MEMORANDUM & MINUTES

November 2, 2009 @ 7:00 P.M.

Eric Roberts opened the meeting with the Pledge of Allegiance.

WEEKLY REPORT– Sharon Halcomb, Assessor reported she had submitted the Real Estate Data Assessor File to the DLGF.  Susan Jones, Auditor reported they are still working on the values, should be able to certify values next week.

2010 CENSUS- Susan Jones had given information on the 2010 Census that had been handed out at the Auditor Fall Conference last week.  Eric Roberts mentioned we need to get committees together to promote the 2010 Census and suggested each of the Commissioners ask 4/5 people each to form the committee.

MINUTES– Tom Wilson motioned to approve the Minutes (October 26, 2009).  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

CLAIMS- Tom Wilson motioned to approve the Claims (November 2, 2009).  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

HEALTH DEPARTMENT WANTING OVERTIME PAY FOR H1N1 CLINICS- Diane Turney, Nurse for the Health Department had contacted the Commissioners requesting overtime pay for hours worked over their 32.5 hours worked per week for administrating the H1N1 vaccinations.  The overtime pay would be paid through Grant Funds that had been granted to Franklin County.  The calculation for the overtime pay would be straight time for hours worked between 32.5 hours to 40 hours and time and a half hours worked over 40 hours.

Don VonderMeulen motions to approve the extra pay for the Health Department during the administration of the H1N1 vaccine.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

HARRY GRAVES- Harry Graves, Resident of Highland Township discussed the Library District and asked what are the Commissioners going to do, are you going to appeal.  Harry presented copies of documents filed in the Clerk’s Office, the Chronological Case Summary Civil Docket, Franklin County Court, Memorandum, Certificate of Service, Stipulated Facts and Letter from Indiana State Library.  Harry Graves said he is not against the Library, but against the procedure in the way it was done.  Gene Stewart said if the Commissioners which to file an appeal, you would need to do so in 30 days.  You can file for a motion to correct error or file for an appeal, don’t know if you would be successful or not, don’t know.  Tom Wilson asked what would be the appeal process.  Gene Stewart said given the amount of time that was given and the County Council did there thing and that was presented to the DLGF, b the time we would file, it would be over.  Tom thinks we should appeal.  Eric Roberts asked if this should be discussed in Executive Session.  Executive Session scheduled for November 9, 2009 & 8:30 A.M. For the Purpose of Appeal of Court Ruling Franklin County Public Library District.

BROOKVILLE FOUNDATION GRANT LEW WALLACE PARK- The Grant was approved for the Lew Wallace Park for the 2nd Phase of the Project in the amount of $7,395.00 by the Brookville Foundation.  Don VonderMeulen asked that in the plans that mulch be switched to stone, as it is costly to replace the hardwood mulch every year.  Don also discussed putting parking bumper in the parking lot and had Doug Flaspohler check for prices and it would be $30.00 a piece for the bumpers.

UNOFFICIAL DETOUR SR 121 Des#0100465- Joe Gillespie received a Letter of Understanding for the Unofficial Detour, Des #0100465 for New Structure SR 121, 4.97 miles N. of US 52 in Franklin County.  Letter stating is will be necessary to close SR 121 in order to accommodate the proposed New Structure Replacement and is expected to be closed starting November 2, 2009 for approximately 25 days .  The Unofficial Detour will use a portion of Kokomo Hill Road in Franklin County.  INDOT will set up and maintain the necessary traffic control for the Detour; the detour will not be signed as a detour.  Franklin County will be responsible for the signing any weight restrictions on the Unofficial Detour.  INDOT agrees to reimburse Franklin County for cost related to damage repair on the listed Unofficial Detour.   Tom Wilson reported the Laurel Fire and EMS are concerned about getting around, that there should be a run around built.  Eric Roberts questions the amount of notice that was given, that the road was closed before we were given official notice; it was closed 12 hours before we were notified.  Eric asked if we could contact Fayette County during the closure to help out with the runs.  Joe Gillespie reported Laurel EMS concern is transporting from Laurel to Fayette County.

