Tom Wilson opened the meeting with the Pledge of Allegiance.

REPORT Susan Jones reported there is nothing new to report.

IN NEWSPAPER
ECONOMIC
DEVELOPMENT Dennis Kolb asked if the Commissioners had put the (2) paid ads in the Newspaper asking for Resumes’ for Economic Development Board going to a P.O. Box 38, Brookville address. The Commissioners said No, they had put in newspaper asking for resumes’ for various Board Appointments. Eric Roberts replied there could be something illegal going on, someone impersonating the Commissioners. Dennis Kolb said you have someone that is unelected trying to run the County. The Commissioners had asked John Estridge if he knew who put in the ads. John replied he did not have the liberty to say, that would violate the newspaper policy.
APPOINTMENT TO
VISITOR COMMISSION
BOARD Received Notice of Nomination from Franklin County Convention, Recreation & Visitors Commission that Dave Cook had been nominated by the Brookville/Franklin County Chamber of Commerce to serve through December 2008. This appointment would represent the Franklin County Commissioners Office.
Tom Wilson motioned to appoint Dave Cook to the Franklin County Convention, Recreation & Visitors Commission Board. Eric Roberts seconds. Don VonderMeulen, All in Favor. Motion carried.
Tom Wilson asked that the Commissioners Appointments for all Board come in and give a monthly report.

TRANSPORTATION
2009 OPERATING/
CAPITAL ASSISTANCE
GRANT Eric Roberts moved for Tom Wilson to sign the 2009 Operating Assistance Grant for Public Transportation. Don VonderMeulen seconds the motion. Motion carried.
Eric Roberts amended the motion to also include the Capital Grant. Don VonderMeulen amended his second. Motion carried.
GRAVEL OUT
OF DUCK CREEK
CROSSING Don VonderMeulen reported that Jim Wendel asked about getting gravel out of Duck Creek Crossing. Tom said he and George Hartman had looked at. Wendel asked if the County would help. Tom said when there is open time available, after other Highway Projects are done. Eric Roberts asked if a Permit is needed. Don replied they said no.

REPORT Don VonderMeulen motioned that we acknowledge the Clerk’s Report (October 2008). Eric Roberts seconds. Tom Wilson, All in Favor. Motion carried.

PROFESSIONAL
SERVICES Tom Wilson motioned to sign the Professional Services Agreement with Hometown Engineering for the Andersonville Utilities Study (Andersonville Wastewater Treatment, Potable Water, and Storm Water Drainage Study. Eric Roberts seconds. Don VonderMeulen, All in Favor. Motion carried.

The Commissioners discussed the clause in the Notice to Bidders for Certified Checks and Bid Bonds. As it is stated at this time a Certified Check is required for out of state bidders. Terry Asphalt Materials had questioned this. Tom Wilson asked do we change it now or next year. Eric Roberts replied ruling needs to be changed for next year. Dennis Cooper from Asphalt Materials said Franklin County is the only County that required a Certified Check for out of state bidders. Eric Roberts moved that we change the rule next year. Tom Wilson seconds. Don VonderMeulen, All in Favor. Motion carried.
Tom Wilson made motion to take bids under advisement and award next Monday, December 2, 2008 @10:00 A.M. Eric Roberts seconds. Don VonderMeulen, All in Favor. Motion carried.
NOTE: A Bid had been received as Certified Mail at 11:49 A.M. today’s date from Raver Ready Mix Concrete after the allotted time which was 9:30 A.M. The Bid was returned unopened.
REX
PIPELINE Barry Moorman representing Rex Pipeline reported that they will be boring Little Cedar Road instead of cutting. Chester Ball is concerned with Wesley Chapel Road; the road is soggy and caved in. Chester reported its okay for now. George asked about flowable mortar. George and Chester will review.
HIGHWAY ENGINEER
WEEKLY REPORT
STONE HOUSE ROAD STABILIZATION PROJECT – George Hartman, Highway Engineer reported he had spoken to Tom Goldsmith, Low Bidder for the Stone House Road Stabilization Project and he is willing to hold the price pending approval of funding. Mr. Goldsmith did have concern with fuel prices, if they increased, he would also like a 3‐week notice before project would start. George had presented a spreadsheet and letter for the project that needs to be sent to Steve Baldwin with USDA, Natural Resources Conservation Services. Tom Wilson would like to see the signatures of the property owners giving permission for the project to proceed, before documents are signed and sent.
ENOCHSBURG ROAD COVERED BRIDGE 73 – George had presented a Letter that needs to be sent to INDOT for Construction Engineering Services with J.A Barker Engineering, Inc. for the Enochsburg Covered Bridge Project.
Eric Roberts moved to sign Letter for Bridge 73 to be sent to INDOT. Tom Wilson seconds. Don VonderMeulen, All in Favor. Motion carried.
WOLF CREEK ROAD STABLIZATION PROJECT – George reported that the Wolf Creek Road Stabilization Project is completed.
SIGN REPLACEMENT PROJECT – George reported that an INDOT Inspector had visited his office and reported he had begun inspection of the road signs that had been placed. Eric suggested that the County Highway to check and make sure all signs is still up.
RAILFENCE BRIDGE 110 & 111 – George had attended a Utility Coordinating Meeting for the Railfence Bridge 110 & 111 Bridge Project. Rush Shelby Energy is developing final plan information for relocation of their utilities to be sent to INDOT. The State has not issued a Notice to Proceed for the project to begin.
BRIDGE INSPECTION PHASE II – George had reported that District Three had completed installing advance warning signs and information signs for bridges as listed during bridge inspection.
HARRY
GRAVES Harry Graves presented a letter to the Franklin County Commissioners dated November 24, 2008 regarding Commissioners Minutes dated November 3, 2008, Certified Copy of Ordinance 1989‐2, Certified Copy of any contract or agreement with a group that call themselves Franklin County Economic Development Corporation, Certified Copy of any contract or agreement with James “Rene” Stivers. Along with a list of questions regarding Auditor. Presented a copy of page 52 of State Board of Accounts Audit and copy of Letter dated November 12, 2008 from INDOT regarding Transportation Enhancement Application for Land Acquisition for Whitewater Valley Interpretive Park.
MINUTES Tom Wilson motioned to approve the Minutes of November 17, 2008. Eric Roberts seconds. Motion carried.

SCHEDULES The 2009 Holiday Schedule, 2009 Commissioners Meeting Schedule and 2009 Payroll Schedule were presented for review.
LONGEVITY
PAYROLL Eric Roberts moved to approve the Longevity Payroll, contingent on County Council approval of Longevity clarification. Tom Wilson seconds. Don VonderMeulen, All in Favor. Motion carried.
