February 23, 2009 Meeting Minutes

Eric Roberts opened the meeting with the Pledge of Allegiance and opened the Drainage Board Meeting.


BRACKNEY DITCH   Joe Gillespie reported on the Brackney Ditch and last fall completed the Ditch Project up to Abbott Road.  Cash balance in the Brackney Ditch Fund is $8,124.03.  For the next phase of the project, would like to construct the main tile to the railroad track.  The distance between Abbot Road to the railroad track is 2,150 lineal feet.  Last year’s assessment was $32,500.00.  Joe is estimating the project for this year to be $31,250 and with the $8,124.03 should be able to complete the main tile and then do the arms that are needed.  The assessment was put on for (2) years, but was only put on for (1) year.  In 2007 the assessment was not put on the taxes that were put on in 2007.  In 2008 it was assessed and billed.  Joe is requesting the Drainage Board and Property Owners within the Brackney Ditch to approve the assessment of $32,500.00, would be the same as last year.  Leroy Updike asked about the single and double wall tile that was used, could the single wall tile be replaced with the double walled.   Joe reported that double walled tile was used to cross Dustin Dorrel’s property this year, a single wall was installed prior to this past year.  It would be take 40 feet of double walled tile and a road cut to replace it now, we do know where the single wall tile is placed and it could be replaced.  Eric Roberts said the funds would not be collected until later this year.  Joe Gillespie reported he would be putting the bid specifications together and may just bid out labor and use price that had been bid for 2009 tile prices that had been bid at the end of 2008.  Leroy Updike feels that the project that was done this past fall is not complete, the construction area had not been graded and has a high area over the pipe.  Joe Gillespie feels it should settle first before the contactor levels the area, but will see that it is taken care of.

Don VonderMeulen motions to extend the assessment to 2009 in the amount of $32,500.00.  Eric Roberts seconds the motion.  Motion carried.  Joe will profile the project before the crops are put in and put bid specifications together.

 GRIFFIN DITCH  Dennis Lackey asked about the Griffin Ditch, is an open ditch and to construct a surface ditch, as it was stated in the 90’s.  A Griffin Ditch Meeting had been set for March 23, 2009 @ 6:00 P.M.

 WEHR DITCH        Michael and David Kolb had reported that there are a couple of blow holes in the Wehr Ditch.  Joe Gillespie had reported that the Wehr Ditch has some money and will assess if repairs can be made with funds that are available or is an assessment will need to be made.  A Public Hearing has been set for March 9, 2009 @ 9:00 A.M.

  Eric Roberts moved to go into the Regular Commissioners Meeting.


At the last Commissioners Meeting the Commissioners motioned to amend the Handbook for E-911 Overtime.  The amendment is in Section 3.11 Overtime – Overtime for the Communications/E911 Department is defined as those hours worked for which compensation is made in excess of forty (40) hours in a (7) day work week.  Employees of Communications/E911 shall receive overtime for overtime worked, but have the option of comp time in lieu of overtime pay if requested in advance.  In lieu only if Communications/E911, Part-time Employees cannot work.

Eric Roberts moved to sign the Amendment to the E911 Overtime.  Don VonderMeulen seconds the motion.  Motion carried.

 ECONOMIC DEVELOPMENT REQUEST TO BE ON AGENDA      Judd McMillin appeared before the Commissioners to request to be put on the Agenda for March 2, 2009 to present Letter of Resignation from Rene Stivers, resigning his position as Director of Economic Development as of December 31, 2008.

 PAYROLL        Susan Jones, Auditor questioned why some of the time cards for E911 have written times on them and not time stamped as the majority of them.  Don VonderMeulen called Tracy Lightfield, E911 Director as was told the employees get on the job and get busy and forget to ring in.

 Don VonderMeulen motioned to accept the Payroll Vouchers.  Eric Roberts seconds the motion.  Motion carried.

 BILL SCHIRMERGRANT APPLICATION    Bill Schirmer, Property Owner in Southgate has been working on a Grant Application for Riverboat Revenue Sharing Funds from Lawrenceburg City that is due April 1st.  Mr. Schirmer is offering his Southgate Property along with Jeff Franks who is offering his property on Golden Road.  Together they have 79 Acres, plus options.  Mr. Schirmer will be addressing the Economic Development Commission on Wednesday, February 25th on pursuing the Grant Application. 


ENOCHSBURG COVERED BRIDGE 73 – George Hartman, Highway Engineer reported he had received a Letter from INDOT authoring construction supervision to proceed.  George had also received a copy of the Agreement for Construction Engineering Services between the Franklin County commissioners and J.A. Barker Engineering, Inc.  Des #0101357 and Project #9924010 had been assigned for the project.  George had also presented a cover letter to be sign for the Notice to Proceed.  A Pre-Construction Conference is scheduled for Thursday, Marcy 5, 2009 @ 10:00 A.M. at the INDOT Seymour District Office.  An invoice to Franklin County was sent on February 5, 2009 in the amount of $31,108.03 for the County’s Local Match for the Project.  This needs to be submitted for INDOT to notify the Contractor to Proceed with the Project. 

 RAILFENCE ROAD BRIDGE 110 & 111 – George reported Rush Shelby Energy is moving ahead with relocation of their utilities service within the project limits.  Railfence Road will be closed to through traffic this Friday, February 27th; Notice was given to Whitewater Publications and will also be given to The Herald Tribune, along with the Official Detour.

 FA-3 APPLICATIONS – George presented a list of proposed FA-3 Applications for Additional Funding and for new Federal Highway Administration funded bridges are as follows:

 1)      Bridge 48 Pipe Creek Alley Ford, a steel truss rehabilitation.  Kevin Loiselle of Clark Dietz submitted application on February 18th to INDOT for additional funding.

2)      Bridge 117 Columbus Ave Batesville, bridge replacement.  Drew Barth of Howard J Barth & Associates was submitting the application on February 19th.  George had made recommendation to add a sidewalk to this bridge.

3)      Bridge 94 Blue Creek, bridge replacement.  Drew Barth had submitted application on February 16th for additional funding.

4)      Bridge 10 Duck Creek, bridge replacement.  Brent Roberts and Tom Walker of Butler, Fairman & Seufert will be submitting application.

5)      Low Water Crossing for Yellow Bank Culvert No. BR-2702 and Bushy Road BR-2701.  Reports were submitted to INDOT and have approved classification as low water crossings.  Federal Highway Administration must approve to be eligible for bridge funds.

ECONOMIC RECOVERY PACKAGE – George reported that Joe Gillespie, County Surveyor and Office Staff have developed plan for (13) Franklin County Roads for the Economic Recovery Federal System for a total estimated project cost of $9,796.111.88.  George had given copies of the LPA Project Information to INDOT last Friday.  There is a public meeting this Friday at the Seymour District Office to discuss the Economic Recovery Funding.

STONEHOUSE ROAD STABILIZATION PROJECT – This project is being funded through the Emergency Watershed Protection Program.  Agreement No. 65-52KY-9-0021 has been forwarded for the project.  The estimated cost of work is not to exceed $100,014.45.  Work for the project must be completed by May 30, 2009.  NRCS will provide 75%, not to exceed $75,010.84.  Franklin County as project sponsor must provide 25% of the total estimate in-kind and/or cash contributions.
