Commissioner Mtg. 07/02/07 @ 9:00 a.m. in County Commissioners Room
Those present:

Thomas Wilson opens meeting with pledge of allegiance
I. Weekly Tax Report
a. Carol L. Monroe – we have the 1782 notice and I will fill that out and send it back
b. Thomas Wilson – when do you think they will be ready to mail?
c. Carol L. Monroe – should be around the first of August
d. Thomas Wilson – can people come in and pay some at last year’s rate?
e. Rebecca Oglesby – yes
II. Bad check fee
a. Rebecca Oglesby – wants to increase/add bounce check fee
b. Thomas Wilson – will have to get with attorney (Eugene Stewart)
III. Lynch Fireworks Agreement
a. Tammy Davis – (the) Judge encouraged us to come to come sort of agreement
b. Thomas Wilson – questions new law for commissioners setting ordinance on fireworks
c. Tammy Davis – yes, on consumer fire works. He has “special” fireworks
d. Larry Franzman – he is a wholesaler. He has a special permit from the state. The state has wrote the
law in such a way that the fire chief is the only one that has to sign off. If he meets all of the criteria,
the fire chief has to sign off on it.
e. Tammy Davis – we went to court with 10 neighbors and sat down and worked out with this degree.
This (current) application lets him set off from 3:00 p.m. -11:00 p.m. (Reviews new agreement) ex:
Lynch shall provide ten days notice to any change of day notice. No fire works before 6:30 p.m. or
past 11:00 p.m. Salutes (really loud ones), shall not be used past 9:30 p.m. Lynch may have display
of fireworks twice in one month. Lynch shall not keep or store fireworks on property. Lynch shall
display site plan with Cedar Grove Fire Dept. At the meeting one of the concerns for Mr. Lynch was
Commissioners/County not to bother him as long as Mr. Lynch meets everything.
f. Eric Roberts – this goes on year to year?
g. Tammy Davis – yes, until someone petitions the court to change.
h. Larry Franzman – if the law changes and says zoning applies, that document no longer applies.
i. Tammy Davis – yes. The state can go after him, just not the A.P.C. (area plan commission)
j. Thomas Wilson – we are just trying to make the best of a bad situation.
k. Larry Franzman – this agreement stops him from going down one evening and setting off bombers for
20/30 minutes
l. Thomas Wilson – are the neighbors satisfied?
m. Tammy Davis –they are not happy, but are in agreement
n. Thomas Wilson – if he lets off after 11:00 p.m., who regulates it?
o. Tammy Davis – the Fire Marshall is the one who signs off on it; he would have to shut it down. I
don’t think it will go that far, he wants to comply.
p. Eric Roberts – move to sign agreement

s. Thomas Wilson – we will need a copy of everything
t. Tammy Davis – yes, once the judge signs off on it.

IV. Contractor bonds (working in the county)
a. Thomas Wilson – we have contractors not completing their work and we are wanting to do an
ordinance to make contractors bond
b. Larry Franzman – they should have a yearly bond. Sometimes you have someone that wants to hire
their brother, and those are the worst ones.
c. Don Vonder Meulen – was wondering if you could just suggest it?
d. Larry Franzman – your better contractors will already have bond. This is what we want to insure we
have an insurance policy.
e. Don Vonder Meulen – could we have a set amount, say if it is over $20,000.00 then require a bond?
f. Larry Franzman – we could do that
g. Thomas Wilson – what if we approve it at an inspection and it is bad
h. Larry Franzman – that has only happened only two or three times since I have been here
i. Thomas Wilson – we are worried about protecting our citizens
j. Larry Franzman – they do a 45 day check. It takes a while for one of these policies to be issued.
k. Don Vonder Meulen – they are not that terribly expensive
l. Larry Franzman – no, it is not that bad. It starts at $300.00. It is an insurance policy.
m. Thomas Wilson – I am willing to do it.
n. Larry Franzman – this would be the homeowners’ responsibility. The homeowner could take this out.
V. Permit Applications from Metamora (Dean Peercy / Jim & Connie Wendel)
a. Larry Franzman –I have not got a chance to look. I would like to drive to Metamora to make sure
they meet setbacks, etc. I have not had a chance to look at anything. Ask that you wait until next
week; would feel better if I could review it first
VI. Puck-in-Wah
a. Larry Franzman – they gentleman doing the work/he is doing it all on his property. It is a legal
matter. There is a six inch pipe that has been added. (I’m) worried about the pond reaching the road.
VII. Safe Passage (2008 Budget Request)
a. Debbie Guzman – we service Franklin County. We have life skill classes, etc. We have a shelter in
Batesville. We have a safe place for folks that are suffering from violence in the family. The reason I
am here, as far as I know Franklin County has not included safe passage in their budget. Last year
23% of clients were from Franklin County and this year it is up to 25%.
b. Susan Jones – in your letter you did not ask for an amount
c. Debbie Guzman – counties give fifty to five thousand. I will leave that up to your discretion.
VIII. Weekly Highway Engineer Report, George Hartman
a. Bridge #100 / Johnson Fork Road over Tributary of Johnson fork North of Snowhill Road Covered

