Meeting Minutes July 27, 2009

Eric Roberts opened the meeting with the Pledge of Allegiance.

WEEKLY REPORT    Sharon Halcomb, County Assessor reported she is planning on submitting the Personal Property Values for 2009 pay 2010 to the Auditor’s Office by the end of the week.  Reported she has resubmitted the Sales Disclosures and looking to submit Real Estate Values at the end of August.

 Susan Jones, County Auditor nothing new to report, waiting for the Treasurer’s Office to process the mail so distribution of taxes collected can be done. 

 MINUTES    Tom Wilson motioned to approve the Minutes of July 13, 2009.  Eric Roberts seconds.  Motion carried.

 PAYROLL     Tom Wilson questioned E-911 Payroll, Employee has been suspended (3) days and was suspended on (July 28) and payroll has suspension on Tuesday, July 28, which started Wednesday, July 29.  Tracy Lightfield corrected payroll and stated (2) is on this payroll and the 3rd will be on the next.  Tom also questioned Tracy’s day she had reported she had work 20 hours on Wednesday, July 29th.  Tracy said she did work the 20 hrs, and then reported she had work 6 hrs the evening before, but clumped the hrs together.  She then went on to say what she had done in the 20 hrs, between dispatch, meetings and issue in dispatch.  Tom Wilson asked Kenny Rosenberger, County Council Member who was present, when you made motion to suspended the 911 Director’s Salary what did you mean.  Kenny Rosenberger, she was not to perform any Director’s Duties, she was to dispatch only until audit was completed on hours on comp-time hours she had submitted for payment.  Kenny Rosenberger stated if she did not dispatch, she was not to be paid.  Gene Stewart was asked if an E-911 Director is required.  Gene said he could not find anything that a Director is required, he had contacted other counties.  The advantage to have a director is to apply for grants.  Tom Wilson, don’t want to go against Council’s decision, if there is no money to pay director, there is no money.  Eric Roberts asked Gene about the Vacation, Sick and Personal Day hours, they are on 12 hour shifts and the Personnel Policy stated days, not hours.  Gene said he would research.  Tom Wilson said Tracy should only be paid 70 hours instead of 80, only pay for hours dispatched. 

Eric Roberts moved we approve Payroll as submitted with understanding that Tracy works in dispatch and have meeting when Don VonderMeulen gets back from vacation and address Monday.  Tom Wilson seconds.  Motion carried.

 Susan Jones, Auditor reported she would not accept payroll from E-911/Communications as submitted being signed by Tracy Lightfield, as Director per County Council Meeting on July 21, 2009 @ 8:40 P.M., as the E-911 Director’s Salary had been frozen.

Tom Wilson motioned for Eric Roberts to sign Public Transportation 2nd Quarter Reimbursement (totaling $43,890.for reimbursement).  Eric Roberts seconds.  Motion carried.    

MOBILCOMM CHECK       Tom Wilson motioned to release the check to Mobilcomm.  Eric Roberts seconds.  Motion carried.  (check was being held waiting for invoice to be corrected, which it had been).

 FIRE ALARM MEMO     It was reported that the fire alarm had went off today in the Government Center and no one left the building.  The alarm was checked and fire department was not dispatched.  There had been issues with the alarm.  It was said everyone had been in the hall getting ready to leave the building, put was said it was clear.  A Memo had been prepared and in the event there is a fire alarm, everyone is to leave the building.

                                Tom Wilson motioned to sign the Memo.  Eric Roberts seconds.  Motion carried.



An Amended Ordinance Regulating the Use of Fireworks had been presented to replace Ordinance 2007-15 adopted on August 27, 2007.  The amended Ordinance would allow Sheriff’s Department to enforce the ordinance.  There had been a paragraph added if any person or entity seeking the use special fireworks, must make a request for such usage in writing to the Board of Commissioners at least (45) days prior t such usage, need to specify the types of special fireworks to be used, the place such fireworks would be used, and the times of such usage.  This Ordinance maybe enforced by any Law Enforcement Officer within Franklin County, violations of the Ordinance shall be punishable by a fine not to exceed ($500.00).

 Tom Wilson motioned to sign Ordinance 2009-12 for Fireworks amending Ordinance 2007-15.  Ordinance to advertised.  Eric Roberts seconds.  Motion carried.


