Tom Wilson opened the meeting with the Pledge of Allegiance.
REPORT Susan Jones, Auditor reported there is less than $100,000.00 in County General. Waiting on the Treasurer’s Office so we can do an advance or we’ll need to a temporary loan at the September 23, 2009 Council Meeting.
FOR VFW Gary Seals, Representative of the VFW came before the Commissioners requesting the $250.00 Building Permit be waived for the Construction of their new building.
Eric Roberts moved to waive the $250.00 Building Permit Fee for the VFW. Don VonderMeulen seconds the motion. Tom Wilson, All in Favor. Motion carried.
RAILFENCE ROAD BRIDGE 110 & 111 ‐ George Hartman, Highway Engineer reported that he had talked to Brandi Fishvogt of INDOT and per calculation the Federal Highway Administration and our LPA cost for completing the Construction of the Railfence Road Bridge 110 & 111 Bridge Project. Based upon current FHWA Funds in the project, $334,633.84 plus an additional amount for contingencies and change order would be needed. After talking to Jeff Logman of INDOT George added $90,366.16 for a total of $425,000.00 in FHWA Funds to be transferred to this project. George had prepared a letter to INDOT recommending the awarding the contract and transferring the additional FHWA Funds from Blue Creek Bridge 94. Eric Roberts and Don VonderMeulen signed this letter of request.
PIPE CREEK BRIDGE 48 – George had submitted the Memorandum of Agreement that had been sent to the State Historic Preservation Officer, INDOT and Franklin County Board of Commissioners for Signatures. It is still undecided if a Public Hearing is needed for the Environmental, Section 106 Review. Rebecca Pyland of INDOT will review Proofs of Publications, Plans, Design Summary and information on Right‐of‐Way with regards to the Adverse Effect on the Project. A Public Hearing if needed must be advertized with a 30‐Day Response period.
Tom Wilson made motion to sign the Memorandum of Agreement for the Pipe Creek Bridge 48 Project. Don VonderMeulen seconds the motion. Eric Roberts, All in Favor. Motion carried.
George had also presented an Invoice for $3,678.00 from Clark Dietz for Professional Engineering Services for Bridge 48. The Field Survey is 100% complete, Design 93% complete, Bridge Inspection & Report 100% complete, Environmental 82% complete, and Soils Investigation 100% complete.
BRIDGE INSPECTION PHASES I & II – George reported that Phase I is Complete for Bridge Inspection and Phase II is being started today. George presented the Final LPA Claim #11 in the amount of $570.00, with 80% Reimbursement in the amount of $456.00. George had mentioned that the Road Foreman’s needs to make sure all signs are posted (such as the load limit signs, one lane) warning signs. Eric asked if when they are doing the Bridge Inspection for Phase II, if they see a sign that is missing to inform the Highway Department so it can be replaced.
Eric Roberts moved that Tom Wilson sign LPA Claim 11 for Bridge Inspection Phase I. Don VonderMeulen seconds the motion. Tom Wilson, All in Favor. Motion carried.
JOHNSON FORK BRIDGE 100 – George reported that we should be receiving Final Documents to close out the Johnson Fork Bridge 100 Bridge Project from the Engineer. The $2,500.00 Payment had been received from the Contractor for damages.
2008 STORM DAMAGES – George had presented a Spread Sheet for the Round 1 Application for the $100,000.00 from the Lilly Foundation, 2008 Indiana Natural Disaster Fund. The Coordinating Committee, which consists of Yvonne Brandes, Ed Hollenbach, Don VonderMeulen, George Hartman, Joe Gillespie, Jr., Jeremy Weber, Joe Meier, Shelly Lunsford, Rebecca Oglesby had met and had reviewed the Projects and Application. The Funds are being sought to pay the local cost for (3) Projects, Wolf Creek Road Stabilization, Harvey Branch Road Slope Stabilization and Stone House Road Slope Stabilization. Total cost of the (3) Projects is over $200,000.00, it could be the end of the month if it’s approved.
A Level II Local Emergency was called on Sunday, September 14, 2008 at 2:00 P.M. regarding the High Winds that went though Franklin County. Franklin County had wind damage, roads closed and residents without electric. The Level II Emergency was lifted at 5:37 P.M. on Sunday, September 14, 2008.
PROPOSAL John Steel with Morning Star Record Management Company has submitted (2) Proposals for Laserfiche Record Scanning. The first is for $20,000.00 which would include (5) full licenses for various offices. The $20,000 includes Software $12,500., LSAP Support $2,500., Installation and Training $1,000.,and Hardware (Estimate Only) $4,000. There is also a Lease Option. The second is for a Standalone Document Imaging in the amount of $5,474.00, which would include (1) license for a desktop computer and scanner. The $5,474.00 includes Software $3,000., LSAP Support $600., Installation and Training $1,000., and Hardware $874. This system would have the capability of scanning records into the computer system and making it easier to find a document. This is an option that several of the offices could benefit, but it would be time consuming to get all the records scanned. The Commissioners asked if this is something that can be paid for out of Cum Cap Development Funds. Tom said yes. Eric suggested to revisit at the beginning of 2009.
INSURANCE Dan Bruns had asked that a Letter of Agent Record could be signed for the County’s Insurance Policies. Dan was an Agent for Smith’s Realty and Insurance and they were purchased by Delhi Insurance out of Cincinnati. Dan is now an Agent for Southeastern Insurance and had been the agent for the County’s Insurance Policies for a number of years.
Franklin County Insurance Policies are as follows: Commercial Property, Inland Marine, Commercial Auto, Employee Benefits, Employment Practices, Multi‐Class Liability and Workmen’s Compensation.
Tom Wilson motioned to Sign the Letter for Dan Bruns. Don VonderMeulen seconds the motion. Eric Roberts, All in Favor. Motion carried.
BANNER Eric Roberts moved to allow a Banner for Safe Passage to be hung at the Courthouse and (75) butterflies be hung in a tree on the courthouse lawn. For safety purposes coordinate with the maintenance department to hang the butterflies and banner. Tom Wilson seconds the motion. Don VonderMeulen, All in Favor. Motion carried.
CLAIMS Eric Roberts moved to approve the Utility Claims. Tom Wilson seconds the motion. Don VonderMeulen, All in Favor. Motion carried.
LAW SUITE Eric Roberts moved to authorize Eugene Stewart to work with Barnes & Thornburg due to the current litigation with Rockies Express Pipeline. Tom Wilson seconds the motion. Don VonderMeulen, All in Favor. Motion carried.
The Judges on Friday, September 12, to give until Noon Tomorrow to file a response. REX is saying Franklin County is uncooperative.
