Tom Wilson opened the meeting with the Pledge of Allegiance.
REPORT Susan Jones, Auditor reported that taxes are due Friday, August 22, 2008.
Ed & Chris Derickson had provided plans for a Planned Unit Development on Fassold Hill located on Reservoir Road and State Road 101. The Unit Development set on 40 Acres and for the plans to precede the property needs to be re‐zoned fromResidential‐1 to Planned Unit Development. A favorable recommendation came from the Area Plan Commission on August 13, 2008. The Unit Development would be in 4‐Stages, plans are 24‐Ranch Homes, 22 Tower Homes, 54 Condos and Commercial Development. Larry Franzman reported that this Planned Unit Development would still need to go before the Town of Brookville. The Commissioners today would amend the zoning for this area. The Developers are requesting the zoning change to allow them to proceed with developing the plan. Soil Borings would need to be done for soil types. A Drainage Plan will need to be designed before it comes back to you, they will need a Rule 5 approval from the State. The Property has water and sewage available. Eric Roberts asked how the new zoning text is compared to the old. Larry Franzman stated he feels there is no difference; the development would have local control. Eric asked about the 3‐story condo’s regarding fire protection. Larry said this is something that would need to be discussed.
Mary Lou Cox, a Property Owner that is located at the bottom of the hill is concerned about drainage when clearing is done for the development. There is a lot of water coming down off the hill right now. Not against the development, just have concerns on drainage. Dan Gengler, another Property Owners replied we have all the water we can handle right now. The Drainage Plan needs to be done right. When the trees are cleared we’re going to have problems. Have no problem with the development. Stanley Monroe asked about the retaining walls that set behind Mrs. Cox’s residence. Mrs. Cox said the retaining walls were built to hold back the hill. Eric Roberts asked if there is a bonding procedure if there are problems and the developer moves out. Would there be something to help the landowners. Larry said not in the zoning part, but later when the building would start, could asked the development to set up. Rene Stivers feels we have a situation that is very positive.
Don VonderMeulen made motion to amend the zoning maps for this Unit Development Parcels. Eric Roberts stated is not in favor of granting re‐zone.
Eric Roberts is requesting a letter from the town in regards the water, sewage and future annexation. Letter from the Local Fire Chief in regards to the height of the 3‐Story Condo’s for fire protection and a List of Covenants that would apply to the development. Would also like a little more information on the retention ponds and drainage plan. Not against the development, just want a little more information.
The Planned Unit Development is to be presented to the Town of Brookville on August 26th and bring back to the Board of Commissioners on September 2nd.
Eric Roberts moved to table the Plan Development Re‐Zone for Amendment to the Zoning. Don VonderMeulen seconds. Motion carried.
TOWER Ed Hollenbach, EMA Director has concerns with the size and height of trees around the Communication Tower on top of the Park Hill. They are putting in a camera system in and are getting shadows. If the trees fall, it would put out the radio system. We have EMA Volunteers that would cut 3‐5 trees, have 2 that are too big for them to cut. Could take bids for cutting down the trees to sell or cut for fire wood for the County Park to sell. Eric Roberts would like to talk to Jeremy Weber, Extension Agent about the trees. Mobilcomm has suggested putting in motion sensors for $450.00 could pay for out of Tower Maintenance. Also said it is dark up there at night, if trees are cut to the south, a pole light can be put up for safety. It could be wired up to the generator system and put an infra‐red light in.
Ed Hollenbach, EMA Director also presented a Sub‐Grant Agreement for 2007 Emergency Management Performance Grant for reimbursement of salaries for EMA. The sub‐grant is for an amount not to exceed $22,585.16. The grant will be based on a points system in the future, 10‐points will be deducted right off the top because of the director being a part‐time position.
Ed reported he is working on the NIMS Compliancy and in process of eliminating some of the departments and have all incorporated towns, except Mt. Carmel in compliance.
Eric Roberts moved to sign the Sub‐Grant Agreement for Reimbursement of Salary. Don VonderMeulen seconds the motion. Motion carried.
