Brad Spurlock asked about the Transfer Station Longevity Pay. There wasn’t enough allowed in the budget after the longevity was figured after the budget was set for 2009.
Brad Spurlock also mentioned if there is no explanation on the Transfer of Funds request, it will not be granted.
Carroll Lanning asked about the Historical Survey through Economic Development. Joseph Jarzen of Historic Landmark explained the Survey on Historic Places and Structures in Franklin County would be documented. The first survey was published in 1976 and needs to be updated. The Survey would be used as a resource for federal projects, if federal funds are involved then a section 106 review needs to be done, this survey would help the County or Engineer for the project with the section 106 review. The Tourism Board is also supporting this project and had awarded funds of $3,000 to the match. The total federal grant for the project is $32,974.00 need $17,697.00 for the local match. The Town of Brookville, Brookville Foundation, Historic Preservation and Laurel Historic Preservation has put funds to this project.
Tom Linkel asked if the Batesville School Corporation will be reimbursing the County for the Special Election. We were told yes they would.

ECONOMIC DEVELOPMENT Keith Hall, President of the Franklin County Economic Development Commission, along with Myron Kanning, Member is requesting a change in the 2010 Salary Ordinance on the Director’s Salary from $35,000 to $45,000. Asking for a $10,000 raise for 2010, Franklin County is on the bottom on the pay scale in the State of Indiana for the Director’s Salary. Tom Linkel said he has no problem with allowing the extra. Hollie Maxie doesn’t agree, we set the budget. Kenny Rosenberger, we need to think of the other employees. Jeff Koch, this is an open position, to work within the budget that is approved, don’t want to micro manage budgets. Brad Spurlock, don’t want to set precedent. Tom Linkel asked what the average salary is for a director, it was said $65,000.00. Jason Allen, we are looking for an Economic Development Director, we may need to raise the salary. Keith Hall, in looking at the 2009 Budget did not use the $5,000.00 attorney fees, and there are other areas where funds are not used. Jason Allen, we need a qualified candidate. Jeff Koch, looking at it as a transfer within the budget. Tom Linkel asked to compromise with $40,000.00. Carroll Lanning don’t want it transferred out of insurance. Jeff Koch, this County needs Economic Development. Brad Spurlock sees both sides. Kenny Rosenberger, we need to readdress the funds taken away from the Judges, Prosecutor, Commissioner and Council raises.
Tom Linkel moves to increase the Director Salary for 2010 up to $45,000.00 and to stay within their budget and not to be transferred out of the benefit lines. Jeff Koch seconds. All in Favor (4) Jason Allen, Tom Linkel, Carroll Lanning and Jeff Koch. Opposed (3) Hollie Maxie, Kenny Rosenberger and Brad Spurlock.
CONGRESSIONAL SCHOOL FUND RESOLUTION 2009-40 Hollie Maxie reads Resolution 2009-40 Resolution Transferring the Sum of $95,120.29 from the Congressional School Fund to the State of Indiana. Resolution 2009-40 replacing Resolution 2009-37.

RESOLUTION TRANSFERRING THE SUM OF $95,120.29 FROM THE
CONGRESSIONAL SCHOOL FUND TO THE STATE OF INDIANA
NOW, THEREFORE BE IT ORDAINED BY THE COUNTY COUNCIL OF FRANKLIN COUNTY, INDIANA, THAT:
Section 1. The sum of $55,806.20 is hereby transferred from the Congressional School Principal Fund 254 and $39,314.09 from the Congressional School Interest Fund 254 pursuant to Indiana Code
20-42-2-4.5 of Franklin County, to the State of Indiana, Treasurer of State.
Section 2. This resolution shall be in full force and effective after its passage, approval and confirmation, as required by law.

RESOLUTION 2009-41 TEMPORARY LOAN TO HEALTH Hollie Maxie reads Resolution 2009-41, Resolution of Franklin County Council to Transfer Funds from 100-County General to 214 Health in the amount of $25,000.00.

RESOLUTION OF FRANKLIN COUNTY COUNCIL TO TRANSFER FUNDS FROM
100-COUNTY GENERAL TO 214-HEALTH
WHEREAS, Franklin County Health Fund is in need of money for cash flow purposes; And
WHEREAS, it is necessary to borrow money to enhance the Franklin County Health Fund; And
WHEREAS, there is sufficient money on deposit to the credit of Franklin County General Fund that can be temporarily transferred; And
WHEREAS, the money to be transferred is revenue derived from the levying and collection of property taxes or special taxes or from the operation of Franklin County, Indiana.
NOW THEREFORE, BE IT ORDAINED:
- That $25,000.00 (twenty-five thousand dollars and zero cents) be transferred from the Franklin County General Fund (100) be transferred to the Franklin County Health Fund (214).
- BE IT FURTHER RESOLVED, the period during which said funds shall be transferred shall end during the budget year of this Resolution, being the year in which the transfer shall occur.
- BE IT FURTHER RESOLVED that only revenues derived from the levying and collection of property taxes or special taxes or from the operation of Franklin County, Indiana may be included in the amount transferred.

ORDINANCE 2009-18 AMENDED 2009 SALARY ORDINANCE The Amendment to the 2009 Salary Ordinance 2009-18 is to do with the H1N1 Grant Funding and allowing the Staff to be able to pay overtime after 32.5 hours would be straight time and over 40 hours would be time and a half, for the time for the H1N1 Grant only. Also the effective date (October 31,2009) was added when E911 Director went from a full time position to a part-time position.

ORDINANCE 2009-19 ADOPTING JOB DESCRIPTIONS Hollie Maxie reads Ordinance 2009-19, Ordinance Adopting Job Description and Fair Labor Standards Act (FLSA).

ORDINANCE 2009-20 2010 SALARY ORDINANCE The 2010 Salary Ordinance was presented for review.
RESCINDING MOTION FOR COUNTY GENERAL REDUCTION AND ADDITIONAL ON SEPT 22, 2009 Carroll Lanning motioned to rescind the portion of motion on September 22, 2009 to do with the Reduction and Additional done for County General with reducing (151) Communications to (132) Jail. Jeff Koch seconds. All in Favor (7). Opposed (0). Motion carried.
LETTER FOR LIBRARY Hollie Maxie reads from Gary Rieveschl supporting the library and letter to be made a matter of the minutes.
HARRY GRAVES Harry Graves was asked to be put on the Agenda in regards to the Library, but did not attend tonight’s meeting.
SMALL ANIMAL CONTROL Brad Spurlock asked about the Small Animal Control Fees. Brad had read letter from Nina Muccillo a Franklin County Resident and mentions a Spay Neuter Ordinance for Franklin County. She had presented information on a ordinance that had been adopted in Counties in Florida. Brad said if the Ordinance is worded right it may be good for Franklin County. Hollie said she would talk to Tom Wilson, County Commissioner. Brad asked that Lou Fasbinder, SAC Officer attend the next meeting.
