FRANKLIN COUNTY COMMISSIONERS MEETING

MEMORANDUM & MINUTES

January 11, 2010 @ 1:00 P.M.

Eric Roberts opened the meeting with the Pledge of Allegiance.

MINUTES – Motion – Tom Wilson motions to approve Minutes of January 4, 2010.  Eric Roberts seconds.  Motion carried.

UTILITY CLAIMS – Motion – Tom Wilson motion to approve Utility Claims (January 11, 2010).  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

CLERK’S REPORT Motion – Eric Roberts moves we acknowledge the Clerk’s Report for December 2009.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

FRANKLIN COUNTY WATER ASSOCIATION GRANT – Susan Craig, Southeastern Indiana Regional Planning Commission mentioned the Franklin County Water Association is proposing a project for Franklin County Water Association to install a new water line from Duck Creek Road off of State Road 1 to McGuire Ridge Road.  The proposed project is 5.7 miles in length and in that area are 102 residents, proposing putting in an 8-inch main.  The cost estimate for the project is 1.225 Million, but looking for less.  The Grant Funding is 1 Million Dollars and no local match is required, unless it goes over the one million.  They will be working on a Planning Engineering Report for the Grant Application that is due July 2, 2010.  Motion – Eric Roberts moved to support the Franklin County Water Association for the Grant.  Tom Wilson seconds.  Don VonderMeulen, All in Favor.  Eric Roberts, Motion carried.  Tim Rosenberger, Member of the Franklin County Water mentioned the next step will be to hold a public hearing in February.

E911/COMMUNICATIONS ADVISORY BOARD – Aaron Leffingwell, President of the E911/Communications Advisory Board thanked the Commissioners for putting the Board together for the Emergency Personnel.  Aaron mentioned the board did want to clarify that the board did not vote to fire the E911 Director.  The First Meeting for the Advisory Board was December 28, 2009, the Board was organized and there was a lot of open discussion and Barry Ritter of Wayne County E911 attended and discussed the East Central Indiana Consortium the Grant they had obtained to replace and update E911 Equipment.  A recommendation to the Commissioners and Council for a full-time coordinator in the future when all this mess is over with.  The January 4, 2010 Meeting will be bringing back a revised ordinance, an ordinance that has more details and what their job is as an advisory board.  There was discussion and recommendation to the Commissioners to advertise and accept applications for a new E-911 Director.  Looked over the job description, and recommendation was made for full time E-911/Communications Director to oversee Communications.  It was then asked about the current status of the E-911 Director, the Commissioners did not appoint a director for 2010.  Michael Wilhelm, Attorney mentioned anything to do with employment matters, be discussed during an executive session.  Dale Maxie, there is a job description for E-911 Director and feels Board should not be recommending a job description.  Motion –Don VonderMeulen motioned to advertise for E-911/Communications Director Position and ask for Advisory Board to review applications and make recommendation.  Tom Wilson would like to get County Council’s permission before we advertise.  Tom Wilson voted No, until County Council changes Salary Ordinance.  Eric Roberts seconds.  Motion carried 2 – 1.

FRANKLIN COUNTY ECONOMIC DEVELOPMENT – Frank Thompson, Franklin County Economic Development Director introduced himself and reported he is getting around talking to other Directors in the Southeastern Indiana Growth Alliance and I-74 Group.  He will be posting email addresses and phone numbers outside of the Economic Development Office.  Also he will be working with the Franklin County Tourism Group.

FEDERAL QUARTERLY REPORTS Motion – Don VonderMeulen motioned to sing the Federal Quarterly Reports for Bridges 48 (Pipe Creek), 94 (Blue Creek), and 102 (Snow Hill Covered Bridge).  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

 RAILFENCE ROAD BRIDGES 110 & 111 FINAL CONSTRUCTION REPORT – Received email from Thomas Gentry of Clark Dietz, Inc. stating INDOT has begun the Final Construction Record for Bridge 110 & 111 that had been turned in on December 22, 2009 and received from INDOT Contract Final Acceptance Check Off Sheet for Contract B-29475.  Motion – Don VonderMeulen motioned that Tom Wilson and Eric Roberts sign the Final Contract Report for Bridge 110 & 111.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

CONDOLENCES TO JOE GILLESPIE’S FAMILY – Tom Wilson gives his condolences to Joe Gillespie and his family on the loss of his father, who had passed in a tragic traffic accident.  Eric Roberts and Don VonderMeulen also expressed their condolences.

SRI COMMISSIONERS CERTIFICATE SALE – RESOLUTION 2010-01 – Michael Wilhelm, Attorney reviewed SRI Contract that had been presented at the last meeting for a Commissioners Certificate Sale of property that was unsold at the December 3, 2009 Tax Sale.  Makes recommendation that the Contract was good and put together well.  Motion – Tom Wilson motioned to adopt Resolution 2010-01 for Certificate Sale.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.  Motion – Eric Roberts moved we establish a minimum bid of $100.00 per property on all other properties except we offer the one parcel to the Town of Brookville for $112.66 and for Eric Roberts to sing Commissioners Certificate Sale Services Addendum.  Don VonderMeulen seconds.  Tom Wilson, All in Favor.  Eric Roberts, Motion carried.

NORTHERN EQUIPMENT – Terry Frost of Northern Equipment introduced himself and mentioned he had meet the Commissioners at Commissioners Conference in December and we here to present information on Highway Equipment.

HENNING DITCH PUBLIC HEARING – Dan Chaddon, Representing Joe Gillespie, Surveyor reported the purpose of the public hearing was for an assessment for Henning Ditch.  There are holes on the lower part of the drainage area that need repaired and had received an estimate from Tim Eich between $2,500 to $3,000 to do the necessary repairs.  To complete the repairs on the entire ditch of the 100 year old tile which is approximately 1,900 feet is estimated to be $21,600.  There was interest in doing the 1,900 feet of tile and was discussed between the property owners within the drainage area present.  It was suggested to schedule another public hearing and make contact with property owners that were not present.  Motion – Eric Roberts moved we schedule another Public Hearing for January 25, 2010 @ 2:30 P.M.  Tom Wilson seconds.  Don VonderMeulen, All in Favor.  Eric Roberts, Motion carried.

PAYROLL – Motion – Don VonderMeulen motioned to approve payroll.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

PUBLIC COMMENT – John Estridge asked if anything come up with what was mentioned last week.  Eric Roberts responded by saying complaint was filed and was turned over to Michael Wilhelm, Attorney. 

ADJOURN – Motion – Eric Roberts moved to adjourn.  Don VonderMeulen seconds.  Tom Wilson, All in Favor.  Eric Roberts, Motion carried.