Don VonderMeulen motioned to sign off on the Unofficial Detour.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

HUNTERSVILLE ROAD CULVERT- Don VonderMeulen mentioned he had spoken to Mayor Fledderman and the City of Batesville would be willing to pay for half of the inspection fee for the culvert inspection.  Need to get with George Hartman to get with someone to inspect the culvert.  It was mentioned that the Bill Olswald Property has a drainage pipe in the area of the culvert that an extra pipe lays along there.

VANATTA ROAD BRIDGE 14- The Vanatta Road Bridge Replacement Project is due to start November 3, 2009.  Vanatta Road will be closed for the construction of the bridge will be conducted by Ballenager Excavating.

E911 GRANT FOR EQUIPMENT- Tracy Lightfield had presented documents for the Federal Grant that had been awarded to upgrade the County’s PSAP to IP enabled Next Generation 911 Equipment.  Franklin County is one of the nine counties in the East Central Consortium.  Received a copy of Proposal for Emergency Services IP-enabled Network (ESInet) Procurement Assistance from Kimball Technology.  Total Fees Proposed for the Consortium for Project Management Fees is $9,425.00.  Franklin County Fixed Fee Cost (including all expenses) is $650.00, this is for (2) PSAP Positions at a cost of $325.00 each.  Tracy requested to be paid with the Utility Claims that are to be paid next week and paid out of E911 Services and Charges.

Don VonderMeulen moved we sign the Proposal for Emergency Services IP-enabled Network Procurement Assistance with Kimball Technology.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

REX- It was said Allan Fore had called Gene Stewart on Tuesday, October 27, 2009 and REX final offer is an additional $75,000.00 to already offer of $3,701.466.00, for a total of $3,776,466.00.  Gene Steward advice was to accept the offer.  Don VonderMeulen suggested we try to come up with something we all agree on and give time to discuss and come up with something we all feel good about.  Tom Wilson said we need to take the offer and run.  Gene Stewart said Mr. King was here to explain your options. 

Tom Wilson made the motion to accept REX’s Offer.

Don VonderMeulen would like to address what will happen if we accept their offer.  Would like to know what will happen with the money and would second the motion with provisions.  Eric Roberts, we represent al l citizens of Franklin County, I have enough money for my district, but do not know if there is enough for District Three.  Don VonderMeulen said there is no doubt District Three has the most damage.  Eric suggest we spend the money on the roads in question first for the next (2) years and if there is anything left then repair other roads.  Tom said the money needs to be appropriated by County Council and be appropriated by District.  After a lengthy discussion.  Eric had calculated the $3,776,466.00 by a percentage on the amount of damages that had calculated by George Hartman on Road Repair Estimates.  Eric came up with 15.8% for District One ($596,608), 25.7% for District Two ($970,432), and 58.5% for District Three ($2,208,960).          

Don VonderMeulen seconds Tom’s motion.  Eric Roberts, All in Favor.  Motion carried.

Gene Stewart recommended that Bond be kept in place until March 2010 when expires, the settlement is one thing and the bond in on contingency if something comes up.  Gene has a copy of the release from REX, but will get in touch with Allan Fore and prepare letter for the Commissioners to sign.

PAYROLL DIRECT DEPOSIT- Direct Deposit was discussed and Don VonderMeulen feels that after it would be started the employees would like it.  Eric Roberts would like to look at the results of the survey.

PAYROLL- Tom Wilson asked Tracy Lightfield if the 294.6 hours for comp-time requested was documented.  Tracy said it is documented on the time cards as is was before.  Tom Wilson would like to see the documentation.

Tom Wilson made motion to approve payroll, upon reviewing documents on the Comp-time requested for Tracy Lightfield.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

PUBLIC COMMENT- Jerry Harnishfeger, complements the Commissioners for accepting the offer from REX.

Harry Graves, asked about the Internet availability throughout Franklin County.  Tom Wilson replied there is an application for stimulus monies for the Internet throughout Franklin County.  Harry said that is more important than a book mobile.

Sara Duffy asked about the percentage, was not clear on how it was figured.  Eric gave Sara the percentages and dollar amount.
