MEMORANDUM & MINUTES

September 8, 2009 @ 7:00 P.M.

Commissioners/Council Public Meeting Room

 Eric Roberts opened the meeting with the Pledge of Allegiance.

WEEKLY REPORT- Susan Jones, Auditor there is nothing new to report.

MINUTES- Don VonderMeulen moved to approve the minutes with corrections.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.  With corrections being made, the Red Cross Shelter was set up at the Laurel Fire Department, not the Metamora Church of God, but Paster Ison did open his church. 

CLAIMS- Tom Wilson asked about the Cleves Connection Claim, the charge was for when the antenna messed up during the storm on August 4, 2009, Mr. Shullman came late afternoon and then again the next morning, charged us for (2) trips when he was told twice by the Recorder’s Office not to come because of roads being closed for flooding and the building would be closing shortly.  Shullman was checking the warrant on the antenna.

 Tom Wilson motioned to approve the claims except the claim for Cleves Connection, hold their check.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

CLERK’S REPORT- Tom Wilson motioned to accept the Clerk’s Report for the month of August 2009.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

METAMORA MAIN STREET PROJECT-Steve Collier reads a Letter of Appreciation from the residents, property owners, business owners and friends of the historic village of Metamora; express their appreciation for the Commissioners efforts in the recent South Main Street upgrade in the center of town.  The improvements not only helped with long standing safety problems associated with historic structures and winter ice to storm water drainage, but also made a significant improvement in the beauty of our business district.  We have heard from many visitors coming to town about how good the new roadway makes the town look.  Also thanked, Rohe Company, Joe Gillespie, Surveyor and the Franklin County Highway Department, and everyone else who had worked to complete the project before Labor Day Weekend.  Letter was signed by 102 people.

 BLUE CREEK BRIDGE 94- Drew Barth of Howard J Barth & Associates reported that the Blue Creek Road Bridge Replacement is due to be on the October Bid Letting and inquired on the Right-of-Way Acquisition.  Gene Stewart, County Attorney reported all property has been acquired.  The Commissioners were also told the project was not eligible for stimulus monies.

HUNTERSVILLE ROAD SMALL STRUCTURE-A Small Structure on Huntersville Road was mentioned, the structure sets inside the Batesville Corporation Limits and is not listed on the Counties Small Bridge Inventory.  It was asked whose responsibility is it.  Drew Barth said he had talked to George Hartman and had visited this site.  The City of Batesville constructed the walkway in the 1970’s.  Gene Stewart said it would probably fall under the County, but will get in touch with the City of Batesville and acquire an Interlocal Agreement and see if the City of Batesville would acquire some of the cost for replacement.  Drew Barth also recommends an inspection of the bridge be done for a load limit.

NEW TRENTON ALLEY-  Jerry Dole and his daughter attended the meeting, they live in New Trenton and had tried to get an alley fixed, they have made numerous calls to the Commissioners and Highway Offices over the last three months and no one will get back with us.  The alley has grown up in grass, wants it fixed and blacktopped.  Mr. Dole’s daughter uses the alley to get to her home, but an Aunt has blocked it off for it to go through, the alley is off of U.S. 52.  The alley has been graveled by the Highway Department for the last 2-years, but nothing’s been done yet this year.  It was suggested to gravel the alley all the way around and if it’s blocked, it’s to be unblocked.  Mr. Dole wants it blacktopped like it was supposed be done, when the rest of the alley’s were blacktopped.  Joe Gillespie reported he and Chester Ball, District One Foreman had checked out the alley and water was shedding off the road onto his daughter’s property.  Chester recommends a pipe be put in and chip sealed.  Joe feels this would not be acceptable.  Eric Roberts asked that Joe get with Chester to work something out and at this time we will keep it gravel.

STATE ROAD 121UNOFFICIAL DETOUR-The Commissioners received a Letter of Understanding, Unofficial Detour, DES #9901640 SR 121 over Whitewater Tributary .35miles North of US 52 in Franklin County from INDOT.  The Unofficial Detour will use a portion of Duck Creek Road to Little Duck Creek to Stone Church Road to Laurel Road.  The detour is in accordance with IC 8-23-21.  INDOT will set up and maintain the necessary traffic control for the Official Detour route.  The Unofficial Detour route will not be signed as a detour.  Franklin County will be responsible for signing any weight restrictions on the Unofficial Detour.  INDOT agrees to reimburse Franklin County for cost related to damage repair on the listed Unofficial Detour.  Reimbursement work must be approved by INDOT prior to the completion of any work.  All reimbursement expenses must be documented.  Once the District has agreed to the documented expenses, INDOT and Franklin Count must execute an agreement that indicates the documented expenses.  This should be done after the INDOT Official Detour is eliminated.

Don VonderMeulen motioned to accept the Unofficial Detour for State Road 121 Project.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

 ENOCHSBURGBRIDGE 73LPA CLAIM-Received Invoice from J.A. Barker Engineering, Inc. for Engineering Services for Enochsburg Covered Bridge 73 in the amount of $12,191.88 for services July 1 to July 31, 2009.  Also presented is LPA Claim Voucher #4 for 80% reimbursement of the Invoice which comes to $9,753.50.

