MEMORANDUM & MINUTES

January 25, 2010 @ 1:00 P.M.

Eric Roberts opened the meeting with the Pledge of Allegiance.

TREASURER’S REPORT – MOTION – Don VonderMeulen motions to acknowledge the Treasurer’s Report for December 2009.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

GIS/SPLIT PARCELS – Sharon Halcomb, County Assessor mentioned she had approached Joe Gillespie, County Surveyor and asked if they would be interested in adding the split parcels to the GIS System.  They currently contract it out with WTH for $500.00 a month to data entry the split parcels.  Joe said they could do it for $10.00 per hour not to exceed $300.00 per month.  This would be a cost savings, plus would keep it local.  The plans are since the office is getting caught up; Sharon mentioned that her office will be learning to enter the data to the GIS map themselves.  The services will be paid out of the Reassessment Fund, and will need to transfer funds from contractual services to a payroll account for part-time.  Eric Roberts and Tom Wilson like the idea of keeping it local, but will need to talk to Council to transfer the funds.

PUBLIC TRANSPORTATION LPA CLAIM VOUCHER 4TH QUARTER REIMBRUSEMENT – Cathy Pelsor, Director of Public Transportation presented the 4th Quarter LPA Claim Voucher for Reimbursement of State Funds of $32,230 and Federal Funds of $43,889.  Total Expenses for the Period is $121,933.  MOTION – Tom Wilson motioned for Eric Roberts to sign the 4th Quarter Report.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.  Cathy also reported that the Grant Application for Stimulus Funds for a Building had been denied, she had not been able to get an answer on why it was not funds, but figures it was the cost.  Don VonderMeulen mentioned that another round of grants funds may be available and suggest that the grant application be resubmitted.

 PAID BENEFITS – Don Smith, Sheriff Deputy was present to discuss the Salary Administration Terms and Conditions on the amount of time stated for the deputies, jailers and dispatcher on sick and personal leave; we all agree and understand the 40 hours per week for vacation.  Some of the wording needs to be changed on the second page where it states 1-day equal  8-hours for sick, personal and bereavement leave.  The sheriff deputies work 10 hour shifts, Jailer’s work 8 hour shifts and dispatchers work 12 hour shifts.  The Commissioners explained that their sick and personal will be based on 40 hour work week and receive 56-hours a year for sick and 16-hours for personal, to be consistent with other 40-hour a week personnel.  In the past the sheriff deputies received 70-hours for sick and 20 hours for personal.  The policy will be corrected on bereavement leave for deputies and dispatchers.  Don said he understands the Holiday Pay is going to be paid out quarterly and asked why.  It was said that when the holiday pay out came in last year, the days varied on some of the employees.  It was said some of the deputies had borrowed days on their holiday earlier in the year.  Don asked if the Holiday Pay could be paid out at the end of the year, instead of quarterly, some of the employees use it for their Christmas.  The Commissioners agreed to pay out the holiday pay out before Christmas without the Christmas holiday on it and employees will no longer be able to borrow their holidays.  Eric Roberts also explained to Don, when overtime rate is calculated, the longevity pay amount needs to be included in the rate. 

INDOT REPORT OF CONTRACT FINAL INSPECTION AND RECOMMENDATION ACCEPTANCE FOR RAILFENCE ROAD BRIDGE 110 & 111 – MOTION – Tom Wilson motioned to sign the Final Inspection Report.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

HEALTH BOARD APPOINTMENT – Eric Roberts reads letter from the Health Department dated January 8, 2010.  This is to notify you of the Franklin County Board of Health’s recommendation of Dr. Bradley DuBois to serve on the Health Board, with a term of January 1, 2010 through December 31, 2013.  Dr. DuBois will be filling the position on the Board that was left vacant by the resignation of Dr. Jason Brashear.  MOTION – Eric Roberts motions to appoint Dr. Bradley DuBois to the Franklin County Health Board.  Tom Wilson seconds.  Don VonderMeulen, All in Favor. Eric Roberts, Motion carried.

