October 22, 2007 meeting minutes


Commissioner Mtg. 10/22/07 @ 1:00 p.m. in County Commissioners Room
Those present:

Thomas Wilson opens meeting with pledge of allegiance
I. Weekly Property Tax Report
a. Don Vonder Meulen – Becky said she would be up here if she didn’t have people in line
b. Thomas Wilson – did we want to put it on the back burner?
c. Don Vonder Meulen – rebate check?
d. Carol L. Monroe – state board of accounts doesn’t see it until at least Jan. the auditor’s around the state. Looking
at a different company to do checks, have it down to about $4,000.00.
II. Metamora Sewar
a. Ricky Venter – the Metamora regional sewer is not with Indiana’s underground yet. Voices concern with laterals,
etc. I talked to Bob last Thursday night and he said they were supposed to work on it last Friday
b. Thomas Wilson – they were working on it this morning.
III. Cummins Road
a. Joe Gillespie – Steve Romer called me and there are four or five large trees that fall within your thirty feet right of
way. They would like to take them down if the property owners are ok. Also, how strict will the county be in
regards to the four foot set back because there are a couple of places that they would need to go within two feet of
the service.

IV. Drainage matter with Fayette memorial
a. Joe Gillespie – the architect called this morning and asked if we could continue it a couple of weeks
V. 2008 Supplies/Bids
a. Eric Roberts – we don’t need any escalation clause
b. Don Vonder Meulen – would it be reasonable to bid it both ways
c. Eric Roberts –it would be reasonable
d. Thomas Wilson – the first year it saved us a lot of money
VI. Burn ban
a. Thomas Wilson – Ed Hollenbach called and wants us to lift the burn ban.
b. Gene Stewart – Don gave me some paperwork. I spoke with Dan Bruns (fire chief) and he expressed some
concerns about the language. There is some language in there that is going to be tuff to enforce. There are a lot of
people who live in the county that are going to be violating that ordinance.
c. Don Vonder Meulen – did you look at the Indiana code on open burning
d. Gene Stewart – no, but if there is an Indiana code already in place not sure why we need a county ordinance.
e. Thomas Wilson – I don’t know if I want to get into something that strong
f. Gene Stewart – read it and digest it a little bit
g. Don Vonder Meulen – talk about it next meeting.
h. Thomas Wilson – I hate to put restrictions on people that are unfair. If we don’t like the way this is written, we can
tweak it?
i. Gene Stewart – absolutely, you can cut and paste however you want it.
j. Thomas Wilson – motion to remove burn ban Wednesday, October 24 at 6:00 p.m.
VII. Fields Road
a. John Kellerman – helped Harold Fields in preparing this request. As you are aware, there is a portion of Fields’
Road that passes through and ends in a bus turn around. He is petitioning to have vacated everything south. The
only people that use this road is himself and family. Mr. Fields has two parcels of real estate. There is an
easement that runs along the north edge for bakers to use. That easement does intersect with Fields Road, so if you
grant our petition then obviously the bakers will have to access there property through other means. We feel that is
possible because there is other right of way/easement that the bakers could access there property.
b. Thomas Wilson – you keep referring to fields road and the old right of way is a twp right of way
c. John Kellerman – absolutely
d. Thomas Wilson – I know the whole story from court. We built a turnaround on Fields’ request. Don’t know that
the Bakers can use the other easement through extensive work.
e. John Kellerman – Mr. Fields is willing to take some gravel and do some work.
f. Thomas Wilson – the court determined it was a public road
g. Wilhelm – here on behalf of Bakers. This case has been in litigation since Jan 2006. The court found there was
prescriptive easement by the county. Old Fields’ Road has not been maintained by the early 1960’s. Extensive
work would have to be done (for other easement). It is in your road system and you receive funding from the state
and there is no reason to vacate it at this point. It would cost the county more money to fix up the old road and
keep it in the system. We have no idea for his motive to block the road. They use this property for camping, etc.
