FRANKLIN COUNTY COMMISSIONERS MEETING

MEMORANDUM & MINUTES

September 28, 2009 @ 1:00 p.m.

Commissioners/Council Public Meeting Room

 

Those Present:  County Commissioners:   Eric E Roberts    Thomas E Wilson    Donald M VonderMeulen

Eric Roberts opened the meeting with the Pledge of Allegiance.

WEEKLY REPORT              Sharon Halcomb, County Assessor reported that the Auditor’s Office will be finishing up putting Homestead Deductions on today and their office will be able to transfer assessed valued over to the  Auditor’s Office.

SPECIAL ELECTION POLLING PLACES- Marlene Flaspohler, County Clerk presented the List of Polling Places designated for the Special Election to be held on the referendum for funding for renovations and improvements to be done for the Batesville School Corporation.  Estimated cost for the proposed projects is not to exceed $28 Million Dollars.    

Tom Wilson made the motion to sign the list of Polling Places for November 3, 2009 Special Election.  Don VonderMeulen seconds the motion.  Eric Roberts, All in Favor.  Motion Carried.

 WAIVE BUILDING PERMIT FEE-Whitewater Canal Trail had requested the building permit fee of $250.00 be waived for the building of a “primitive type deck”.  Since children will be using this deck, Eric Roberts would like for Larry Franzman, Director Area Plan/Zoning Department to inspect this deck to make sure it is safe for use. 

Tom Wilson made the motion to waive the building permit fee of $250.  Don VonderMeulen seconds the motion.  Eric Roberts, All in favor.  Motion Carried. 

 QUOTES FOR CAR FOR AREA PLAN-Larry also spoke of getting quotes from area auto dealers for the purchase of 2 vehicles.  Once he obtains the quotes, he will bring them to the next Commissioners meeting for approval.

 MINUTES– Corrections to the September 8th Commissioners meeting.  County Line Road should be Glaub Road.  Also, in the first paragraph, the Red Cross meeting was held at the Laurel Fire House, not the Community Center. 

Don VonderMeulen made the motion to approve the minutes with the mentioned corrections.  Tom Wilson seconds the motion.   Eric Roberts, All in Favor.  Motion carried.

 Note from Susan Jones, Auditor on the correction of Minutes.  The Letters from John Watson, Attorney for the Town of St. Leon dated July 13, 2009 were regards to County Line Road and Laub Road, no mention was made of the road name being wrong.  The minutes of September 8, 2009 will not be changed pertaining to this section of minutes.

 E-911 ORDINANCE- Eric said since Gene Stewart has not arrived yet, he was going to wait on discussing this Ordinance.

BRIDGE INSPECTION- George Hartman asked the Commissioners to review the draft request for proposals of the inspection of 117 county bridges.  This is Phase 1 which is a routine Bridge Inspection for 2010.

Tom Wilson made the motion for Brent to submit the request to INDOT for Bridge Inspections.  Don VonderMeulen seconds the motion.  Eric Roberts, All in Favor.  Motion Carried.

REX– Eric Roberts mentioned Rex made an offer of $3,701,466. to fix all of the 20 + county roads that was damaged by Rex during the installation of the pipeline.  George Hartman (County Engineer) came up with a figure of $5,572,575.  Paul Rohe Co. came up with a figure of 1,216,900 just to fix 6 roads in need of desperate repair before the winter months.  O’Mara came up with a figure of 3.1 million just to fix approximately 8 of the 36 county roads.  Mark Richardson (Rohe) looked at 6 of the roads in desperate need of repair and does not believe the recommendations by Rex’s engineers are adequate.  Scott Davidson also looked at half of the roads and he came up with a quote of 3.1 million just for the 8-10 roads he looked at.  Eric Roberts does not believe the County will have enough money to fix all of the 55 miles of roads damaged if they accept this offer from Rex.  Tom Wilson disagrees.  Tom said the contractors are seeing big dollar signs and believes this is a good deal for the county.  Our highway department can get to work now on Wolf Creek which is in need of repair the most before the winter sets in.    Most of the county roads are all chip & seal.  There is no reason why these few affected roads should be treated any different than the rest of the roads.  They would like the Taj Mahal compared to the rest.   Don said this is not a good deal for us.  There just is not enough time to fix all the roads the way they should be.  Tom said if we have to go to Federal Court it will end up costing the County 1 million dollars and take up to 2 years.  Eric thinks that if we go to Federal Court, they can get FERC to make Rockies Express fix the roads the correct way.  Gene Stewart said Rex’s 3.7 million is a final amount.  He doesn’t think we should go to litigation.  Don thinks if we send a letter to Rex to fix the roads so they make it through the winter, then during the spring they can come and fix the roads the right way.  Gene said he is willing to draft up a letter. 

Tom made a motion just to accept Rex’s 3.7 million offer made to the county.  Eric said no and denied the motion.  It is not enough money.  Don said no and wants to send a letter to Rex.

WEB PAGE– The web page for each county office has a deadline of September 30TH to submit information for their web page.  Don thinks the department who does the best job on their web page should be rewarded with an extra Holiday.  Eric disagrees with the extra holiday but liked the idea.  Tom agreed with Eric and suggested having a party for everyone after the website is up and running and start off with a ribbon cutting ceremony.  Eric said some departments have more to offer than other departments and some have privacy and security issues which prevent them from putting information on the website.  The website is expected to go live on October 14, 2009.

QUOTE FOR EXTRA LAPEL MICROPHONES– Jim Kolb gave Don a quote of $400 per microphone for (4) microphones for a total of $1600.  No action was taken. 

 QUOTE FOR CARPETING- Received quote from John Flaspohler for new carpet in the Prosecutor and Child Support Offices in the Courthouse.  Quote for the Child Support Office for taking up old carpet, new carpet and installation is $2,406.54 and Quote for Prosecutor’s Office is $6,902.28.  Eric told Don they needed to hold off on this decision because Doug is going to get another quote.

PUBLIC COMMENT-Library Tax Rate – Roy Hall asked if the Commissioners came up with an answer to rescind Ordinance 2008-14 to be a County-Wide Library.  Cecil Bruns also questioned why the library needs 1 million dollars to operate when before it was being run on a half mill.  Roy stated that it should go back to how it was and a $75 dollar fee is not bad.  If someone can’t afford it, he will try to get it waived. 

 Tom Wilson made the motion that the 2008-14 Ordinance be rescinded.  Eric seconds the motion.  Don VonderMeulen said no and does not agree with the motions.  Eric stated the motion was carried with a vote of 2 to 1.

 ADJOURN- Tom Wilson made the motion to adjourn.  Don VonderMeulen seconds the motion.  Eric Roberts, All in Favor.  Motion Carried.
