Eric Roberts opened the meeting with the Pledge of Allegiance.
WEEKLY
REPORT Sharon Halcomb, Assessor reported she had not been able to forward assessed values to the Auditor’s office as planned. Checking geothermal exemption right now. Wanting to make sure everything is on to cut down on Certificate of Errors. Susan Jones has nothing new to report.
MINUTES Tom Wilson motioned to approve minutes of January 5, 2009 and January 12, 2009, also to include minutes of executive sessions January 5, 2009 and January 12, 2009. Don VonderMeulen seconds. Eric Roberts, All in Favor. Motion carried.
HIGHWAY
ENGINEER REPORT
SNOW HILL COVERED BRIDGE 102 – Kevin Loiselle of Clark Dietz was present and said Commissioners had concerns about there being enough space in the future to put in a by‐pass bridge alongside the Snow Hill Covered Bridge. Kevin presented drawings of the area that Howard J Barth had prepared showing there is enough room for a bridge. There was concern that the covered bridge after rehabilitation still would not allow fire trucks to cross. Kevin Loiselle reported it will have a H16 Rating (16 Ton Load Limit) to accommodate school buses and small trucks and a H34 Rating (34 Ton Load Limit) to accommodate Fire Trucks and Small Semi’s (3‐axle).  The Estimate Construction Cost is $777,000.00. Kevin is working on putting the final plans together. Clark Dietz is requesting additional funding in preparing drawing for a sprinkler system building. Eric Roberts asked about the Construction Engineering Services. George Hartman said it is already gone through the selection process and is in place.
PIPE CREEK BRIDGE 48 – George reported the Planned Improvement Public Notice is being advertised, public comments are due February 4, 2009. If a Public Hearing is not required then final processing can be completed. Acquisition of Land for Right‐of‐Way process still needs to be done awaiting approval of the environmental review. Cost estimate for the project is $830,000.00 and fees for construction inspection cost are $124,500.00. It will be necessary to make a request for additional funding before February 23, 2009.
BRIDGE INSPECTION PHASE II – Kevin Losielle of Clark Dietz has presented LPA Claim Voucher No. 15 Phase II Underwater Inspection in the amount of $12,920.00 with federal 80% reimbursement of $10,336.00, for report and special assessment to Blue Creek Bridge 55 and Fairfield Causeway Road Bridge 144. The underwater inspection of Silver Creek Bridge 46 will be determined by INDOT. Eric Roberts stated we need to start the process in putting Bridge 144 in the federal bridge project list to make necessary repairs to the bridge.  Tom Wilson motioned for Eric Roberts to sign LPA Claim Voucher No. 15 for Bridge Inspection Phase II. Don VonderMeulen seconds the motion. Eric Roberts, All in Favor. Motion carried.
ENOCHSBURG COVERED BRIDGE 73 – George reported Bids were opened for the Enochsburg Covered Bridge Rehabilitation Project on January 14, 2009. Duncan Robertson, Inc. was Low Bid in the amount of $311,000.00. This bid was below INDOT’s adjusted engineer’s estimate of $490,000.00. There will be an invoice in the amount of $31,000.00 to Franklin County for the Local Matching Funds for the construction phase. A Pre‐Construction meeting will be coming up. The bridge would be closed for 6‐months. Jim Barker had contacted George to discuss a test project to install strain gages on the steel rods and truss members of this bridge. Grant funds had been granted to a University to analyze bridges under live load conditions.
NORTH HAMBURG ROAD – George reported that he contacted James H Drew Corp for a cost estimate for the installation of the guardrail that had been destroyed on North Hamburg Road. An estimate is needed for damages to be paid by the insurance of the vehicle that had crashed into the guardrail. The County will need to notify them when to do the installation.
BLUE CREEK ROAD BRIDGE 94 – Don VonderMeulen asked George about Bridge 94 if we moved ahead on this bridge it still would not make it for it to be part of the stimulus package. But would like to authorize Joe Gillespie and Gene Stewart to start the condemnation process for the Bolser Property. Eric Roberts has concerns with funding, we have the construction of Railfence Bridge 110 & 111, Enochsburg Covered Bridge 73 and possibly Snow Hill Bridge 102, and we won’t have the funds this year to do another bridge. Tom Wilson would like to have the right‐of‐way in place.
Don VonderMeulen moved that we authorize Gene Stewart to proceed with condemnation procedures for Blue Creek 94. Tom Wilson seconds the motion. Eric Roberts, All in Favor. Motion carried.
ECONOMIC
DEVELOPMENT
Tom Linkel, County Council Member reported that Rene Stivers had stopped and talked to him and said he had a contract with the County Commissioners for him as Economic Development Director. To him it looks that he is still an employee of the County until he receives notification. Right now he is an unfunded employee. There should have been a letter sent to Mr. Stivers from the Commissioners that he is no longer a County Employee. Tom Linkel said there was no job description for the Director of Economic Development. They are saying the equipment was purchased with Corporation Money. Tom Linkel feels that money is still tax payer money. Eric Roberts suggestion is for the Economic Development Commission to go before Council tonight and see what happens. This is out of our hands when Council put the 1984‐1 Ordinance back in place. Tom Linkel said he cannot personally put funding in place until the mistakes made in the past are corrected before we go on and funding is brought back to the County. Tom Wilson said a letter needs to be written requesting the funds back. Roy Hall and John Estridge feel there should be a state police investigation into the funds that is being held by the Corporation. The Commissioners had asked that a letter be sent to Rene Stivers at the end of the year, letter was not sent. Don VonderMeulen feels we should maybe send Rene’ a letter. Tom Wilson motioned to send Rene Stivers a letter that funding has ended December 31, 2008 and has terminated his position. Don VonderMeulen seconds. Eric Roberts stated, he be terminated as per agreement and have Commissioners and Rene sign. Motion carried.

FOUNDATION
LETTER Tom Wilson motioned to sign Letter to the Brookville Foundation for the Grant received for Landscaping for the Lew Wallace Park in the amount of $7,660.54. Eric Roberts seconds. Don VonderMeulen, All in Favor. Motion carried.

OF REVENUE
STATE & USE TAX
FORM Don VonderMeulen motioned for Eric Roberts to sign the 2008 Sales and Use Tax Form to the Indiana Department of Revenue. Tom Wilson seconds. Eric Roberts, All in Favor. Motion carried.
U.S. CENSUS
WORKSHEET The Commissioners received a packet from the U.SA. Census wanting information regarding homeless shelter, soup kitchens for the homeless. Carol Westerman had contacted the Division of Family and Children and was told there was no shelter.
Tom Wilson moved we sign the U.S. Census Worksheet and mail. Eric Roberts seconds. Don VonderMeulen, All in Favor. Motion carried.