Letter was received from David C Smith, Director of Implementation Project Hoosier SAFE‐T. Requesting Franklin County concurrence for the use of an omni‐directional antenna on the radio site in Batesville, which will be known as Site 7513. The Integrated Public Safety Commission is planning to construct a Project Hoosier SAFE‐T radio site south edge of Batesville in Ripley County for the purpose of improving primary 800MHz public safety radio coverage in the surrounding area.
Don VonderMeulen motioned for Tom Wilson to sign the Letter to concur with request from Hoosier SAFE‐T Site. Eric Roberts seconds. Motion carried.
GARDEN CLUB Don VonderMeulen moved to allow the Garden Club the use of the Courthouse Steps on September 13th for the use for a Plant Sale. Eric Roberts seconds. Motion carried.
Mike Rauch of St. Peters Parish had contacted the Commissioners requesting the St. Peter’s Road be closed at Noon on October 18th for the Parish to celebrate their 175th Anniversary by having a small parade. He had talked to the Sheriff’s Department.
Eric Roberts moved to allow St. Peters Parish to Celebrate their 175th Anniversary at 12:00 Noon with a Parade by having St. Peters Road Closed at that time. Don VonderMeulen seconds. Motion carried.
PIPE CREEK ROAD BRIDGE #48 – George Hartman, Highway Engineer mentioned that Cark‐Dietz Engineers had completed a Draft Memorandum of Agreement, between the Federal Highway Administration and the State Historic Preservation had been sent to the consultants for review, they have until August 25, 2008 to comment. With regards to the change from concrete deck to steel grid decking. Also presented a copy of public notice sent to adjacent property owners with regards to N4 Form for the IDNR Permit Application.
FAIRFIELD CAUSEWAY BRIDGE 144 – George reported that there was a site meeting on August 12 and was attended by Eric Roberts, Larry Franzman, Chester Ball and Brian DeFossett to discuss the cast‐iron downspouts and replacing them PVC Pipe. George also presented a letter from Rustoleum on the analyzing of chips of paint from the bridge painted by the Army Corp of Engineers in 1972. It detected some lead in the paint chips.
PIPE CREEK LOW WATER CROSSING BU‐1901 – George presented pictures of the large cracks in the concrete roadway surface of the low water crossing and debris that is blocking the opening of the culvert pipes. There was discuss on replacement, but would be a major project, with having to build the road surface up. Immediate attention would be to do repairs to the concrete surfaced and clear debris.
BLUE CREEK ROAD BRIDGE 94 – John Graf of Howard J Barth & Associates asked about the Right‐of‐Way for Blue Creek Bridge 94. Joe Gillespie, County Surveyor is waiting for appraisals for 2‐Parcels.
FEMA STORM DAMAGES TO COUNTY ROADS – George reported that FEMA Funding for the (4) Roads in Franklin County are not eligible for funding for any of the repairs. The County will be looking for assistance through the Lilly Foundation.
GIS MAPPING The State of Indiana is requesting for County GIS Data Information to build a State Wide Map. There is up to $14,894 per County available from IDHS to specifically offset the making of the data available. George asked the Commissioners to review and have Keith Bias of WTH and Gene Stewart to review the proposal.
SYSTEM Jay Shullman presented application for T‐1 Line, the price has changed from $1,200 to $100 a month during contract this should be a better deal.
SIGN PROJECT Don VonderMeulen made motion to sign LPA Claim Voucher for reimbursement in the amount of $61,953.44 for the Sign Replacement Project. Eric Roberts seconds. Motion carried.
FORMS Eric Roberts moved we sign the Liability Waver Forms form the Small Animal Control for volunteers. Don VonderMeulen seconds the motion. Motion carried.
MINUTES Eric Roberts moved to approve the Minutes of August 4, 2008. Don VonderMeulen seconds the motion. Motion carried.
REPORT Eric Roberts moved that we acknowledge the Clerk’s Report of July 2008. Don VonderMeulen seconds. Motion carried.
Eric Roberts moved to acknowledge the Resolution of the Whitewater River Advisory Board of Franklin County, Indiana Condemning the Location of a Certain Forty‐Two Inch (42”) Natural Gas Pipeline Proposal Submitted by Rockies Express Pipeline – East (Rex‐East) Owned and Operated by Rockies Express Pipeline, LLC. A Copy to be forward to the Area Plan Commission. Don VonderMeulen seconds the motion. Motion carried.
