FRANKLIN COUNTY COMMISSIONERS MEETING

MEMORANDUM & MINUTES

April 13, 2009 @ 9:00 A.M.

Eric Roberts opened the meeting with the Pledge of Allegiance.

WEEKLY REPORT   Susan Jones, Auditor reported that the office is rebalancing assessed values since the allocations for cap rates were interfaced from the Assessor’s office this past week.

 

MINUTES     Tom Wilson moved to approve the March 23, 2009 Commissioner Minutes.  Don VonderMeulen seconds the motion.  Eric Roberts, All in Favor.  Motion carried.

 CLERK/TREASURERREPORTS    Don VonderMeulen moved we acknowledge both the Clerk and Treasurer Reports for the Month of March 2009.  Tom Wilson seconds the motion.  Eric Roberts, All in Favor.  Motion carried.

 

WAIVE BUILDING PERMIT FEE FOR HOLY FAMILY CHURCH

Jeff Paul representing Oldenburg Holy Family Parish and Oldenburg Preservation Association has requested the Building Permit Fee be waived for the restoration of the Onion Dome (Ziebeltrum) Spire or Church Steeple.  Organizations have been raising funds to restore the steeple and have about half of the funds raised.  The steeple’s delivered cost estimate is $71,234.00, and the cost to prepare and install the tower is estimated to be approximately $20,000.00.

Tom Wilson motioned to waive the Permit Fee for the Oldenburg Holy Family Church.  Don VonderMeulen seconds the motion.  Eric Roberts, All in Favor.  Motion carried.

RESOLUTION 2009-12 FRANKLIN COUNTY SPECIAL OLYMPICS WEEK

Geriann Shank presented to the Commissioners a Resolution Honoring the Special Olympics Movement for the State of Indiana and Franklin County.  Special Olympics are celebrating its 40th Anniversary and will be holding the 40th Annual Special Olympics Indiana Summer Games June 5 – 7 on the campus of Indiana University in Terre Haute.  The Summer Games will include State Level competition with 2,700 athletes participating.  The Area 9 Spring Meet will happen on May 9th on the East Central High School Campus in St. Leon.  Also requested a Police Escort to St. Leon on Saturday, May 9th.  The week of May 31 – June 7 will be designated as Special Olympics Week for the State of Indiana and May 4 – 9 will be designated as Special Olympics Franklin County Week.

Eric Roberts moved we Sign Resolution 2009-12 Honoring the Special Olympics.  Tom Wilson seconds the motion.  Don VonderMeulen, All in Favor.  Motion carried.

DNR/REX HEARING     Joe Gillespie, County Surveyor reported that the DNR/REX Hearing that was to be held today has been canceled.  REX Officials went to Federal Court and received an injunction to proceed with the project and drilling under the Whitewater River.  Joe Gillespie had a copy of a fax from Pete King, Attorney for Hoosier Hills Water.

 LPA PROJECT DEVELOPMENT TRAINING  Joe Gillespie, County Surveyor reported that he is planning on attending LPA Project Development Training Session that is scheduled in May.  Don VonderMeulen stated he would also like to attend the training session for the Interpretive Park Grant through Transportation Enhancement.

 RAILFENCE ROAD BRIDGE 110 & 111           

The Commissioners had received a fax from Thomas Gentry, Project Manager for Clark Dietz for the Railfence Road Bridge 110 & 111 Bridge Project along with a Change Order.  The project is moving forward, the box beams have been set and the plan is to pour the deck in approximately 3 weeks.  Change Order No. 3 is associated with providing and maintaining three road closure assembly signs.  This item was not included as a pay item in the original contract documents.  These warning signs are mandatory to ensure the safety of the traveling public.  The change order is in the amount of $1,588.95.  Jason Bunselmeier of INDOT was forced to accept the price quoted.  These signs require a more frequent maintenance interval than others on the project.  Eric Roberts disagrees and questions the change order were they omitted from the plans.  Joe Gillespie expects the rules have changed on the signage.  Eric Roberts will call to clarify the change order and contact Tom Gentry and Jason Bunselmeier.

