FRANKLIN COUNTY COMMISSIONERS MEETING

MEMORANDUM & MINUTES

December 21, 2009 @ 9:00 A.M.

Eric Roberts opened the meeting with the Pledge of Allegiance.

LINDA VAUGHN CLERK OFFICIAL BOND-   Linda Vaughn introduced herself and said she had been appointed Clerk of the Circuit Courts, effective January 1, 2010 replacing Marlene Flaspohler who had resigned effective December 31, 2009 to take a position in the County Assessor’s Office.  Linda had presented her Officials Bond for the Commissioners to approve.

 Tom Wilson motioned to approve the Officials Bond for Linda Vaughn, Clerk.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

OFFICIAL BOND/LARRY FRANZMAN/GARY MARMOUZE/AREA PLAN- Tom Wilson motioned to approve the Officials Bond for Larry Franzman and Gary Marmouze, Building Inspectors for the Area Plan.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

WEEKLY REPORT   -Sharon Halcomb, Assessor mentioned she has a concern with deductions for nursing homes doing charitable work, and if this goes through the deduction is allowing it to be retroactive back to 2001.  She had talked to legislatures and was told to deny the appeal.  She had also talked to Nexus, they are in assessing, not tax deductions.  They had suggested we hire an attorney to handle the appeal.  Sharon is asking permission to hire an attorney; she had contacted an attorney for fees.  Don VonderMeulen asked Sharon if other Counties have this, can we drag our feet and see what happens.  Tom Wilson asked if we could pool with another county to get legal counsel.  Sharon said the fees would be paid out of the Reassessment Fund.  Tom Wilson feels its okay to proceed in getting prices for legal services.  Eric Roberts feels should go with someone who is representing other appeals.  Don VonderMeulen said the County needs representation.  Commissioners gave permission for Sharon to seek legal counsel.

Susan Jones, Auditor reported that the December Settlement had been approved by the State and Distribution of Tax Monies had been distributed to the Taxing Units on Friday, December 18th

 PHASE II SOFTWARE CERTIFICATION

Susan Jones, Auditor and Sharon Halcomb, Assessor also mentioned the Phase II Software Certification for Vendors to do on site testing to certify that the programs flow from one office to another, the offices being the Assessor, Auditor and Treasurer.  We had received several quotes from different vendor to the Software Certification and we had meet between ourselves and make recommendation to select Crowe Horwath LLP out of Indianapolis for a price of $7,250.00 for a one-time fee.  This fee includes any additional retesting that may be necessary.  The Contract must be signed by December 31, 2009 and testing is to be completed by June 2010.

Don VonderMeulen motions to sign Agreement with Crowe Horwath for the Phase II Software Certification.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.   

 MINUTES   Tom Wilson motioned to approve the Minutes of November 30, 2009.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.Motion carried.

 TREASURER’S REPORT    Tom Wilson motioned that we acknowledge the Treasurer’s Report (November 2009).  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

 BRIDGE MAX HIGH SPEED WIRELESS INTERNET–   Ryan Stout of Bridge Max reported that Franklin County did not receive the Stimulus Grant Funds for the High Speed Wireless Internet.  The first phase of the project was to start in Metamora.  Mr. Stout had reported there are other funds that maybe available for the next round of funding and can re-apply.  Don VonderMeulen asked about the Emergency Alarm System if it was included in the grant application packet.  Mr. Stout said they had a month to put the proposal together and don’t think it was, but will put an email to have it included for the next round.

2010 EMS CONTRACT     Eric Roberts moved we sign the 2010 EMS Contract.  Tom Wilson seconds.  Don VonderMeulen, All in Favor.  Motion carried.

SNOW HILL COVERED BRIDGE 102 LPA CONTRACT- Received a Copy of the INDOT – Local Public Agency Project Coordination Contract between INDOT and Franklin County for the Snow Hill Covered Bridge 102 Project.  EDS # A249-10  Des. No. 0089200.

 Don VonderMeulen motioned we sign the LPA Contract for the Snow Hill Covered Bridge 102 Rehabilitation Project.  Eric Roberts seconds.  Tom Wilson, All in Favor.  Motion carried.

BRIGE INSPECTION LPA CLAIM  VOUCHER #20    Received LPA Invoice –Voucher No. 20 for NBIS Bridge Inspections for Phase I (2006)and Phase II (2008) for Engineering Services in the amount of $1,690.00 with 80% Federal Reimbursement of $1,352.00.

 Tom Wilson motioned for Eric Roberts to sign LPA Voucher No. 20.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

LIBRARY-  Harry Graves of the St. Peter’s Area, until someone can furnish a meets and bounds of Highland Township is established, said I would like to be referred to from the St. Peter’s Area.  Harry presented a copy of a print out from the Recorder’s Office with five listings on it for the Whitewater Valley Community Library and two listings for Whitewater Valley Public Library.  None are for the establishment of any library (3) for expansion.  Stated it Not a Public Library, then mentions again the IC Code for Library Class 1.  Also presented a copy of IC 6-1.1-17-3 and reads Section 3 (a) The proper officers of political subdivision and has underlined along with different sentences underlined.  Harry also presented a copy of a Letter to the Franklin County Auditor dated December 15, 2009, waiting on a response.

 Melody Gault explained on one of the documents Harry is questioning, she at the time had x’ed out the Public and put District. Melody stated that the Library is a Class I Library and was created in 1943 and documents are being put together by the State Library, where the records are.

Harry is still questioning a bond amount.  Gene Stewart replied all IC Codes are statutory and amount of bond is discretionary.  Harry said he wants it in writing.  Eric asked Gene to give response in writing.  Don VonderMeulen doesn’t think it needs to be in writing.  Harry said, as it stands No Library District was created.

 CIC PUBLIC HEARIN   Joe Gillespie reported the CIC had re-organized to review the recommendation and corrections made by the Area Plan Commission and had met last Thursday.  A Public Notice had been put out for the County Commissioners, Board of Zoning Appeals, Area Plan Commission and CIC to attend on January 7, 2010 @ 7:00 P.M.  to accommodate the Sunshine Law.  The Area Plan Commission went through the CIC Recommendations and pointed out typo errors, blunders and differences of opinion and the Minutes and Recommendations from the Area Plan Commission will be reviewed with the Zoning Text.

METAMORA SEWER DISTRICT DELINQUENT LETTERS  Gene Stewart mentioned he is working on the Metamora Sewer District Delinquent Letters for Non Hook Ups to be sent out to property owners.  Letters to be signed by Gene Stewart, County Attorney.  It was mentioned that the Loan Payment is due the 1st Business day of 2010.

 COURTHOUSE FOUNDATION     Received information on the Courthouse Foundation from Dave Duvall of INDOT.  He had suggested an evaluation of the limestone be done on the Courthouse.

 E-911 PAYROLL TRACY LIGHTFIELD

Don VonderMeulen motioned to approve the Payroll for E 911 (Part-time Director).  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried. 

 Susan Jones, Auditor reported that if someone is left off any future payrolls or a payroll is not turned in, they will need to wait  until the next pay date to be paid.  It is not an easy task to do a payroll in between pay period and when a payroll is closed out in reporting withholdings.  This last check had shut down our system to the point no checks could be written and we were in the middle of trying to do distribution to the taxing units.

 SRI CERTIFICATE SALE     Eric Roberts asked should we contact SRI for a Certificate Sale.  It was asked that SRI come to a meeting and explain the process for a Certificate Sale.

PUBLIC COMMENT          Harry Graves still have question of recording document within 5 days.  Commissioners didn’t have authority to sign document to claim lien on his property.