WORKONE LETTER TO GOVERNOR DANIELS – A Letter was received from WorkOne to be signed by the Board of Commissioners recommending and supporting the expansion of the youth program to include city and county parks, as the current economy has forced the reduction of service to constituents and would welcome the opportunity to put our young people to work in our city and towns in Southeastern Indiana.  MOTION – Don VonderMeulen motions to sign letter to Governor Daniels.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

QUOTE FOR EMERGENCY DEFIBRILLATOR FROM FOREMOST EQUIPMENT – Received quote from Foremost Equipment for a Philips FRS –Refurbished Emergency Defibrillator in the amount of $895.00, a new Zoll AED Plus for $1,245.00. and an alarmed AED Cabinets for $175.00.

Tom Wilson mentioned it could be paid out of Cum Cap Funds.  Eric Roberts in favor of buying one for each building, Courthouse and Government Center.  Discussed having training to use the defibrillator.  MOTION – Don VonderMeulen motioned to purchase (2) (Refurbished) Units and (2) Cabinets.  Eric Roberts seconds.  Tom Wilson, All in Favor.  Eric Roberts, Motion carried.

2007 HOMELAND SECURITY GRANT PROGRAM SUB-GRANT AGREEMENT EDS# C44P-0-194A FOR EMA – Ed Hollenbach, EMA Director had forward a Homeland Security Grant Program Sub-Grant Agreement EDS# C44P-0-194A for Law Enforcement Terrorism Prevention Program (CFDA 97.074) not to exceed $14,894.00.  Grant is for GIS Software and Projection Equipment for GIS and Set-up fee for WebGIS.  MOTION – Tom Wilson motioned to sign Agreement for EMA.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

RESOLUTION 2010-02 A RESOLUTION FOR THE SALE AND PURCHASE OF TAX SALE CERTIFICATE FOR PARCEL #24-10-29-179-001.000-004 IN THE TOWN OF BROOKVILLE, FRANKLIN COUNTY, INDIANA.  Michael Wilhelm, Attorney for the Board of Commissioners had presented Resolution 2010-02 and Eric Roberts reads the resolution.  The Franklin County Board of Commissioners that the Commissioners shall transfer the tax sale certificate for parcel number 24-10-29-179-001.000-004 to the Town of Brookville for the price of the delinquent taxes $112.66.  MOTION – Eric Roberts moves to pass Resolution 2010-02.  Don VonderMeulen seconds.  Tom Wilson, All in Favor.  Eric Roberts, Motion carried.

PAYROLL – MOTION – Don VonderMeulen motions to approve Payroll.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

CLOTHESLINE PROJECT – Don VonderMeulen mentioned a Clothesline Project sponsored by the Community Mental Health and had requested the use of the Courthouse Lawn on April 16th if weather permitting.  The Clothesline Project addresses issues of violence against women.  There will be a display set up with t-shirts available.  MOTION – Don VonderMeulen motions to allow the Community Mental Health the use of the Courthouse Lawn for the Clothesline Display on April 16, 2010.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

COURTHOUSE FOUNDATION – Don VonderMeulen mentioned on January 28, 2010 Michael Conley, Architect will inspect the Courthouse Foundation.  There will be no charge for the inspection.

STIMULUS FUNDS – Don VonderMeulen also mentioned that he had received e-mail from INDOT for a second round of stimulus money on Job Bill.  Don is recommending George to contact a consultant to collect information and make recommendation on projects.  Discussed the Fairfield-Causeway Road Project and Bridge #144 with Brent Roberts.  George Hartman and Joe Gillespie had worked on projects for stimulus funds, but came up against road blocks.  Joe said we have worked on manufacture projects, instead of projects we had in the process.  Right-of-Way has been an issue.  Tom Wilson is also in favor of George working with a consultant for the Fairfield-Causeway Road Project.  MOTION – Don VonderMeulen made motion for George Hartman to put a plan together for stimulus funds for Fairfield-Causeway Road and Bridge #144.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

2010 CENSUS COMPLETE COUNT COMMITTEE – Eric Roberts mentioned that there will be a 2010 Census Complete Count Committee Meeting on Thursday, January 28, 2010 @ 6:00 P.M. in the Ms Hamilton Room.  It was said for each person that is not counted, lose $4,000 for each person in figuring dollars for grant funding.  It very important to get the word out for everyone to turn in their census surveys.

