FRANKLIN COUNTY COMMISSIONERS MEETING

MEMORANDUM & MINUTES

August 24, 2009 @ 1:00 P.M.

Commissioners/Council Public Meeting Room

Eric Roberts opened the meeting with the Pledge of Allegiance.

WEEKLY REPORT– Susan Jones, Auditor reported that Settlement had been approved by the Auditor of State this past week and checks are being written today to be distributed tomorrow.  Personal Property is also balanced with the Assessor’s Office.

PUBLIC TRANSPORTATION 2010 SECTION 5311 GRANT APPLICATION- Cathy Pelsor, Director of Public Transportation presented the 2010 Section 5311 Grant Application.  It’s for Operating Expenses; there is not Capital Grant for this year.  Total Budget is for $388,020., ($232,788. Federal Funding and $155,232. State Funding).  The Funding the County provides is very important; funding is matched dollar for dollar.

Don VonderMeulen motioned to authorize Eric Roberts to sign the 2010 Grant Application.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

MINUTES-Don VonderMeulen motions to approve Minutes of August 3, 2009, with correction made.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

2010 CENSUS- Norm Crampton, Employee of the Census Bureau explained how the census worked and asked Commissioners to work with them.  They will be sending out the short form to be filled out and returned, these will be mailed out on March 15, 2010 and are due back April 1, 2010.  The Census information is needed for grants.  The businesses, schools and government use the information provided.  Mr. Crampton presented a Partnership Agreement for Franklin County to work with the Census Bureau.  Said it was very important to get the word out and have a contact person working through groups or organizations.  The Census Bureau will be sending press releases to the newspapers and radio stations.

Don VonderMeulen motions for Eric Roberts to sign the Partnership Agreement for the 2010 Census.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

EMERGENCY PERSONAL MONUMENT-  Martha Shea, Representing the Franklin County Historical Society reads in the absence of a Master Plan for the Court House lawn, the Franklin County Historical Society suggests the proposed monument be put in the Lew Wallace Park near the Government Center.  Their yearly Memorial Service could be held there as well as on the Court House lawn; both places are government property.  The Court House square should be kept for temporary displays and functions and remain a park, esthetically pleasing to the eye.

It had been mentioned that the Main Street had done a plan on the Court House Lawn and Town had adopted it.  It was then said to get interested persons together and put a comprehensive plan together. 

Phil Wietholter, Brookville Chief of Police had talked to EMS, Police and Fire Departments and they would like for the memorial to be on Main Street.  Thad Ariens had also mentioned that he had started to put together a comprehensive plan together for the Courthouse lawn.  It was recommended that a meeting be set up with organizations involved to discuss the plan and asked if a plan be adopted by September 21st.

VIETNAM VETERANS RECOGNITION WEEK PROCLAMATION-Tom Wilson reads the Vietnam Veterans Recognition Week Proclamation.  The week of September 6, 2009 be declared Vietnam Veterans Recognition Week in Franklin County.  Recognition week includes Franklin, Wayne, Fayette and Union Counties.  The Event will be held at the Whitewater Memorial State Park in Liberty on September 10, 2009.

Eric Roberts made motion to Declare Week of September 6, 2009 Vietnam Veterans Recognition Week in Franklin County and sign Proclamation.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

FOREIGN TRADE INZONE- Gary Schlueter addressed the Commissioners on his research on Foreign Trade INZone and Commissioners has a copy of emails that were addressed to them and the Franklin County Economic Development Commission.  Also included is correspondence from Tony Schwab, Director Franklin County Economic Development.  Commissioners thanked Mr. Schlueter for his research.

2008 ANNUAL REPORT FOR SECURITY CENTER- Dale Maxie, Sheriff reads the 2008 Annual report for the Franklin County Security Center.  In compliance with State Requirements, the Franklin County Security Center must submit the end of the year report to the Circuit Court Judge.

Don VonderMeulen motions to acknowledge the Receipt of the 2008 Annual Report for the Franklin County Security Center.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried. 

FRANKLIN COUNTY SECURITY CENTER 911 EMERGENCY PROTOCOL- Dale Maxie, Sheriff reads Franklin County Security Center 911 Emergency Protocol.  In an emergency situation that requires the immediate attention of both dispatchers, the following steps will be implemented to insure the safety of the Jail Staff, Inmates and the Public. 

  1. Upon receipt of the call, the dispatcher not taking the 911 call will use the Jail radio and state loudly “CODE BLUE”. 