Tom Wilson motioned that Eric Roberts sign the Semi-Annual Report for the Andersonville Planning Grant.  Eric Roberts seconds.  Motion carried.


The Board of Commissioners received (2) Proposals for a Restroom Facility at the Transfer Station.  Proposal from S & S Construction – $8,628.00 and Bob Arcaro Construction – $6,965.00.  Arcaro Construction had submitted the low proposal.

 Tom Wilson motioned to accept the Proposal from Bob Arcaro Construction in the amount of $6,965.00 to construct a new restroom facility at the Transfer Station.  Eric Roberts seconds.  Motion carried.


The Board of Commissioners had received a Letter from Clark Dietz answering questions from the July 6, 2009 Commissioners Meeting.  1)  Could the cost of the sprinkler system be included in the project if the water supply is inadequate for it to operate properly?  No.  FHWA will not provide funding for a sprinkler system that will not operate properly.  2)  Will the existing 2” water line allow the sprinkler system to operate at all and how effective would it be?  No.  I spoke with Chris Evans from VFP Fire Systems, Fort Wayne, Indiana.  He said that the water pressure and flow from the 2” line will not allow the sprinkler system to operate.  Kevin Loiselle does not recommend installing a sprinkler system without having an adequate water supply.  People will have a false sense of security if they see sprinkler system installed in the bridge and it does not operate.  Kevin Loiselle of Clark Dietz recommends that the sprinkler system be eliminated from the project.  The cost to make it function properly is going to be very expensive and will delay the completion of the project further.

 Eric Roberts moved we contact Clark Dietz to Proceed with the Project without the Sprinkler System.  Tom Wilson seconds.  Motion carried.


Tom Wilson motioned to accept the Proposal from E & H Bridge & Grating, Inc. for an all steel bridge in the amount of $45,496.31 for the Vanneta Road Bridge Replacement Project.  Based on the Approval of Funds by County Council.  Eric Roberts seconds.  Motion carried.

 METAMORA MAIN STREET PROJECT              Mark Richardson of Paul H Rohe Company said he understands approval was given for funding by County Council and is asking if they can proceed with the project.  They would need to schedule, could begin August 24th or week prior.  The project could be completed in 1 ½ weeks, to have it completed before Labor Day.  Eric Roberts asked if they could start the Week of August 17th.  Also the traffic is lighter the first part of the week and the shops are closed down on Mondays.  Eric suggested starting the week of August 17th, if not wait until after Labor Day and before Canal Days.  Joe Gillespie, County Surveyor will contact Utility Locator’s and set up a site meeting.  The project will start at the Bane Property.  Main Street will need to be closed for approximately 3-days.  It was asked that the road closure be posted in the Town of Metamora before the project begins.  The County Highway Trucks will haul away materials and haul in stone.  Rohe Company will work with the County Highway Schedule.  Rohe Company will also be responsible for all signage. 

 INFIRMARY AND STRINGER FAMILY CEMETERIES      Joe Gillespie, County Surveyor and Don Dunaway, President of the Franklin County Cemetery Commission were present to discuss the property near the Conservation Club that they no longer are wanting to maintain.  They had approached the County Park and they had agreed to mow it, if it is turned over to the Park.  Don Dunaway reported there are (2) Cemeteries on the grounds in question.  There are several head stones, but there is believed to be many more unmarked graves.  Don would like for the area be noted as a cemetery.  It was asked if language be put in the amended lease that the grounds not be disturbed.  Gene will work on amending the Conservation Club and Count Park Leases.

PUBLIC COMMENT         Scott McDonough – Citizen of Franklin County.  Asked who is in charge and who is responsible for E-911.  Eric Roberts, the Commissioners and it is Don VonderMeulen’s Area of Responsibility and we will wait for Don to be here to discuss.

Tony Schwab – Economic Development Director reported the Economic Development Website is up and running and is in Phase I in implementing the website.  Phase II will be next year to enhance the website.  The County will need to make decision for what property is shovel ready for it to be listed on the website.  It was also reported that the Governor will be in Connersville on Wednesday, July 29th @ 11:30 A.M., as guest speaker for Carbon Motors.  Carbon Motors is be announcing their decision on whether or not they are going to bring Carbon Motors to Connersville.   Tony also reported it has been decided to join the Southeastern IN Regional Economic Development (Dearborn, Franklin, Ripley, Ohio & Switzerland Counties) to be able to market as a region.