 COURTHOUSE RENOVATION PROJECT     The County Commissioners had received a Contract Status Inquiry from The Fidelity and Deposit Company of MD, they hold the Bond for Bruns-Gutzwiller, Inc for the Remodeling/Renovation for the Franklin County Courthouse.  They are requesting the Completion Date of the Project.  Eric Roberts stated the Contract has been completed.  The heating and air conditioning issue have been ratified.   The fire alarm is an issue with the phone system.  Releasing the bond does not affect the 1-year warranty.

 Eric Roberts moved that the Contract Bond be released and the final check to Bruns-Gutzwiller be released.  Don VonderMeulen seconds the motion.  Tom Wilson, All in Favor.  Motion carried.

VANETTA HOLLOW SLAB REPLACEMENT

Tom Wilson mentioned the Vanetta Hollow Slab and had received a quote from E & H Bridge in the amount of $48,000.00.  Joe Ballenger said he would donate his labor for the project.  Don VonderMeulen asked if they could wait until George Hartman returns to work on this.  Tom Wilson said George had been working on plans.  Eric Roberts said we are tight on Cum Bridge Funds.  Tom Wilson said he would talk to Hollie and see if funds are available. 

UTILITY CLAIMS    Don VonderMeulen motioned we approve the Utility Claims (April 13, 2009).  Tom Wilson seconds the motion.  Eric Roberts, All in Favor.  Motion carried.

The Spillman Software Payment is being paid by E-911 Funds and making a one-time payment.   Tracy Lightfield, Director E-911 had submitted a claim in the amount of $52,650.00, she is wanting to pay the invoice amount and put the balance to the principle.  Jon Hundley, Assistant E-911 reported that Tracy and Sally Henson of the Sheriff’s Department went through the Spillman Software Contract and came up with $52,650.00.  Susan Jones, Auditor reported we could only pay the $43,442.62 of claim as that is what the invoice stated,  we will need an invoice for the difference.

ETC INTERNET SERVICE    Don VonderMeulen reported we are currently paying $260.00 for 3-locations for internet service a month.  We received a proposed rate of $239.85 from ETC and the first month of service is free.  Eric Roberts reported looking to switch to ETC May 1st.  

IT MEETING        Don VonderMeulen reported an IT Meeting is set for Tuesday, April 14, 2009 @ 9:00 A.M. to discuss the new phone system, internet service and the need for IT Support.

IND FUND CYCLE 4 GRANT FUNDING    Franklin County received word that we do not quality for Grant Funding for the IND Fund Cycle 4 Program.  Don VonderMeulen will check on this at their meeting this evening.

 PUBLIC COMMENT 

STEVE COLLIER – Of Metamora is inquiring on the status on the repair of Main Street in Metamora.  Eric Roberts reported he had received a letter from Steve Collier, Pat Ramos and Joe Gillespie had put a plan together.  Joe Gillespie reported he has concerns when the street is lowered, the sidewalks will be higher and will need ramps for handicap accessibility for wheel chairs and strollers.  Eric reported the estimate for the project had come in lower than anticipated and should have local funds, but could apply for grant funding.  Eric said they are planning on attending the next Commissioners Council on Historic Metamora Meeting to discuss the project.  Joe Gillespie’s concern is not to destroy the Historic Value of the Town.  Mr. Collier said his concern is now the water is coming into the buildings, because it’s the same level with the sidewalks.

STANLEY MONROE – EMS Response Time, Stanley Monroe asked what would be the response time for an EMS run 10 minutes from town.  Jon Hundley reported an average of 7 – 10 minutes.  Stanley said it took 45 minutes last Monday morning, his wife had passed out and he had called 911.  Jon Hundley said he will check out and get back with him today.  The Brookville Unit showed up, Jim Hodapp was the driver.
