Tom Wilson opens the meeting with the Pledge of Allegiance.
Tom Wilson motions to go in the Ditch Board/Drainage Board Meeting. Don VonderMeulen seconds the motion. Motion carried.
ROCKDALE
DRAINAGE ISSUE
Joe Gillespie, County Surveyor reported that last Wednesday during the heavy rains a property in Rockdale along Johnson Fork Road is being flooded by water coming across the road from the churches parking lot (1190 Johnson Fork Road). Joe is requesting permission to write a letter to the church to correct the problem. Permission was granted.
REX
PIPELINE Joe had presented a copy of a Termination Notice Construction in a Floodway from the Department of Natural Resources (DNR) for the Big Cedar Creek Stream Crossing. The signed document constitutes the termination of Rex’s application by the DNR. The termination may be appealed by applying for an administration review. Tom Ritz replied no exceptions in the 1989 zoning text ordinance, no special exemption for utilities. Joe explained the special exemption was for the Big Cedar Stream Crossing. Don VonderMeulen asked what we would get out of an administration review. Joe said we would request a review for the five feet of cover beneath the stream and three feet of cover in the banks, the Big Cedar Creek is a highly erodible stream. Our entire creek has a high violicty of water. It was asked if notices have been received for the Blue Creek and Wolfe Creek Stream Crossing. Joe relied no he had not.
Tom Wilson made motion to appeal by applying for an Administration Review for the Big Cedar Creek Stream Crossing Special Exception. Don VonderMeulen seconds the motion. Motion carried.
STAVETOWN
DRAINAGE
AREA Joe Gillespie, County Surveyor reported that he had been at the site 3 to 4 days last week to evaluate the drainage issues at Stavetown. He had seen a pipe has failed on Old Blue Creek Road and water is gathering between the railroad track and Singer’s Property. John Seal and Dave Montgomery are present today, along with Dick Schmid. They had all went over the Drainage Area and discussed the issue coming to a conclusion that the hospital project is not the problem. Dick Schmid would be acceptable to put a pipe at the coroner of his property where the pipe needs to be replaced, may need to do some dredging. Joe will get with Mr. Schmid at the site to put a plan together.
The Ditch/Drainage Board meeting was closed and regular meeting re‐convened.
BY‐LAWS OF FRANKLIN
COUNTY DEVELOPMENT
CORPORATION
Rene Stivers, Franklin County Economic Development Director presented By‐Laws of Franklin County Development Corporation and feels they are ready to be signed. Tom questions Rene being the Chairman of the Board. Rene said their Attorney feels that it would be okay since he was not be in the decision making or voting. Tom asked if the Commissioners wanted something changed in the By‐Laws could they. Rene said they would make recommendation for the changes to him and he would in turn take to the Board. Don asked if their appointment member be a Commissioner or someone else. Rene feels it probably should be a Commissioner.
Don VonderMeulen made motion to approve the By‐Laws for the Franklin County Development Corporation as submitted by Rene Stivers. Tom Wilson seconds the motion. Motion carried.
LETTERS OF SUPPORT
FOR LAWRENCEBURG
RIVERBOAT REVENUE
GRANT FUNDING
Rene Stivers had presented two Letter of Support for the Lawrenceburg Riverboat Revenue Grants that are being submitted for funding. The first being supporting the application for an Industrial Park in Franklin County and the second being the support the application for the Brookville Immediate Care Expansion.
Tom Wilson made motion to sign both Letters of Support. Don VonderMeulen seconds the motion. Motion carried.
EMA 2008
GRANT FUNDING
Ed Hollenbach, EMA Director stated that District 9 had received notice that 2008 Grant Moneys are available. Ed will be submitting application for funding for $11,080.00 in Grant Monies for 800 MHZ Radio’s, he has until March 28th to submit application. If Grant is approved, it would provide radio’s to Emergency 1st Responders and Dispatch. It was also discussed putting in a generator for the Government Center and Gym, Franklin County does not have an emergency shelter and would also provide base for surrounding counties. Ed will get with Don this afternoon to put together information to submit grant.
HIGHWAY ENGINEER
WEEKLY REPORT
FEDERAL AID PROJECTS – George Hartman, Highway Engineer reported that INDOT has scheduled a Public Hearing to be held on March 31st for LPA’s regarding bridge project request for funding. There will be eleven counties present. Franklin County has six bridges on list for federal aid funding. They are Bridge 10, Duck Creek Road – Bridge 48, Pipe Creek Road – Bridge 94, Blue Creek Road – Bridge 102, Snow Hill Covered Bridge ‐ Bridge 110, Railfence Road over Salt Creek – Bridge 111 Railfence Road over Harvey Branch.
George had also sent notification to Consultants for the various bridge projects for them to attend and answer questions asked. INDOT wants the LPA’s to establish a priority for this projects. INDOT is also wanting the maximum FHWA Funds that will be needed to complete these projects, this amount is based upon consultants estimates, and if local matching funds are available. They are also wanting to know how much Development Credit LPA that Franklin County is requesting. We are asking for full credit for half of our local match of construction cost, since our normal match 20% of construction. The local match should be reduced to 10% of the contractor’s bid amount.
BRIDGE 110 & 111 RAILFENCE ROAD PROJECTS – INDOT had some questions during the review process of the project plans. Drew Barth of Howard J Barth had responded to INDOT’s request for information. Some of INDOT’s staff were not familiar with LPA Projects.
BRIDGE 18 CANAL STREET OVER DUCK CREEK IN METAMORA – George had received a phone call from Harold McNeeley regarding debris collecting under Bridge 18. His concern is about the effect debris would have to possibly cause flooding to his property. Brian DeFossett, District Foreman will speak with Mr. McNeeley.
INDOT US 52 BRIDGE REPLACEMENT PROJECT – George reported that the project is tentatively scheduled to have plans ready for contract in May 2009, with bid letting in the fall of 2009. INDOT plans to have one lane of traffic with traffic signals on each end of by‐pass.
TOM RITZ Tom is questioning Ordinance 1995‐17, a copy fee ordinance. Also mentioned that Cody Ritz had given him a copy of the Zoning Text that was passed out Thursday evening that is also questioning. Asked where he can get a copy of the current text. Presented a copy of Ordinance 1998‐21, with Each day that the violation continued shall constitute a separate offense was underlined in red with (Exhibit C) written. Mr. Ritz had brought a couple with him, Jerry & Sandy Dierckman. Mr. Ritz, needs some kind of resolution to rectify the error that had occurred, all amendments need to be corrected, and says all amendments did not follow procedure. That only one meeting at area plan, need to have two meetings before it can be passed to Commissioners. Tom Ritz wants Tom Wilson to check with Gene Stewart on how to correct.
Jerry Dierckman asking the Commissioners to look at this and save County some money. To correct this without going through a lawsuit.
EMS
CONTRACT The 2008 EMS Contract had been signed by the EMS with the payment amount be changed to $60,000.00 and No. 6 being added saying the BOARD shall provide EMS with an administrative assistant, who shall be an employee of the County, and paid as an employee of the County. On January 1st EMS will reimburse the BOARD $11,250.00 which is half of the administrative assistant’s salary.

