FRANKLIN COUNTY COMMISSIONERS MEETING

MEMORANDUM & MINUTES

April 12, 2010 @ 1:00 P.M.

 Eric Roberts opens the meeting with the Pledge of Allegiance.

MONTHLY REPORT – Sharon Halcomb, Assessor reported they are compliant for 2009 Real Estate and Personal Property on the Assessor’s side, waiting to hear for Sales Disclosures.  The deadline for the 2010 Personal Property forms to be turned in to the Assessor’s Office is May 15th.     Susan Jones, Auditor reported that her office had received the revised Budget Order from the DLGF on April 7th due from the Court Order dissolving of the Library District on April 5, 2010.  Had been working with Manatron our Computer MVP Software Company and they had restored our tax files by backing out all the adjustments and payments that had been done, we had received the file this past Friday Evening.  We are working today on redoing all reports to do with refiguring the 2009 pay 2010 taxes and redoing the Abstract the needs to be done and reapproved by the State Auditor’s Office.  The County is still on to have a May 10th Collection Date.  Rebecca Oglesby, Treasurer reported the tax statements must be in the mail by April 23rd

MINUTES – None, due to receiving the revised budget order and getting the tax rates ready for re-advertisement and working with DLGF, State Auditor’s Office and Manatron for the 2009 pay 2010 needing to recalculated. 

UTILITY CLAIMS – MOTION – Don VonderMeulen motioned to approve the Utility Claims (April 12, 2010).  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

ANDERSONVILLE DRAINAGE PROJECT NO. CF-09-205– Susan Craig, Southeastern Indiana Regional Planning Commission presented to the Commissioners, a Contract Agreement for Services between the Franklin County Commissioners and Southeastern Indiana Regional Planning Commission for the Andersonville Drainage Project pertaining to the Community Focus Fund Grant that had been awarded in the amount of $310,500.00.  This agreement is not to exceed $24,840.00 for General Administration and $5,000.00 for Labor Standards services.  A total not to exceed cost of $29,840.00.  MOTION – Tom Wilson motions to sign the Contract Agreement for Services.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

HIGH SPEED INERNET SERVICE – Don VonderMeulen asked Susan Craig, SIRPC if there are any grants available for High Speed Internet Services for areas in Franklin County that cannot get it.  Susan Craig said she had checked and is not aware of any, but will keep on looking.

PRESERVATION OF FOUNDATIONS OF COURTHOUSE AND JAIL – Don VonderMeulen reported that a feasibility study had been done on the Courthouse and Jail Foundations.  Don asked if Susan Craig if she had received the information and had been researching for grants funds for the restoration, but had no found any.  Don reported that the Courthouse Preservation Commission will be here on Wednesday, April 14th @ 9:00 A.M. to discuss the Summary Needs Assessment for the Jail and Courthouse and invited Susan Craig to attend.

GOVERNMENT UTILITIES TECHNOLOGY (GUTS) TAX SALE SERVICE – Chad McDonald and Greg Jordon, Representing GUTS was present to explain the services they provide for Tax Sale and their Software Program.  The Treasurer provides the Delinquent Tax List and the list is downloaded into the system.  The Auditor is required to send out certificate letters to notify tax payers their property is up for tax sale.  GUTS provide these services.  They would be here the day of the Tax Sale.  A fee is charged and is attached to the parcel up for tax sale.  A Contract Agreement for Professional Services had been presented and a List of Services they provide.  Eric Roberts asked how many Counties they provide service.  Mr. Jordon replied by saying (6) Counties this year.  Rebecca Oglesby, Treasurer reported she is not satisfied with SRI’s Software and the projection screen to see a parcel; it has been a battle for her.  Also said that the Auditor’s Office deals with the tax sale company more than she does.  Becky had looked over GUTS contract.  Susan Jones, Auditor reported she is satisfied with SRI’s services and does not wish to change.  The Commissioners will take under advisement.  Susan Jones reported later in the meeting that SRI has been there when her office has a question in regards to the tax sale, certificates or redeeming property.  There response time is very quick.  Also a little leery with GUTS only having (6) Counties and SRI having (80) Counties.  In researching some counties have went to GUTS and then went back to SRI the next year.

2009 EMA PERFORMANCE GRANT (SUB-GRANT AGREEMENT) – MOTION – Eric Roberts moved we sign the 2009 Emergency Management Performance Grant for 50% of Ed Hollenbach, EMA Director’s Salary.  Tom Wilson seconds.  Don VonderMeulen, All in Favor.  Eric Roberts, Motion carried.

