MEMORANDUM & MINUTES

October 5, 2009 @ 7:00 P.M.

Commissioners/Council Public Meeting Room

Eric Roberts opened the meeting with the Pledge of Allegiance.

WEEKLY REPORT- Sharon Halcomb, Assessor reported that last Friday afternoon she had transferred assessed values to the Auditor’s Office.  The file was transferred as one unit, as Franklin County.  Manatron will need to transfer the one unit into the individual taxing units.  Sharon reported there are field workers out working in the County starting the reassessment, working in Brookville Township.  The Reassessment Company will be bringing in an addendum since they are starting early.  Susan Jones, Auditor has nothing new to report. 

 MINUTES– Eric Roberts mentioned the section of minutes for the microphone, where Doug is getting another price, which was for carpeting in the Prosecutor’s Office.  The September 21st Minutes started at 9:00 A.M. instead of 1:00 P.M.

Don VonderMeulen made motion to approve the Minutes of September 14th, September 21st, & September 28th.  Tom Wilson seconds the September 21st & September 28th, not the 14th (he was not here).  Eric Roberts seconds the September 14th.  Motion carried.

CLAIMS– Tom Wilson motions to approve the Claims (October 5, 2009).  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

CLERK’S REPORT- Don VonderMeulen motions to acknowledge the Clerk’s Report for the month of September, 2009.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

 AREA PLAN PROPOSAL FOR (2) USED CARS- Larry Franzman had provided a Letter and Proposal from Hirlinger Chevrolet in Harrison, Ohio.  2008 HHR Model with 39,000 miles for $11,200.00 and 2008 Impala with 55,000 Miles for $10,700.00.  Both cars come with 5 year or 100,000 mile warranty and have been fully serviced.  Requested to trade in the Dodge Intrepid, they had offered $300.00.  Also in the Letter he had looked at Acra in Shelbyville, IN and priced (2) cars at Jim True Ford, 2007 Impala $13,831.00 and 2008 Pontiac $12,997.00.

Tom Wilson made motion to purchase the (2) vehicles from Hirlinger and trade in the Intrepid.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

FRANKLIN COUNTY SURVEY REPORT- Joe Jarren, Presenting the Historical Society and Indiana Historic Landmark Association presented the Franklin County Survey Report and requested the existing survey report be updated.  The updated survey would list each historic structure in Franklin County, includes buildings, bridges, homes, etc…  This Survey is a resource to the Commissioners and Consultants when County takes on a federally funded project, there is the do process called Section 106.  Those who apply for federal funding need to go through this process.  Mr. Jarren presented a Summary of Cost for the Survey Report; the Historical Society had applied for a Federal Grant through the Historic Preservation for 70% of the Project.  The total project is over $50,000.00, would need to raise $17,600.00 as the Local Match.  The Historic Metamora has raised $1,000.00.  The Town of Brookville has raised $2,260.00, for a total of $3,260.00 so far for the local match.  Had also applied through the Brookville Foundation for $5,000.00.  They have requested a contribution from Franklin County Commissioners in the amount of $7,100.00 or $8,000.00.  Tom Wilson asked where other Counties had taken the funds they had contributed.  It was said E.D.I.T. Funds.  Eric Roberts asked if they had been in contact with other incorporated towns.  Don VonderMeulen asked if the books are sold and it was said yes.  Eric, we all see a value to the survey, but cannot commit at this time.  It was asked to check with the Economic Development Commission, if they had any funds to go toward this survey.

Don Dunaway, Member of the Franklin County Cemetery Commission and Franklin County Historian reported he gets in on the Section 106 review, had been involved with the review process of Pipe Creek Bridge 48.  The updating of the Franklin County Survey Report would be very beneficial and valuable tool down the road.  The survey would also include the cemeteries.  Also present were Gail Ginther of Historic Metamora and Susan Knight, Franklin County Citizens for Historic Preservation.

E-911 ORDINANCE- Don VonderMeulen again presented the E-911 Ordinance to form a (9) Member Advisory Board.  Dale Maxie, Sheriff was asked what he thought of the (9) Member Board, said don’t think we need a (9) Member Board maybe a (4) Member, (Sheriff, Chief of Police, EMA and EMS or Fire Chief).  Don VonderMeulen mentioned he had spoken to Nick Gulling of Hancock County and he had given presentation at AIC Conference, there Board if looking at the same Ordinance as we are looking at.  It would give all the people a voice and it would be an advisory board only.  Dale suggested to start out with (4) or (5) members.  Tom Linkel, County Council Member is not a fan of committees, if there is a problem they can go directly to the Board of Commissioners.  Don VonderMeulen reads the Ordinance.

Don VonderMeulen motions to adopt the Ordinance.  Eric Roberts, motion lapse for lack of second.  We need to talk to the Chief’s Association and see if we need this Ordinance.  Eric will take the Ordinance to the Chief’s Association Meeting for their input.

 REX-Eric Roberts reported he had spoken to Jean Liesing this afternoon, she had just spoken to Joe Sutherland of the Indiana Regulatory Commission and it is their feeling after review the Utility Agreement signed between Franklin County and REX, it holds REX responsible to fix the roads.  Had received quotes from Rohe Company and O’Mara and they are very close to George Hartman estimates.  Don VonderMeulen reported he had received a call from Chris Basista and Allen Fore and they want to know what they need to do to resolve this.  They had asked for the County to come back to them with an offer in a formal way, if we don’t resolve this we could end up in court.  Allen Fore suggest we sent send them a number.  Eric mentioned the contractor’s quotes back up George’s figure, suggest we turn the numbers over to George and have him put the numbers together.  Tom Wilson feels Gene Stewart needs to negotiate with the final number.  Tom Linkel, Council wants this to be resolved and put an end to it.

EXECUTIVE SESSION- Don VonderMeulen moved we have an Executive Session at 8:00 A.M. on Thursday, October 8, 2009 to discuss negotiations with REX, also would like for George Hartman to attend and Regular Meeting at 9:00 A.M.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.     

CULVERT REPLACEMENTIN BATESVILLE-Gene Stewart mentioned he had talked to Mayor Fledderman on the culvert in Batesville and will speak with him again.  Eric would like to cost share the project with the City of Batesville.  The culvert is not in the small culvert inventory.  It has been estimated to cost $60,000.00 for the replacement.  Tom Wilson mentioned the County may be responsible, since the County gets all the Cum Bridge Funds.

PAYROLL-Jon Hundley’s time was discussed.  Tom Wilson motioned to approve payroll, excluding (8) hours for Jon Hundley [(4) overtime and (4) regular hours] he worked in the 911 office as assistant director, they is no assistance director, this time was not authorized.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

WIRELESS MICROPHONES- Don VonderMeulen motion to transfer funds for the quote for the Wireless Microphones.  Susan Jones, Auditor asked if funds are transferred, will there be enough funds to transfer for the payment that needs to be made to Community Mental Health in the amount of $79,000.00.  Don VonderMeulen takes motion back.   We will need to review appropriations.

 PROPOSAL FOR DOCUMENT IMAGING-                John Steele had presented a Proposal Laserfiche Avante Document Imaging for the Commissioners Office.  The proposal is for the purchase of software, training and support for $4,500.00.  Training is for one day and proposal includes annual support.  The Commissioners will review financing and get back with Mr. Steele next week.
