MEMORANDUM & MINUTES

February 1, 2010 @ 7:00 P.M.

Eric Roberts opened the meeting with the Pledge of Allegiance.

MINUTES MOTION – Don VonderMeulen motions to approve the minutes of February 25, 2010.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.  Don asked that Minutes be emailed if possible.

CLAIMS – MOTION – Tom Wilson motioned to approve the claims.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried. 

BLUE CREEK ROAD BRIDGE 94 CONSTRUCTION ENGINEERING AGREEMENT AMENDMENT – Drew Barth of Howard J Barth & Associates presented a Supplemental Appendix “D” to Contract Agreement that had been sign by Commissioners on April 10, 2006.  The supplemental is for changes that INDOT has implemented to show a fixed wage amount for each labor category.  This needs to be sent to INDOT for approval.  Tom Wilson asked what is the difference in amount from 2006.  Drew said approximately $20,000.00.  MOTION – Don VonderMeulen motioned to sign the amendment for Bridge 94.  Eric Roberts seconds.  Tom Wilson, All in Favor.  Eric Roberts, Motion carried.  Drew Barth also reported that he had received a phone call from INDOT today needing more information and this was sent to them today.  We should hear tomorrow if the project has been approved for stimulus funds.  The Project is ready to go and the Bid Letting is set for February 24, 2010.  The Project was already in the system for Federal Funding and if it is approved for stimulus funds it could possibly stay with the County for another project.

HUNTERSVILLE ROAD CULVERT – Drew Barth also reported the Inspection Report is almost complete and should have completed yet this week and be back next week with the report and will also present to the City of Batesville.

CERTIFICATION ARRA PROJECT FOR PIPE CREEK BRIDGE 48, BLUE CREEK BRIDGE 94 AND SNOW HILL COVERED BRIDGE 102 – The Board of Commissioners had received copies of Letters from INDOT from John Engleking, Real Estate Services Manager, Seymour District advising that all parcels with the limits of the above referenced project have been acquired and the Right-of-Way is clear for contract letting.  A certification letter from Joe Gillespie, Franklin County Surveyor is available upon request.  In accordance with 23 CRF 635.309, all applicable rules and regulations have been complied with in the acquisition of right of way.  Blue Creek Bridge 94 Bid Letting is scheduled for February 2010 along with Alley Ford Bridge over Pipe Creek Bridge 48.  The Snow Hill Covered Bridge Letting is set for July 2012 maybe sooner.  

ANDERSONVILLE STORM DRAINAGE PROJECT – Received phone call and email from Jodi Comer of Southeastern Indiana Regional Planning Commission informing the County that the procurement for engineering services will be necessary to meet the federal requirements under the grant regulations.  To meet the bid deadline of May 31, 2010, the final design of the plans and specifications need to proceed.  The County will need to perform the QBS process in early March to meet the grant application requirements.  The Commissioners called Jodi Comer of SIRPC with concerns with approving Ladd Engineering to proceed with the design and specifications, before the QBS process is complete.  They were told this in order for them to meet the grant application deadline and jeopardize funding.  It was recommended the County approve that Ladd Engineering proceed.  MOTION – Tom Wilson moved to sign letter to Gary Ladd of Ladd Engineering.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.  

 HVC WATER TREATMENT CONRACT – Eric Roberts reported that they had received quotes on the Water Treatment Program on the Condenser Water System at the Government Center from HVC, A Division of Aqua Science, LLC, in the amount of$2,700.00 payable $225.00 per month for (12) Months.  Also quote on the Water Treatment Program for the Hot and Chilled Water Systems for the Courthouse in the amount of $1,095.00 payable $91.25 per Month for (12) Months.  MOTION – Eric Roberts moved to accept these proposals.  Tom Wilson seconds.  Don VonderMeulen, All in Favor.  Eric Roberts, Motion carried.   

UPDATE ON LAPEL MICROPHONE QUOTE – Don VonderMeulen mentioned he had received a call from Jim Kolb following up on a quote that was given for extra lapel microphones for the 7-member boards if they would use them, they need to be heard.  Tom Wilson not willing to spend the extra money, we have the stand up microphones.  Eric Roberts agrees not to spend the extra funds, if they will not use them.

UPDATE ON CULVERT PIPE ON POCKET ROAD – Don VonderMeulen reported that he had called Mayor Rick Fledderman of the City of Batesville and mentioned that Ray Reese, District Three Foreman has the culvert pipe for Pocket Road.  George Hartman had mentioned that the City of Batesville should participate in the cost of replacing the pipe.  Mayor Fledderman has recommended installing 2-30 inch pipes instead of 1-48 inch pipe, but the water will end up on a property owner downstream and cause a problem there.  Weigel Engineering is doing the Engineer Study for the Culvert Replacement.  Don emailed the Mayor and asked if the City of Batesville would pay for the pipe, if the County would do the installation.  Eric Roberts and Tom Wilson agreed.  

UPDATE ON COURTHOUSE FOUNDATION – Don VonderMeulen reported that Michael Conley had meet with himself, Eric Roberts, Judge Cox, Doug Flaspohler and Darren Brack and inspected the Courthouse Foundation.  He will put together a report and recommend to the County what needs to be done.  A recommendation from Michael Conley that the cap stone be replaced.  If you repair it, it will still flake off; need something that is a harder stone.  They had also looked at the foundation on the old portion of the security center, the cap had been replaced and is holding up, but the brick is soft.  Something will need to be done with them.

CEMETERY COMMISSION REPORT TO INDIANA HISTORICAL BUREAU – The Commissioners received a copy of the Franklin County Cemetery Commission Report to the Indiana Historical Bureau for 2009.  MOTION- Eric Roberts motions to acknowledge the 2009 Report to the State.  Don VonderMeulen seconds.  Tom Wilson, All in Favor.  Eric Roberts, Motion carried.

 APPOINTMENT TO THE CEMETERY COMMISION – Received Letter from the Cemetery Commission informing the Commissioners that Juanita Baker can no longer serve as a member of the Cemetery Commission; her term expires later this year.  It was recommended by the Cemetery Commission that Julie Schlesselman be appointed to replace Juanita Baker.  The Commissioners asked that John Estridge get a letter from Juanita Baker resigning her position.

 DSL AT SMALL ANIMAL CONTROL SHELTER AND HIGHWAY ENGINEER OFFICE – Don VonderMeulen mentioned that the Small Animal Control Shelter and Highway Engineer Office will be connected to DSL for High Speed Internet.

PAYROLL MEETING – Don VonderMeulen asked about having a better reporting on payroll.  A Meeting has been set for Thursday, February 4 @ 9:00 A.M. with department heads.

PUBLIC COMMENT – Ken Doerflein asked about County Road R-O-W.  He drives Fairfield-Causeway Road two evenings a week, the road is dark and the lines are not visible.  Need to have lines on the road, is dangerous when it is raining and snowing.  Eric Roberts mentioned at the last meeting we had discussion to put this road for ARRA Stimulus Funding to resurface, then put lines on the road.  Mr. Doerflein also mentioned several years ago REMC had trimmed trees along the roads, when the utility poles were relocated along Duck Creek Road.  The brush is growing and is now encroaching the roadways and scratching the paint on his vehicle.  Asked if something can be done.  Mr. Doerflein also commended the County on putting reflectors on the bridge culverts.  Don VonderMeulen asked about who owns the Right-of-Way, maybe the County could trim along the road, like we do on other roads.
