March 9, 2009 Meeting Minutes

Eric Roberts opened the meeting with the Pledge of Allegiance, and entered into Drainage Board Meeting.


GRIFFIN DITCH    Joe Gillespie, County Surveyor and Member of the Drainage Board reported that Dennis Lackey had requested this Drainage Board Meeting to discuss Griffin Ditch.  There is an issue of drainage on the East Side of the Railroad tracks.  Dennis Lackey reported that surface water does not drain near the railroad tracks, asked if it needs to be tiled.  Joe Gillespie feels if you can keep water from going through the tile and let it drain as a surface drain, it will drain naturally.  Dennis Lackey says it’s too flat.  Joe mentioned he had spoken to the Kolb Brothers, they also would like for it be drained.  Joe reported the property owners themselves have taken care of the surface drainage, with all the legal drains, we only take care of a few 100 feet.  Joe said he can do a study of the area.

 Eric Roberts closed the Drainage Board Meeting and entered into the Regular Meeting.

 WEEKLY REPORT   Sharon Halcomb, County Assessor reported that we found out last week the cap allocations still need to be moved to the Auditor’s office in order for them to do tax billing.  Sharon also reported that the Personal Property Assessment Forms will all be mailed out this week.  Susan Jones, County Auditor, had nothing new to report this week.

 MINUTES   Eric Roberts moved we approve the Minutes of February 17, 2009.  Tom Wilson seconds.  Motion carried.

 UTILITY CLAIMS   Eric Roberts moved we accept the Utility Claims (March 9, 2009).  Don VonderMeulen seconds.  Tom Wilson, All in Favor.  Motion carried.

REX DRILL MUD DISPOSAL AGREEMENT W/ PRICE      The Drill Mud Disposal Agreement was presented for approval by the Board of Commissioners.  Price Gregory International Inc. is seeking permission to dispose of approximately 600,000 gallons of drilling mud at the Franklin County Transfer Station (Pit Area).  The mud will come from the Whitewater River HHD crossing associated with the Rockies Express Pipeline.  Price is also seeking temporary storage of timber mats and equipment at the same location.  Price is also agreeing to hire security for all after-hours operations associated with this agreement.  Agrees to obtain any and all necessary State or Federal permits pertaining to the disposal of said drilling mud.  It had been agreed that a disposal fee of ten cents ($0.10) per gallon of drilling mud based on a figure of 600,000 gallons.  Payment in the sum of $60,000 shall be remitted to Franklin County prior of disposal of any drilling mud.

Don VonderMeulen motions to accept the Drill Mud Disposal Agreement.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

Barry Moorman reported they will be hauling pipe on St. Mary’s, Blue Creek, Wolfe Creek Roads this week.  Also reported that there are two (2) crews patching and one (1) grading to repair roads in the Western Side of the County.  Doing Pumphouse Road today and are working on Snake, Stipps Hill Roads that are starting to break up.

Chris Basista reported they have made contact with all concerns and questions in person last week.  Asked if it would be okay to attend the April 6th Commissioners Meeting to give report, unless something comes up.

LONGEVITY AMENDMENT    The Board of Commissioners had amended the County’s Personnel Policy Book in regards to longevity pay.  It is still not correct and needs to be amended to what the Sheriff’s Policy states.  Commissioners tabled until budget hearings and discuss with County Council and get in contact with Elected Officials and Department to review.


ENOCHSBURG COVERED BRIDGE 73 – George Hartman, Highway Engineer reported that the Pre-Construction Meeting for the Enochsburg Covered Bridge 73 Rehabilitation Project was held on March 5, 2009 at the Seymour INDOT Office.  Looking to start the project in April and Construction completed in September 2009.  There are utilities that need to be relocated within the project limits.  There may be more to the roof that needs to be repaired then what was planned for in 2005.

RAILFENCE BRIDGE 110 & 111 –   George reported that Railfence Road was closed to traffic on March 4th.  George discussed the Change Orders for the project and was told by INDOT Officials are a necessary part of the project for the project to be done properly.  If not approved the Commissioners they change order will proceed without approval.  George then presented Change Order No. 5; there are no concrete encased piles only steel piles.  This change order has zero cost. 

Tom Wilson motioned to sign off on Change Order No. 5.  Don VonderMeulen seconds the motion.  Eric Roberts, All in Favor.  Motion carried.

Don VonderMeulen motioned to approve the first three Change orders to allow the project to move on.  Tom Wilson seconds the motion.  Eric Roberts votes against.  Eric feels its INDOT’s mistake, they changed the review process.  Motion carried.

