FRANKLIN COUNTY COMMISSIONERS MEETING

MEMORANDUM & MINUTES

February 8, 2010 @ 1:00 P.M.

Eric Roberts opened the meeting with the Pledge of Allegiance.

MINUTES – MOTION – Don VonderMeulen motioned to approve the minutes of February 1, 2010.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

UTILITY CLAIMS – MOTION – Tom Wilson motioned to approve Utility Claims.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

PAYROLL CLAIMS Don VonderMeulen mentioned the Prosecutor and Treasurer Offices had not converted their time from days to hours.  It was said the Prosecutor’s Office will convert theirs on the next payroll and Treasurer’s Office was not at the meeting this past Thursday.  Don will mention to the Treasurer.  MOTION – Eric Roberts moved to approve Payroll as submitted.  Tom Wilson seconds.  Don VonderMeulen, All in Favor.  Eric Roberts, Motion carried.

CLERKS REPORT – MOTION – Tom Wilson motioned to acknowledge the Clerk’s Report for January 2010.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

ARRA LPA CONTRACTS FOR BLUE CREEK #94 – Eric Roberts mentioned they had received a LPA INDOT ARRA Coordinating Contract for Blue Creek Bridge #94.  The Project had been approved for the American Recovery and Reinvestment Act of 2009 Funding.  Contract had been signed for Federal Funding and now will be through stimulus funding with INDOT and Engineering Services though Howard J Barth & Associates.  With the new funding there will be no need for future local match funding, with the exception of what had already been paid for engineering services and right-of-way acquisition.  MOTION – Don VonderMeulen motioned to sign Cover Letter and Eric Roberts to sign LPA Contract (INDOT and Franklin County).  MOTION – Don VonderMeulen motioned to sign LPA Contract Agreement for Bridge 94 with Howard J Barth & Associates and Franklin County when received.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

COURTHOUSE FOUNDATION – Received Report from Michael Conly of Architura Corporation on the analysis in reviewing of the Franklin County Courthouse and Jail for historic restoration goals.  It was asked that the summary analysis be forward to Susan Craig of Southeastern Indiana to seek grant funding for restoration.

SAC MEACHAM FOUNDATION MEMORIAL GRANT APPLICATION – Don VonderMeulen mentioned that Eva Heyob, Humane Society Member had contracted him along with Sylvia Merkel with information on spay /neuter programs and improve the conditions at the shelter.  Had received a 2010 Meacham Foundation Memorial Grant Application for a $4,000.00 Grant for improvement at the animal shelter.  Plans are to construct an addition.  MOTION – Tom Wilson motioned to sign the Grant Application for a $4,000.00 Grant.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

MILEAGE RATE ECONOMIC DEVELOPMENT – Frank Thompson, Economic Development Director mentioned the federal mileage rate is 58 cents per mile and the current county’s rate is 38 cents a mile.  Tom Wilson stated that is a County Council issue; know we are lower than the state rate.   