b. Bridge #144 / Fairfield Causeway over Brookville Reservoir
i. In April 2006 Kevin Loiselle wrote letter to Marshall Graham and that letter was deferred to
Corp of real estate. (see attached letter dated June 18, 2007)
ii. See excerpt from inspection report
iii. There are federal highway funds available for bridge rehabilitation.
1. there are problems with the wear and surface (flip tape)
2. may be able to work with I.N.D.O.T. if you want to make it a project
c. Bridge #17 / Laurel Road over the West Fork of the Whitewater River
i. Brian Defosset checked the project site and believes he can use backhoe to remove debris from
the (pier 3) east bank
d. Programmatic Sign Improvement Project for Franklin County (Des. No. 0501216)
i. Steve Dilk has everything he needs except for the obligation of funding. Talked to Mike
Holloway and told him we have done everything we need to do. Essentially we are waiting for
him. Mike said he thought he was close to the time when we would see the funding in place.
ii. Could stand by and wait a little longer?
iii. Don Vonder Meulen – is there anything we can do?
iv. Don’t know of anything, maybe a letter from the commissioners would be helpful.
v. Reviews size of signs with Commissioners
vi. Thomas Wilson – the smaller the signs, the more signs we can get
IX. WTH – contract/new layer
a. Thomas Wilson – the highway thought that was a good idea and the highway could take care of the
b. Keith Bias – will work with Hollie (Sintz) and consult with her to make it easier and make it more
efficient. Build a layer of all of the new signs and you will have a layer of all of the old signs so you
could compare it. If you have extra signs, you could put on that layer that you have an extra sign.
There will be a picture of the sign, G.P.S., date and time it was installed. We will have a unique
number to the sign so that if it was stolen, etc.

X. City of Lawrenceburg Grant Awarded
a. Thomas Wilson – really want to thank Tom Siedel and the town of Lawrenceburg for the grant. We
really appreciate it. Tom really worked hard on getting us that money and (we) want them to know
we appreciate it.
XI. River Road
a. Earsel Caudill – There is a campground (Newkirks) and they have been setting off fireworks for the
last week and a half. The police station tells me it is the fourth of July. There is 100/150 people in
there every weekend. They are living in them. There is no sewage in there. Have talked to Larry
Franzman two or three times. Nobody seems to want to deal with it. I only got three hours sleep last