RECOMMENDATION FOR E911 DIRECTOR – Fred Neeley, Member of the E911/Communications Advisory Board was present on behalf of the Board to make recommendation for the E911 Director.  The Board is recommending Jay Manning of Cincinnati, Ohio.  There were 26 Applicants and went through applications and came up with 11 with knowledge of E911.  Mr. Manning was one of the 2 people who had come to the interview, the other gentlemen was from Michigan.  The others had declined because of the salary.  Mr. Manning had been in contact with several of the Board Members with questions and said he can start May 1st.  Tom Wilson mentioned that he had been contacted by several people who had applied and did not hear anything from the Advisory Board.  Fred Neeley explained that they had looked over the applications and looked at those that had E911/Communications knowledge.  Eric Roberts trust the E911/Communications Board judgment on the recommendation and is important to get this issue resolved.  Eric said the Commissioners will make the final decision on May 3rd.  It was mentioned that there are budget issues and there is new equipment coming in, that someone needs to be on board.  There is still question on the job description if the new director would be over the E911/Communications Department.  The Advisory Board had written the job description to also oversee the E911/Communications Department. 

SPECIAL OLYMPICS – Tom Coombs, Franklin County Coordinator for Special Olympics was present for donations for the Special Olympic Athletes that will be participating in the Spring Games at East Central High School on Saturday, May 8th.  Mr. Coombs explained that the number of athletes since 2009 had increased from 14 to 40 and now have 48 volunteers.  The cost per athlete to participate is $250.00 a year.  The Commissioners said to see them after the meeting that they would personally made a donation to the Special Olympics.

BLUE CREEK BRIDGE 94 BRIDGE REPLACEMENT PROJECT CONTRACT NO. SB-29636 & DES NO. 0088440 – The Notice to Proceed had been received to be signed with Howard J Barth & Associations for Professional Services for the Blue Creek Bridge 94 Bridge Replacement.  McAlister Excavating Company is the Contractor for the Construction of the Bridge for the Bid amount of $758,243.44.  This amount will be paid with 100% Federal American Recovery Reinvestment Act Funds to the Contractor.  MOTION – Don VonderMeulen motioned to Sign the Notice to Proceed Letter for Howard J Barth & Association for Engineering Services for Blue Creek Bridge 94 Bridge Replacement.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.     

INDOT MEETING – Don VonderMeulen had mentioned he had attended a meeting with the Indiana Department of Transportation (INDOT) for $3.9 Million that had been allotted for the Seymour District.  Franklin County had submitted applications for (3) Projects in 2009.  George Hartman had been asked to rank the projects.  Projects were ranked with the Slab on Duck Creek be replace with Bridge (Bridge 10) being the first.  The seconds being the (2) Slab Replacements on Yellow Bank and Bushy Roads and the third being Bridge 117 on Columbus Ave in Batesville.  Don explained that INDOT may make partial funding on projects instead of 100% funding and may allow 1 project for Franklin County this year.  The County can apply for additional funding as funding becomes available.   

LETTER OF INTENT WITH CARGILL FOR SALT – The Commissioners received a Letter of Intent form Cargill for Salt for the 2010 – 2011 Winter.  The Letter of Intent would allow Cargill to set aside 600 tons of white salt for Franklin County.  The tonnage is an estimate only and is subject to availability.  Pricing will be Cargill’s bid price offered on the Indiana State Bid Locals for Franklin County’s District, plus not more that an additional 10% over.  Eric Roberts signed Letter of Intent for County to purchase salt from Cargill.

2010 CENSUS – It was reported that 77% of Indiana Residents had mailed in their 2010 Census Forms.

911 DIRECTOR INVESTIGATION LETTER – Don VonderMeulen mentioned that Fred Neeley and Aaron Leffingwell had met with Mel Wilhelm, Prosecutor and letter had been presented saying To Whom it May Concern:  Ms. Amy Johnson, with the Indiana State Police, completed an investigation concerning the activities of Tracy Lightfield during her tenure as 911 Director.  After speaking with Ms. Johnson, this Office is not pursuing criminal charges against Ms. Lightfield.  Signed Melvin F Wilhelm, Prosecuting Attorney.  Don VonderMeulen wishes to pay and include here pay with the next pay period.

PUBLIC COMMENT – Sara Duffy requested a copy of the Amended 2009 Fireworks Ordinance, would like to know the do’s and don’ts pertaining to fireworks, there are people in the area where she lives that are shooting off fireworks.

LONGEVITY PAY – There was a request for payment of longevity payout from LeeWanda Washnock who is retiring in May 11, 2010.  Copy of letter and policy was given to Michael Wilhelm, Attorney to review.