 Tom Wilson made motion for Eric Roberts to sign LPA Claim Voucher #4.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

LYNCH FIREWORKS DATE CHANGE-Received a Copy of an Email from Dennis Lynch to Larry Franzman, Area Plan Commission informing a date change for fireworks display at 6018 Big Cedar Road South from October 17 to October 10, 2009.

Don VonderMeulen made motion to instruct Larry Franzman to notify Mr. Lynch that date change was not approved.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

 ANDERSONVILLE PUBLIC HEARING-A 2nd Public Hearing has been scheduled for September 15, 2009 @ 6:00 P.M. at the Andersonville Community Center.  Following the Public Hearing there will be an Easement Meeting for Andersonville.  A Site Visit has been scheduled for September 16, 2009 @ 10:00 A.M. at the Andersonville Storm Drainage Project.  It was reported the Grant Application is due October 2, 2009.  All Right-of-Way Agreement Forms must all be signed when application is submitted.  Joe Gillespie is working on Right-of-Way Acquisitions.

METAMORA MAIN STREET PROJECT-Joe Gillespie, County Surveyor reported his did not like how some of the project was done east of the bridge.  The sidewalk was poured and street was made even with sidewalks, this was not to be put in this way.  The other issue is the Post Office; the owner is saying her building has cracks in the mortar joints from the vibration for the equipment used to do the Main Street Project.

 Reported that Brian DeFossett is trying to tie up loose ends for the Metamora Main Street Project.  Ted Cooley to be giving the final figure for the project.

COUNTY LINE ROAD LAUB ROAD-The Commissioners were presented a Letter from John H Watson, Attorney for the Town of St. Leon to Gene Stewart, regarding County Line Road and Laub Road.  There is a gentleman on County Line Road who is a private individual who is taken the position that the road is private and may be currently blocking the road.  Don’t know if it’s being blocked on Franklin County’ side or the Town of St. Leon’s side.  In the past he had sought to vacate the road through the county, and county referred him to the Town of St. Leon to see what our position would be.  We sought not to have the road vacated, because it provides the only access to three or four farms in the immediate area.

Letter on Laub Road, this road also sets partially is Franklin County and Town of St. Leon.  The Town of St. Leon had done some ditching, because of water over the road in various places washing out the road.  It was said prior to them doing the ditching they had made contact with Franklin County, no one responded and some ditching was done in Franklin County.  Someone from Franklin County has made contact that more ditching needs to be done in the area and requested the Town of St. Leon to do it or the ditch would be closed off.

Franklin County did not vacate the road and does not currently maintain the road County Line Road.  Joe Gillespie and Chester Ball will check out both County Line Road and Laub Road.

VANATTA ROAD BRIDGE #14-Bridge Plans was prepared by E & H Bridge and Grating, Inc. were presented for approval.  George Hartman had reviewed the plans.

 Tom Wilson made motion to accept the Plans for Vanatta Road Bridge 14.  Don VonderMeulen seconds.  Eric Roberts, All in Favor. Motion carried.

RAILFENCE ROAD BRIDGE 111 CHANGE ORDER- Received Change Order #4 in the amount of $1,000.00 for the Railfence Road Bridge 111 Bridge Replacement Project from Thomas Gentry, Engineer from Clark Dietz.  The change order covers costs associated with repairing damages to bent 4 on bridge 111 due to a rain event that occurred on August 4, 2009.  This event exceeded the design capacity of this bridge and one other new bridge located upstream in Oldenburg.  Local accounts of the event report 6.5 inches of rain falling in less than a twelve hour period.  Flooding during this event undermined the foundation material beneath bent 4 exposing the piling.  Inspection by INDOT and the Design Engineer concluded there was no structural damage to the bent, but the void at both ends of the bent should be filled.  It was determined that the most economical way to replace the foundation material was to install flowable backfill beneath the undermined sections to fill the voids at each end.  A total of eight yards of flowable fill was installed at each end of the bent.   

Tom Wilson motioned to approve Change Order #4 for Railfence Bridge 111 for $1,000.00.  Don VonderMeulen seconds. Eric Roberts, All in Favor.  Motion carried.

 REX ROAD REPAIRS- Commissioners received the Engineer’s Review of Haul Roads for Franklin County from REX Officials dated August 30, 2009.  A site visit was conducted on August 7, 2009 to review the county roads as part of the construction of Spread E of the REX pipeline construction project.  Total estimate $1,845,290 minus $221,901 for material for temporary repairs, which come to a recommended reimbursement of $1,623,389.00.  A List of Roads reviewed was listed in the report along with the Engineers recommendation.

George Hartman had also reviewed the damaged roads and had put a spreadsheet together listing the roads and estimates for repairs, with recommendations.  George’s recommended estimate is $6,715,800.00

George will be meeting with REX Officials, along with Road Foreman’s to go over the estimates.  Gene Stewart recommends coming to an agreement and finding out where the differences are.