HARRY
GRAVES Don VonderMeulen had answered the questions that had been submitted by Harry Graves at that last meeting, in order to update his Codicil to his Will. Don read the questions submitted, they are as follows with answers.

Do the commissioners have a signed copy of the Current zoning text if any that can be “certified”? Yes

Mr. Graves refused to take copy that Don had presented to him, his is wanting a written letter.
COUNTY WIDE
CLEANUP The dates have been set for the County Wide Cleanup April 21 thru April 26 and April 28 thru May 3. Coupons will be put in the newspaper for free roadside cleanup disposal during those weeks. Trash bags will be available at the Transfer Station.
MINUTES Don VonderMeulen motioned to approve Minutes of March 17, 2008. Tom Wilson seconds the motion. Motion carried.

SALE OF OLD
DUMP TRUCK Tom Wilson motions to sell a Old Dump Truck (1991 International Vin# 1HTSONSN4MH387150) at White’s Machinery Auction on March 29th. Don VonderMeulen seconds the motion. Motion carried.
PIPE CREEK
BRIDGE 48 Ed Hundley asked about when Pipe Creek Bridge 48 will be reopened. It was explained that will have to do a soil borings and proposing to replace the deck with a steel grid deck instead on concrete. There are more hoops to jump through because it on the Historical Bridge Inventory. We will try to get the bridge re‐opened as soon as possible.
