a Local Public Agency (LPA) Project Coordination Contract between the Indiana Department of Transportation and Franklin County for the Commissioners Approval and Signatures. Eric Roberts moved to sign LPA Contract with the Indiana Department of Transportation for Railfence Bridge 110 & 111. Don VonderMeulen seconds the motion. Tom Wilson, All in Favor. Motion carried.
George also mentioned the Construction Engineering Contract between Franklin County and Clark‐Dietz Engineering. George talked to Kevin Loiselle of Clark‐Dietz and contract will be submitted to Brenda Fox of INDOT for review by August 8th. George had not yet received the copy for the County to review.
BLUE CREEK BRIDGE 55 – George reported that he had received a phone call from Kevin Loiselle of Clark‐Dietz and the Special Feature Inspection was set for Wednesday, August 6, 2008 for the Pin and Hinge Support System Inspection. George reported nothing was found and will be receiving an Inspection Report.
FAIRFIELD CAUSEWAY BRIDGE 144 – George mentioned that on July 30th, Kevin Loiselle stated that further review of the structural steel details on the Fairfield Causeway Bridge 144 require detailed arm length inspection. There is a ¼” or less gap between the welds. These structural details were not checked in June, 2008 by Wiss, Janney & Elstner. The platform truck was scheduled for Thursday, August 7th, and Friday, August 8th. Also talked to Kevin about the 8” diameter cast iron down spouts that have been breaking away from their supports under the bridge inlet drains. There is concern about these pipes falling from the bridge, requires the pipes to be removed. Highway Employees were to complete this work, but were unable to, due to the employees not meeting the training requirements.
MID ROAD 71 – Verizon Field Operations still have not received an work order from Officials in Lafayette to relocate their poles and cable for their service. Was told to would take two to three days to complete the relocation after they receive the order.
FEMA DR‐1766‐IN – George reported that Levee Road does not qualify for FEMA Funds, since the flooding of the Whitewater River did not cause any damage to Levee Road itself. Will check into funding through Watershed and Soil & Water Conservation Grant Funding. The County will be receiving worksheets for Stone House Road, Harvey Branch Road and Wolfe Creek Roads that were affected with the Spring Flooding. Don VonderMeulen mentioned as soon as we know we may be eligible for funds, we then can proceed for funding for the 25% match that will be required through the Lilly Foundation.
GASB 34 – George had presented copies of the Bridge Inspection Reports for the GASB 34 Reporting, will work on the roads and small bridges and culverts report.

EXECUTIVE
SESSION The Board of Commissioners called an Executive Session for Thursday, August 14th @ 8:00 A.M. in the Ms. Hamilton Room for Personnel Issues at the Security Center.
LPA CLAIMS
SIGN PROJECT Ton Wilson motioned to sign LPA Claim Voucher in the Amount of $35,000. for the Sign Project Reimbursement Grant. Don VonderMeulen seconds the motion. Eric Roberts, All in Favor. Motion carried.
HARRY
GRAVES Harry Graves presented paper work to the Commissioners in regards to the Executive Session that had been scheduled for Monday, August 11, 2008. Mr. Graves asked does the County claim any exemption from the Public Excess Laws. Tom Wilson said No. Mr. Graves faxed the posted documents to the Commissioners and stated that they are in violation of the IC Code for Executive Sessions. Mr. Graves said he had brought this to the Commissioners attention at the Executive Session and then was physically removed from the Ms. Hamilton Room, from a Public Room. John Estridge asked if Harry was upset that the IC Code was not put down on the notice. Harry Graves said it does not follow procedure as per code. Eric Roberts mentioned we were there with our Legal Council. Tom Wilson said we acknowledge your documents you presented.
PAYROLL Tom Wilson motioned to approve payroll. Eric Roberts seconds the motion. Don VonderMeulen, All in Favor. Motion carried.
ADJOURN Eric Roberts motioned to adjourn. Tom Wilson seconds the motion. Don VonderMeulen, All in Favor. Motion carried.