HENNING DITCH PUBLIC HEARING – Joe Gillespie, County Surveyor reported the Henning Ditch is a Legal Drain with the outlet on the north side of Abbott Road on the Ron Schnecker Property.  Tim and Earl Rosenberger had contacted Joe and reported they have an arm that is failing and would like to make repairs a few feet away from the Henning Ditch.  The holes that are in the ditch has made it impossible for Ron to mow and has become a dangerous situation.  Joe has estimated the cost of repairs of 1,906 feet for the East Arm of the Henning Ditch to be $20,000.00.  To replace the remainder of the 1,900 – 2,000 feet of ditch he is estimating to cost $16,000.00, but has not done a lot of research for the – remainder.  Joe read off the proposed assessment percentages for the Henning Ditch East Arm.  Richard Jewell 0.24% – Earl Rosenberger 10.9% – Robert Martin 26.0% – Morris Drake 26% – Tim Rosenberger 0.36% – Paul Rosenberger 15.9 % – Erwin Schnecker 13.7% – County Highway 1.2%.  Joe said he had talked to Bob Martin and is in favor of doing the repairs.  Jack and Dave Rosenberger reported they have an arm that needs to be prepared and is a 12-inch tile.  Joe said he did not have it figured in, but could have it done in a week.  Adding this could take it to approximately $35,000.00. Next Henning Ditch Meeting had been set for February 8, 2010.  MOTION – Eric Roberts moved we put a $20,000.00 Assessment on the Henning Ditch East Arm on Schnecker to the Drake Farm.  Tom Wilson seconds.  Don VonderMeulen, All in Favor.  Eric Roberts, Motion carried.

MINUTES – MOTION – Tom Wilson motioned to approve Minutes (January 11, 2010) with corrections made.  Eric Roberts seconds.  Don VonderMeulen, All in Favor.  Eric Roberts, Motion carried.

PUBLIC COMMENT – Jerry Harnishfeger mentioned that there is a bill in legislation putting a ban on wood burning stoves and asked the Commissioners to support the residents of Franklin County and contact representative for this not to be passed .  Jerry also mentioned there is a lady that lives on Quarry Road in District Three that can’t go to her mail box to get her mail, because of a dog.  Jerry was told to contact Lou and Letter would be set signed by Lou and the Sheriff to the dog’s owner.  Jerry said he will get the information to the Commissioners Office.  John Estridge asked if Tracy is still 911 Director.  Don VonderMeulen mentioned, leave things as they are right now by Michael Wilhelm’s recommendation.  Tom Wilson is questioning the advertisement for Director being stated for a full-time position, feels the ad should not have stated full or part-time.  Eric Roberts we don’t have funds from County Council for full-time director, we may need to look at the hours could be 32.5 hours instead of 40 hours.  Don VonderMeulen stated the Advisory Board recommended a full-time position.  The Advisory Board meets tonight.  M P Allen asked when Pipe Creek Bridge will be fixed.  He was told it is on the February Bid Letting.  Mr. Allen then asked about the slab on Duck Creek, when is it going to be replaced.  Don VonderMeulen said plans are to include the project in the 2010 Request for Federal Funding. Brian Patterson asked who is in charge of the Advisory Board and why are they going to Council.  Don VonderMeulen replied the Advisory Board works under the Commissioners and they are going to Council for us.  Brian asked if Dale Maxie has allowed Tracy Lightfield in the Jail.  It was said no.  Roy Hall reported there is a hole in Drewersburg Road at a culvert near Roger Grubbs residence.  Eric Roberts said he will have the Highway Department check it out.  John Estridge asked about the complaint that had been filed.  Eric Roberts said it had been handled internally and can’t discuss.