h. Eric Roberts – it looks like a certify mail was sent out to Humper and not been received back
i. Joe Gillespie – in my report I noticed that there was an easement to the property owner to the south
j. Harold Fields – gives history
k. Thomas Wilson – through prescriptive easement it was obtained by the county (flip tape one)
l. Don Vonder Meulen – it would be real helpful to have something for us to look at.
m. Joe Gillespie – I have viewers report
n. Eric Roberts – to fix it up would take a bridge or a culvert or two.
o. Joe Gillespie – I would suspect
p. Mr. Wilhelm – it has been through appeals and has been upheld in the in supreme court. It is a county road. He
wants to have it vacated to block access.
q. Thomas Wilson – in two weeks we will be sending you a letter. We will make a point of going out there.
VIII. Rene Stivers – Bylaws for redevelopment corp.
a. Rene Stivers – asking for a review of the bylaws.
b. Judd McMillin – we would like to have you appoint someone to participate in our meetings. We will have seven
members w/ the seventh one being one of you. Also, we would like to establish a holding corporation. I am sure
you are aware of the problems that come about when the town owns the property. The corporation would be
exclusive to holdings. The redevelopment corporation would
c. Thomas Wilson – where would the money go after the sale.
d. Rene Stivers – it would go back into the county fund. The revitalization fund.
e. Judd McMillin – through proper agreements the money is stilled controlled by the town.
f. Thomas Wilson – the county council would be in control
g. Rene Stivers – that is something that would need to be looked up. This is something Liberty is doing right now.
h. Gene Stewart – the concept is good. Somehow it is going to have to be funded; you are going to have to get some
i. Don Vonder Meulen – when you apply for a river boat grant the pretty much want the money to be used for
economic development. Having this type of entity would be very helpful
j. Thomas Wilson – how do we go about setting up this board?
k. Gene Stewart – there are guides for this. You can follow that and take the good parts of what people already have
and change to what you see fit.
l. John Estridge – they are open meetings; Lawrenceburg told Union County that they will look at land for
m. Don Vonder Meulen – do the commissioners need to direct the planning commission to look into this; where would
be a good place in Franklin County.
n. Renee Stivers – Franks is the closest to being shovel ready
o. Thomas Wilson – questions are by Batesville
p. Renee Stivers – that is wonderful access.
q. Thomas Wilson – we are looking at the entire county. We have to have some industry to get us some C.A.G.I.T.
r. Renee Stivers – I wish all of our residents would understand that.
s. Judd McMillin – review the bylaws at your lesure and if any of you have questions, please let me know.
t. Thomas Wilson – could you come up every two weeks or week and let us know what is going on?

g. Don Vonder Meulen – I think it would be good to have someone that council, commissioners have some respect
h. Carol L. Monroe – I am disagreeing with you; all of those numbers that Eric gives you he gets from me
i. Susan Jones – and she gives them to him two and three times.
j. Thomas Wilson – maybe we should sit down and have a big pow-wow and go over these numbers
k. Carol L. Monroe – yes that is what we were elected to do! (tape 2)
X. Maverick Insurance
a. Kevin Kerkler – looked at all of your loses over the past five years; reviews options. Franklin County would have
two adjusters. Franklin County would pay the first $50,000.00 of any one claim (which you only had one of in the
last five years). In all of the claims you would have in one year you would not pay more than $125,000.00. we
want to get those employees back to work. The county as a whole has to be willing to accept that $50,000.00.
b. Thomas Wilson – what happens after the cap.?
c. Kevin Kerkler – the insurance pays 100%. Instead of the employee going to any doctor they want, they will go to
the doctor we want. That way we know the doctor is working on your behalf. We also have to come up with
return to work programs. It would never be set up where the insurance company would have to pay the claims
d. Thomas Wilson – we need to take it under advisement really take a look at it.