something about these fire works

XIX. Reconvene-Preconstruction (meeting) of Courthouse Remodeling/Renovation Project
a. Derry Condon (Lamson and Condon Arch) – questions general (contractor) for builders risk insurance
i. Bill Gutzwiller – easiest thing would be to have building re-insured.
ii. Derry Condon – performance and payments bonds send to Susan Jones.
b. Eric Roberts – biggest question is on page 2/3.3 (of contract) = substantial completion of work not
later than 30 days of completion. Needs to be changed.
i. Bill Gutzwiller – show just over an 11 month construction schedule.
ii. Derry Condon – substantial completion will be June 6, 2008.
iii. Bill Gutzwiller – we are going to do a mechanical bar chart and the electrical will just have to
follow sequence
c. Derry Condon – will need a preliminary schedule/pay request. For change orders, don’t want to hold
job up. May give you a verbal, just to keep things up. Temporary space for contractors?
i. Bill Gutzwiller – we will probably go to first floor/conference-maintenance room. Will just
need one trailer
ii. Eric Roberts – behind grey building or “old” senior citizens
d. Derry Condon – entrance to site for construction personnel. Suggest using north entrance and not
south. For entrance to building, use back/south entrance.
i. Bill Gutzwiller – will have to bring masonry block in thru the north entrance.
ii. Derry Condon – need to check with local fire chief; may have to keep both entrances open to
iii. Eric Roberts – 2/3 of people doing business use the back door.
iv. Bill Gutzwiller – we may just scaffold this.
v. Susan Jones – our handicap entrance is in back.
vi. John Obermeyer – will entrance be secure
vii. Bill Gutzwiller – yes. After major shaft is done we will not be on the first floor
e. Bill Weberding – we will have to be in ceiling to do some plumbing. Maybe move out of those rooms
when we are working
i. Bill Gutzwiller – that will probably be half way into project
f. Bill Gutzwiller – we will build around the two stairs
i. Derry Condon – that is important. Then you will build an access door to help control dust.
Construction start July 9th. Contact person is Eric Roberts. We can always get a hold of Susan
Jones-just to keep things on schedule. I can be here in a couple of hours.
g. Derry Condon – Anything happening in the next 6-8 months
i. Marlene Flaspohler– election in May. Absentee starts in April.
ii. Eric Roberts – any concern, we will need to know something 2-3 weeks ahead of time.
h. Derry Condon – could we get some signs for people to use front entrance for their own safety
i. Bill Gutzwiller – yes.
i. Bill Gutzwiller – There may be some power outages.
i. Derry Condon – you could pick a holiday to change the service over
ii. Dick Rosenberger – yes
j. Derry Condon – any guess on when elevator/equipment may be here
i. Tom Bercing – ¾ week for layouts and then 5/6 weeks to get it here once we get approvals
ii. Derry Condon – that is not bad
iii. Tom Bercing – will probably take 2/3 days to (drill) – jack work. (It) will be noisy
iv. Bill Gutzwiller – we really don’t know what we are going to hit until we get down there. You
are going to be in sand in gravel
k. Derry Condon – there is not smoking in building. Is there any area for contractors to smoke
i. Eric Roberts – by smoking urn.
ii. Derry Condon – just keep it clean. Be conscious of area. Will be taking a few photographs of
site. Just put is back like it was.
l. Derry Condon – Ask that shop drawings be reviewed by contractors. If there is something you change,
just circle or highlight it.
i. Bill Gutzwiller – I need two
ii. Derry Condon – I need one
iii. John Obermeyer – lets say six
iv. Bill (blue stripe) I normally send ten
v. Derry Condon – I just need copy of transmittal
m. Bill Gutzwiller – how many sample of floorings/colors
i. Derry Condon – I only need one
n. Derry Condon – when John or his staff or myself visit the site we will hammer that right out. There is
a claims schedule. I would like to have it in my office seven days prior when they are due to her
(Susan Jones). We have to meet that schedule, the owner pays like clockwork, but it has to be in on
time. Retainage, if owner is happy, if clerk is happy, then there will be no retainage. Burt-as we make
changes, just keep track of it. Any security measures we need to discuss
o. Doug Flaspohler – the window to shaft needs to be secured
i. Eric Roberts – the door to Marlene’s office needs to be sealed up and maybe even cover that
stair well.
p. Derry Condon – normal (summer) hours are 7:00 p.m. – 3:30 p.m. and back an hour in the winter.
You will have one of the owner’s keys and the owner will have one of your keys.
q. John Obermeyer – there are some narrow door ways, maybe order things disassembled and assemble
it once in. coil units need to be same size or a little larger
r. Derry Condon – toilet room for construction personnel?
i. Bill Gutzwiller – as long as we can would like to keep one active on second floor
ii. Derry Condon – clean up the best you can daily. It is going to be a mess in here when you start
taking out walls.
s. Don Vonder Meulen – wondering some sort of construction tents to keep people out.
i. Derry Condon – that might help.
ii. Bill Gutzwiller – we can do that
iii. Eric Roberts – at least fencing around the dumpster.
t. Larry Franzman – the handicap spot
i. Eric Roberts – that will not be touched
u. Susan Jones – the air and heat will not be going down for a while?
i. Bill Weberding – I won’t have any equipment for 6-8 weeks.
ii. John Obermeyer – we will have to do some testing before then. Maybe September area.
iii. Derry Condon – how long will existing system take?
iv. Bill Weberding – a week or two
v. Eric Roberts – coordination meetings
i. Derry Condon – every other week. I want it the same day and time every other week. We do
need one of the commissioners at these meetings
ii. Eric Roberts – Friday? Or 1st and third Monday?
iii. Bill Gutzwiller – rather go at 1:00
iv. Derry Condon – 1st and 3rd Monday at 1:00 p.m. unless holiday, then Tuesday.