APPLICATION FOR CERTIFICATE OF APPROPRIATENESS IN METAMORA-The Commissioners received (2) Applications for Certificate of Appropriateness from the Commissioner’s Council on Historic Metamora.  The first from Roberts Austen of 19057 Clayborn Street.  Request to put roof over front porch to keep water from going into walls, will have gutters and down spouts.  A favorable recommendation was given by the Commission.  The second is from Heather Hatcharg/Fair Exchange/ Dale & Rose Marie Cowen-Hartlage located on Lot 5 Duck Creek Crossing #61.  Request to replace back porch and/or add on a storage area approximately 5’ x 8’.  A favorable recommendation was given by the Commission.

 Don VonderMeulen made motion to approve these (2) Certificate of Appropriateness.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

 E911 ORDINANCE-Don VonderMeulen had Gene Stewart prepare an Ordinance setting up a 6 Member Advisory Board for E911; it was drafted off of an Ordinance from Hancock County.  Eric Roberts would like to research further with counties that are similar in size with Franklin County.  Tom Wilson would like to discuss further.

WEBSITE PROPOSAL- The IT Committee had met and went over (3) Proposals that had been submitted for the Franklin County Website.  Interviewed two of the three that had submitted proposals, one of them had declined.  The recommendation is to go with Ignited; Rodney Grubbs said he would be giving training class to those who are interested.  He is the same person who had helped in putting the Website together for the Economic Development.  Each Office would be responsible to keep up their office web page.

Don VonderMeulen motioned to accept the Proposal from Ignited for a cost of $1,450.00 for new Website and Training and for Eric Roberts to sign the Proposal.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

 PAYROLL –Tom Wilson mentioned that there is no money in account to pay Tracy Lightfield.  In the past payrolls funds were transferred out of part-time help to the temporary dispatcher line.

Tom Wilson motioned to approve Payroll, except 911 Director.  Motion died for lack of second.

 Don VonderMeulen motioned to approve Payroll, subject with transfer being made for director’s pay and asking Dale Maxie to check hours on payroll for Jon Hundley.  Motion died for lack of second.

Eric Roberts, any hours working in dispatch and sick hours she is entitled to, the hours in question are hours for meetings.  For Jon Hundley hours need to be checked out before pay is given.

 Eric Roberts moved to approve payroll upon verification of comp-time/overtime and Tracy’s time as dispatcher hours and sick hours be paid and hours over that be treated as comp-time hours and pay be adjusted accordingly.  Don VonderMeulen seconds.  Tom Wilson, No.  Motion carried.  Tom Wilson wants to find out how comp-time hours work, don’t know if this can be done.  Note:  Susan Jones, Auditor does not agree with how Tracy Lightfield is given comp-time compensation for hours attending meetings.

PUBLIC COMMENT

Jerry Harnishfeger – All you talk about is this Ordinance getting members for commission.  If there’s a question or problem they can come to one of your meetings, you meet four times a month.  Having lived in the County and letting them do this to the Whitewater River.  Don’t give away our river.  Eric Roberts, we have not received official notice.

Scott McDonough – Just attended the Brookville Town Council Meeting and several people were there against dropping boulders in the Whitewater River.  Town Council did not grant permission to access the river though the Park.  There will be a meeting in Indianapolis on September 14th @ 6:00 P.M. with DNR, this will be discussed.  Scott suggested a Letter be written by the Board of Commissioners not supporting the group in putting the boulders in the river.  Scott will get more information and draft a letter that we oppose this project.  Eric Roberts suggest finding out more information and it may benefit Franklin County.  Tom Wilson if it’s limited on who can fish and causes problems with the canoe fest, then he is against.  Scott will get more information and asked to be put on next week’s agenda.  Plans are to place 70 – 1 Ton Boulders in the Whitewater River.  Eric Roberts asked if the Corp of Engineers were notified.  Scott said they were, but did not hear any comments.

 Gary Schlueter – Had presented the Commissioners information on Foreign Trade Zone.

 John Estridge – Asked who the representatives from REX were and who represented the County on August 7th during the site visit.  On July 29th he had taken a picture of all three Commissioners doing the site visit.  The Commissioners said none of them had been present, unless it was of the foreman or George.

Lonnie Helms – Resident of Franklin County, Member of EMS and Laurel Fire Department in regards to the Memorial Monument.  The artillery piece should not be moved, represents all arm forces.  Eric Roberts it’s not their intention to destroy, but maybe move it to another location.  There is a safety issue with the piece of equipment and is rusting away.  The Gazebo was explained and what it presents.  Don VonderMeulen, his understanding they are trying to incorporate it into their plans for the memorial the last he had heard.

 Scott McDonough – With the Budget Hearing for the Library.  When the Commissioners passed the Resolution in 2008 according to Indiana Code the Resolution was to be recorded within 10 days of signing, it was not, it was recorded within 30 days.  He had talked to Dan Jones of DLGF for the correct process.