PUBLIC HEARING HENNING DITCH – Joe Gillespie, County Surveyor mentioned at the last meeting there was discussion on the holes on the south side of the old main on the Ron Schnecker Farm.  The proposed assessment was $4,000.00 to repair these holes.  These holes are on the old main and below where the western arm splits away, the assessment would be assessed to all the property owners within the Henning Ditch.  The second assessment of $20,000.00 for reconstructing a 12 inch line on the Tim and Earl Rosenberger Farm and is the end of the main tile.  There is a water way that runs along their eastern line and the 12 inch diameter tile runs along this waterway.  There had been problems in this area and several holes had been fixed that were repaired by the Rosenberger’s that last couple of years.  Holes had come in a section of about 300 feet.  A new tile had been installed near the property line between the Rosenberger’s and Bob Martin Farm.  There is still a section of old tile that is about 1900 feet long.  The assessment would be assessed to the owners on the eastern side of the Drainage Area.  The third issue that had been discussed was finishing rebuilding the eastern arm that runs through the Bob Martin Farm to the Rosenberger Farm.  It had been previously replaced up to the woods on the north end of the Martin Farm.  The end of the drain is at a lane that runs through the Rosenberger’s and is approximately 1500 feet long and will require some clearing through the woods.  To complete this section of the arm would be an additional $15,000.00 and would be assessed to the owners on the east side of the drain.  There are also some holes on the Drake Farm east of the lane that runs south of the cemetery on an old tile that had been replaced that are needing to be fixed.  Dave Rosenberger suggested going around the woods instead of clearing.  Joe would still like to investigate this portion on the Bob Martin Property when contractor is working in the area and look into putting the assessment on next year.  Mr. Martin was not able to attend today’s meeting.  MOTION – Don VoderMeulen motioned to assess $4,000.00 for the entire ditch and $20,000.00 for those on the eastern arm and investigate the portion on the Martin Property.  Eric Roberts seconds.  Tom Wilson, All in Favor.  Eric Roberts, Motion carried. 

BUTLER, FAIRMAN & SEUFERT ARRA PROJECTS/JOB BUILT PROJECT – Brent Roberts of Butler, Fairman & Seufert was present and mentioned he had discussed with George Hartman about ARRA Projects/JOB BUILT PROJECT for Franklin County.  The resurfacing of the Fairfield Causeway Bridge #144 will not be eligible for ARRA Stimulus Funding; the bridge is too narrow to be considered for the funding.  The Fairfield Causeway Road itself was discussed for resurfacing and could possibly be eligible for funding.  There are (3) Bridges in Franklin County that would be eligible, Bridges 55, 56 and 106 for milling and resurfacing of the bridge decking.  Brent Roberts had estimated $10,000.00 for the Fairfield Causeway Road for project design and plans to be submitted to INDOT.  Brent Roberts had presented to the Commissioners (2) Agreements for Engineering Services for a specific project and one being a General Service Agreement to be on call for services, no estimate was given for the engineering fees.  Joe Gillespie mentioned that Bridge 106 was constructed several years ago and there is a right of way issue that has never been resolved, the property was condemned and funds are in an escrow account in the Clerk’s Office.  MOTION – Eric Roberts moved we take agreements under advisement and investigate.  Don VonderMeulen would like to have them put a plan together in the next (3) weeks.  Eric Roberts, now do we put a plan together if we don’t know the guidelines.  Tom Wilson seconds Eric’s motion.  Don VonderMeulen would prefer to allow Brent Roberts to move forward on Fairfield Causeway Road.  Eric Roberts, money is not in place.  Don VonderMeulen, know this.  Eric Roberts we have $600,000 in Highway EDIT, will need to check for this is for.  Motion carried 2-1.

FA3 APPLICATIONS – Brent Roberts mentioned the FA3 Projects are due on February 22nd and said he would update applications for the Yellow Bank Slab Replacement and re-submit.

HIGHWAY OVERTIME – Don VonderMeulen mentioned he would like the Resolution that was passed to amend the Handbook to reconsider how overtime is calculated if a vacation day is taken when the workers have overtime.  Would like for it to say vacation be included as time worked for computing overtime.  Eric Roberts feels if they could use this time instead of burning a vacation day if they want a day off.  MOTION – Don VonderMeulen motions starting this payroll and forward vacation time be included as time worked for computing of overtime pay for Highway only.  Tom Wilson seconds.  Eric Roberts opposed.  Motion carried. 2-1.  

PUBLIC COMMENT – John Estridge asked about the Snow Emergency Levels being on the website, when they go on and off.  It was said the definitions of the levels are on the website.  It happened over the weekend and weren’t available to be put on.

ADJOURN – MOTION – Eric Roberts motioned to adjourn.  Tom Wilson seconds.  Don VonderMeulen, All in Favor.  Motion carried.