2.  The Corporal Jail Officer, or most senior Jail Officer will proceed immediately to 911/Dispatch where they will take     over control of the board. 

3.  If the remaining Jail officers are on the Jail floor, they will immediately finish what they are doing and leave the Jail floor. 

4.  The Corporal will then:  Lock down the Jail.  Notify the front office to take calls on days or handle the calls themselves on nights.  Notify the Jail Commander of the situation. 

5.  The Corporal or Senior Officer will determine when it is safe for the lock down to cease and for the remaining Jail Officers to return to the floor. 

6.  The dispatchers on duty will advise the Jail officer running the control board when they have the situation in hand. 

Authority 24-1 & 24-6

COMPLAINTS- Dale Maxie reported that he has been contacted by Bath State Bank and have problem with bushes on the property next to them, and the railroad sign not being able to see when exiting their driveway.  Cannot see the West Bound Traffic.  Eric Roberts will work with the Property Owner.

Dale also mentioned he had noticed that there are No Speed Limit Signs posted from the State Line to Mudd Road.  Sheriff’s Department will enforce the speed limit, but signs need to be posted.  Eric will check with with the Highway Department about the signage.

LISTING OF BRIDGES FOR SCHOOL BUS SAFETY- Letters to the Directors of Transportation for Batesville Community Schools and Franklin County Community School Corporations have been prepared listing the Bridges for School Bus Safety from the Franklin County Bridge Inspection, Phase II, 2008.  Transmitted with these letters is a spreadsheet showing the load limits on Franklin County Bridges.

Eric Roberts moved we sign the Letter for Listing of Bridges for School Bus Safety for Batesville and Franklin County Community School Corporations.  Tom Wilson seconds.  Don VonderMeulen, All in Favor.  Motion carried.

REX REPAIRING OF ROADS- Eugene Stewart, County Attorney reported that he had spoken to the Decatur County Attorney and tried to make contact with Shelby County, and getting no response.  Gene made suggestion that roads that were damaged be documented by being photographed.  Gene also reported the reason REX Officials did not attend meeting, they did not have the Engineer’s Report on damaged roads, hoping to have the reported by the end of the week.  It was estimated that 60 miles of roads are affected.  There had been contact with Chris Basista and was told as soon as the report is available he will forward and then meet with Highway Officials to go over the report.  Tom Wilson would also like for George Hartman review the report.      

 PAYROLL- Don VonderMeulen motioned to approve the Payroll.  Eric Roberts seconds.  Tom Wilson, replies there were 2 days she (Tracy) went to Indianapolis as Director, Council says she was to dispatch.  Motion carried.  (Susan Jones, Auditor does not agree to pay Tracy Lightfield for days other then dispatching).

CLEVES CONNECTION- Jay Shullman of Cleves Connection made report on the new phone system and the big storm we had, how should we deal with it when the phone system is down.  The antenna got water in it, it was to be sealed, but it was standing up right.  It was said we did not have wind on that day, we had heavy rain.  Susan Jones reported that Jay had contacted Amanda in the Recorders Office several times and Amanda told him not to make the trip that day, because of roads being flooded and road being closed and by the time he had called it was late in the day, the offices were getting ready to close.  Told him to come the next morning.  He came anyway, was not able to fix the problem.  We were charged for him coming that evening and then again the next morning.  Mr. Shullman said he will need to send the antenna back to the company.  Tom Wilson said they need to call one of the Commissioners if the phone system is down.  It was asked if there was any warranty.  It was said the phone system has a 5-year warranty and radio equipment has 1-year warranty.

Asked about the RBSK Invoice.  Mr. Shullman said part of it is resolved and working on the other part.  Asked about the problem with the Caller ID.  Mr. Shullman said it was ETC’s problem and had talked to the ETC Engineers.

PUBLIC COMMENT– Scott McDonough asked about the CD’s that were blank.  The County did get copies of the CD’s of the Roads that REX had videotaped.  Scott then asked about the DNR-Brookville Project placing large rock for trout in the Whitewater River along the Town Park, if anyone had heard anything.

IT MEETING– IT Meeting has been set for Friday, August 28th @ 9:30 A.M. to discuss County Website.

METAMORA MAIN STREET PROJECT– It was reported that they had run into problems with the sewer, water and utility lines with the Main Street Project in Metamora.  Ted Cooley suggested doing a dry well to drain the water, there will be no surface inlet, no pipes in the ground.  Concrete will be poured for the drains,  need to cure for 7-days.  The east part of the project , will need to grind high spots and pave so water runs away from homes and businesses.
