Eric Roberts opened the meeting with the Pledge of Allegiance.
MINUTES – Motion – Tom Wilson made motion to approve the Minutes of December 7, 2009, December 21, 2009 and December 28, 2009 and Executive Session Minutes of December 28, 2009. Eric Roberts seconds. Motion carried.
HEALTH INSURANCE CLAIM – Motion – Eric Robert moved we approve Claims for Health Insurance. Tom Wilson seconds. Motion carried.
SRI CERTIFICATE SALE – Joe Edward of SRI explained they had just recently conducted the Tax Sale and 28 Properties did not sell at the Tax Sale. He had presented a packet for Franklin County explaining the new laws regarding a certificate sale. The Tax Sale Laws have changed since the last Tax Sale in 2006 that was held in Franklin County. The 28 Properties that did not sell are considered Commissioners Certificates that can be sold to get the properties back on the tax rolls at a reduced rate and the property owners have 120 day redemption periods redeem the property. If someone comes in to redeem property, they would need to pay taxes in full, plus a 10% redemption fee. The Commissioners have different options in selling these certificates. Can hold a live sale, internet sale or contact the adjoining property owners if they are interested in the property and negotiate a rate. Rebecca Oglesby, Treasurer reads off IC Code and has concern if a certificate is sold at a reduced rate, it says the taxing unit get the full amount of taxes that are do, where does those funds come from. Mr. Edwards explained the unit would get the pro-rated amount and a certificate of error is done writing off the taxes. If the property is redeemed the taxes would be recharged back to the property. Becky mentioned that the Lake Shore Property Owners Association is interested in some of the lots, but would want them put into a green space. Tom Wilson said one of the Lake Shore Lots; an adjoining property owner is interested. Eric Roberts mentioned there are 2 parcels on in Batesville and the other in Brookville, that the Corporations may be interested in, can the Commissioners give to the entity. It was said this is something that can be negotiated. Mr. Edwards explained more of the process, the County would give notice of sale, and SRI would research the County’s GIS and sent out letters to adjourning land owners. The purchasers of the property would be required to do a title search and pay attorney fees and notify property owners of the certificate sale. Tom Wilson said this is something that we are interested in doing. Tom would like for Michael Wilhelm to review contract with SRI for the Certificate Sale. Mr. Edwards mentioned once a contract is signed, they could have the sale in 60 days. It was asked about SRI fees to hold the sale. If it’s an internet sale they would get 10% of the sale, if it’s a live sale 15%.
ANDERSONVILLE FLOOD DRAINAGE PROJECT COMMUNITY DEVELOPMENT BLOCK GRANT NO. CF-09-205 – A Grant Agreement was presented for the Andersonville Flood Drainage Project that had been awarded in the amount of $310,500. MOTION – Tom Wilson motioned to sign the Community Development Block Grant for Andersonville in the amount of $310,500. Eric Roberts seconds. Motion carried.
LETTER TO THE CITY OF LAWRENCEBURG FOR $500,000.00 FOR RIVERBOAT REVENUE SHARING FUNDS – Letter was presented to be sent to the City of Lawrenceburg requesting the $500,000.00 that had be appropriated in Lawrenceburg City’s 2010 Budget for Franklin County. MOTION – Tom Wilson motioned to sign the letter to the City of Lawrenceburg for the $500,000 that had been appropriated. Eric Roberts seconds. Motion carried.
AMENDMENT TO PERSONNEL POLICIES HANDBOOK – Received Copy of Amendment to Personnel Policies Handbook for Salary Administration Terms and Conditions to be in effect January 4, 2010 and thereafter from Kent Irvin of Waggoner, Irwin, Scheele & Associations that had been discussed at the last meeting with Mr. Irwin. Motion – Eric Roberts moved we adopt the amendment to Personnel Policies Handbook that these policies, terms and conditions repeal and replace past policies and are in effect January 4, 2010 and thereafter. Tom Wilson seconds. Eric Roberts, Motion carried.
2010 COVERED BRIDGE CERTIFICATION – Motion – Tom Wilson motioned to sign the Covered Bridge Certification for 2010. Eric Roberts seconds. Motion carried.
INVESTMENTS AND BANK ACCOUNTS FOR 2010 – Rebecca Oglesby, County Treasurer presented the Investments and Bank Accounts 2010 Report to the County Commissioners. Motion – Tom Wilson made motion we acknowledge receipt of the 2010 Investments and Bank Account Report for 2010. Eric Roberts seconds. Motion carried.
FRANKLIN COUNT ECONOMIC DEVELOPMENT COMMISSION 2009 YEAR END REPORT – Keith Hall, Economic Development Commission Member presented to the Commissioners a copy of the 2009 Year End Report for the Economic Development Commission.
ACCUSATION – Tom Wilson made accusation on what Don VonderMeulen had supposedly said to a Highway Employee about another employee.
PUBLIC COMMENT – John Estridge asked Eric Roberts what he was going to do about it since he is over the Highway Department. Eric Roberts, this is the first I heard of it and turned to Michael Wilhelm, Attorney. Mr. Wilhelm said he would take under advisement.
ADJOURN – Motion – Eric Roberts moved to adjourn. Tom Wilson seconds. Eric Roberts, Motion carried.