STONE HOUSE ROAD SLOPE STABILIZATION PROJECT – George reported on the Pre-Construction Conference on the Emergency Watershed Protection Project USDA/NRCS Agreement No. 65-52-KY-9-0021.  An inspector from NRCS will observe construction and help the Contractor align the precast concrete block wall.  The Contractor would like to proceed with construction on March 25th, if County Council puts funds in place.  NRCS will deposit payment of their 75% share of the project cost within 8 days of the completion of the project and all cost is verified.

SIGN PROJECT – George reported he had spoken to Jason Bunselmeier of INDOT and mentioned again the importance that Franklin County complete the installation of the new traffic signs by July 2009 or risk losing the federal funding.  He again stressed the importance of properly getting documentation of new signs installation, in order for INDOT to process reimbursement.   

SNOW HILL COVERED BRIDGE 102 – George presented a Compliance Certificate that needs to be signed when the Snow Hill Covered Bridge 103 Rehabilitation Project is complete.


George Hartman had submitted his letter of Resignation that he is planning on retiring at the end of the March 2009.  George said he would stay on as a part-time basis.  Tom Wilson replied going to miss you and hope that George enjoys his retirement.  You have saved the County $100,000’s of dollars.  Don VonderMeulen asked do we need to meet with George and put a plan together.  We need to get in touch with the State on the reimbursement of his salary.  It was decided to meet at 1:00 P.M. next Monday.  Eric Roberts reported that Joe Gillespie’s Office is going to have to pick up a lot of the slack and the Road Foreman’s will need to oversee more of the projects.

ETC UPDATE       Doug Foster of ETC reported the PRI’s are in place and Jay of Cleves Connection has been testing the system.  The tentative date is set for March 20th to switch the phones from Verizon to ETC, between 4:00 – 5:00 P.M.  We will need access to all (3) buildings.  The Sheriff’s Department & E-911/Communications will not be changing at this time.  Doug then asked about the high speed internet, with our equipment installed we will be able to proceed.  Don VonderMeulen asked what speeds and service can be afforded with staying within our budget.  Eric Roberts mentioned that ETC had presented figures.  Don reported he will review.

 PAYROLL    Don VonderMeulen motioned to approve the payroll.  Tom Wilson seconds the motion.  Eric Roberts, All in Favor.  Motion carried.

PUBLIC COMMENT   Monica Yane – Has concerns on Bull Fork Road, feels the problem with the road deteriorating is coming from REX Pipeline hauling pipe; the trucks are going up on the shoulder of the road and deteriorating the road and stream bank.  Also wherever there is a culvert under the road, that area is also showing signs of deterioration.  Chris Basista, REX Representative will get with Monica Yane after the meeting and have pin point the locations on the map and get there people out there to look at.

 Harry Graves – Mentioned that he had come down Blue Creek and Highland Center Roads where it connects.  There was a truck backed into the gravel pit area, and then someone in a vest came at him waving he arms and hit his car.  Did County give REX authorization to regulate traffic control on these roads?  There are No Warning Signs.  On the County Road there was a person walking North on Highland Center Road.  Commissioners stated they would have the right to maintain traffic control per traffic control regulations.  Chris Basista spoke to Mr. Graves and said he will make investigation before he speaks to Mr. Graves and have Barry Moorman check out.  Harry Graves asked Mr. Basista if he will provide documents to where he is putting signs on the shoulder of the roads, the shoulders of the roads is not County Right-of-Way, they only have the traveled portion of the road and it’s not dedicated.  Mr. Basista replied they use the Manual for Traffic Control provided by the State of Indiana.

Bob O’Rourke – Asked if the Commission has any confirmation on the grant on the campground.  Don VonderMeulen reported a Transportation Enhancement Grant was awarded to Whitewater Canal by-Way Association.  There needs to be an Environmental Study and Appraisals that need to be done before transaction of the ground can be done, could possible e done in June 2009.

Bill Schirmer – Asked if you got too talked to Trevor Lane.  Don VonderMeulen said they talked to him in North Vernon last Thursday.  Tom Wilson, there is lots of property available along I-74 that is available for development.  Jeff Franks and Bill Schirmer are working on a proposal and they will need to work with the Economic Development Commission.  Bill mentioned there is an April 1st deadline in submitting application to the City of Lawrenceburg and they are providing the land.  We don’t want to miss the chance and need to have all (3) Commissioners approval.
