Eric Roberts opens the meeting with the Pledge of Allegiance.

MONTHY REPORT – Susan Jones, Auditor reported that the June Distribution (on tax money that was collected as of May 10th) has been sent to the Auditor of State’s Office for Approval.  Once we receive approval we can proceed in distributing funds to the taxing units.

MINUTES – MOTION – Eric Roberts moved we approve the Minutes of May 17, 2010.  Tom Wilson seconds.  Don VonderMeulen abstained.  Motion carried.  MOTION – Don VonderMeulen moved we approve the Minutes of May 24, 2010 Meeting.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

UTILITY CLAIMS – MOTION – Don VonderMeulen moved we approve the Utility Claims (June 14, 2010).  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

VETERANS SERVICE OFFICER MONTLY REPORT – MOTION – Eric Roberts moved we acknowledge the Veterans Service Officer Report (May 2010).  Tom Wilson seconds.  Don VonderMeulen, All in Favor.  Eric Roberts, Motion carried.

BATH TOWNSHIP DRAINAGE ISSUE – Joe Gillespie, County Surveyor mentioned that last week Dale Harvey had asked him to come and talk to himself, Darryl and Don Harvey with regards to the ponding of water that lies on the North Side of Bath Road.  Joe said he had researched when this was taken out of the Dare Ditch, could not find anything, except in Merle Updikes records, County Surveyor at the time a letter dated March 2, 1954 to the County Commissioners.  Joe reads the letter,   We the undersigned landowners of land affected by a ditch known as “The Dare Ditch” in Bath Township, realizing that said Ditch must have money for reasonable minor repairs, that this means of giving our consent to the Surveyor of Franklin County to make an assessment prorated as was the original assessment, but only; on that part of Ditch lying South of Bath County Road, running East and West, or in other words omitting assessments on land located in Sections 20 and 21, Township 10, Range 1.  Signed by Roy R Harvey, Mark Maley, Kenny F Brack and Martha Oliver.  From that time forward, this property was not in the assessment roles.  No Drainage Board’s action was taken to exclude this property.  Joe said he had taken pictures of the property North of Bath Road and there is a stand pipe and another at the edge of the property.  Joe had shot elevations and has 4 feet of negative grade, can see why water does not run North.  When the Dare Ditch was built elevations was to be 1785 feet to make sure it drained.  Joe feels we could drain the water to the South; the problem is the property owners spend approximately $200,000.00 on the reconstruction of the Dare Ditch, don’t know how to make it fair.  Tom Wilson asked what would be assessment be if that property was included in the assessment.  Joe said he didn’t know without refiguring.  Joe said can’t do anything until the Harvey’s petition the Drainage Board for that area North of Bath Road be included with the Drainage Area to the South.  Then a Public Hearing is held, so all property owners within the Dare Ditch know what the situation is.  Could take a 8-inch tile and hook on to the tile at Old Bath, there would be enough grade to drain the area North of Bath Road.  There would need to be a survey to see what is in the drainage area.  Eric Roberts asked that Joe do some research on the drainage area.  Don VonderMeulen suggested that the Ditch be revalued and consider the deprecation.  Joe said he had been thinking along the same lines and include portion to South of Bath Road and include with assessment and see what it is.  Joe said he would work with the Harvey Family to petition the Drainage Board.  Arthur G Robinson mentioned he had just passed by this area and made suggestion by putting in a 9 foot leaching wall with H4 stone and concrete retaining wall and put in 2 submerge able pumps so the water can drain away.  Joe said it would be easier that that with the grade to drain it to the South.  Darrel Harvey said this is a health hazard with mosquitoes.  Joe Gillespie the main concern is to be fair to all the property owners within the Dare Ditch.  Ted Young, Union County Surveyor came to the Meeting and Joe brought him up to date, his recommendation for them to petition the Drainage Board to include the area in drainage area.  Eric Roberts suggested getting a Public Hearing date set.  Joe would like to get some surveying done before the crops get to big.

BRIDGE INSPECTION LPA CLAIM VOUCHERS – At the last meeting Clark Dietz had forward LPA Claim Vouchers for Bridge Inspection for 80% federal reimbursement.  Vouchers 19 and 20 were approved, but Vouchers 17 & 18 was not.  MOTION – Don VonderMeulen motioned for Eric Roberts to sign the (4) LPA Claim Vouchers.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

BLUE CREEK ROAD BRIDGE 94 LPA CLAIM VOUCHER NO 2 – Received LPA Claim Voucher No 2 for Blue Creek Road Bridge Replacement Project for Construction Engineering Services 100% Federal Reimbursement.  Total amount to be reimbursed is $12,323.04.  MOTION – Don VonderMeulen motioned for Eric Roberts to sign LPA Claim Voucher for Bridge 94.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

HUNTERSVILLE ROAD BRIDGE 116 – Howard J Barth & Associates had submitted an invoice for Professional Services in the amount of $10,334.13 for Huntersville Road Bridge 116.  MOTION – Tom Wilson moved we sign Claim Voucher from Howard J Barth & Associates.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.  Also discussed the bridge railing that is to be installed on the bridge.  It’s been suggested and the Commissioners agree with George Hartman to install a TX railing would be less maintenance down the road.  Don VonderMeulen asked are we okay with what is budgeted and the quote from CPI Supply for the ConSpan Structure?  Eric Roberts has concern with the length of the wing walls and George Hartman has concern with the 11 foot rise, was his understanding it was with an 8 foot rise.  It was suggested to set up a meeting with Drew Barth to discuss.

PERSONNEL POLICIES HANDBOOK – Discussed the Drug and Alcohol Policy in the new Personnel Policies Handbook.  Carol Westerman reported she had talked to Kent Irwin and he recommended leaving the policy that way it is in the book.

EMA EXERCISE – Don VonderMeulen mentioned that a Representative from Highway Department is needed for an EMA Exercise on Wednesday, June 16 @ 5:00 P.M. in the EMA Room.  Don mentioned if we nominate someone they should be paid.  Eric Roberts said it’s hard to designate one person, because of the way the County Highway is set up.  Eric suggested one or more of the Commissioners to attend.  It was said this is a planning meeting and for the exercise should have the (3) Foremen’s attend.  Eric will attend the planning meeting.

PIPE CREEK ALLEY FORD STEEL BRIDGE 48 NOTICE TO PROCEED – MOTION – Tom Wilson motioned to sign the Notice to Proceed.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

CORPORATE COST SOLUTIONS, INC. – Carol Westerman explained that Corporate Cost Solutions, Inc. had been in contact with regards to auditing the County’s Workmen’s Compensation Policy and Invoices.  No action was taken.  Need to check with Malinowski Consulting to see if they do any auditing of Workmen’s Compensation records.

PAYROLL – Don VonderMeulen mentioned since the last payroll, one of the two employees with the time discrepancy has been corrected and the other had not.  MOTION – Don VonderMeulen motioned to approve payroll as submitted.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

NORTH ANNEX BUILDING NEW SEWER LINE HOOKUP – Eric Roberts reported we had received (2) quotes for the New Sewer Line Hookup for the North Annex Building.  1) Brackney Excavating $14,000.00  2) Ken Bischoff Excavating $39,210.00. (the other option $12,871.00, but would be digging from under and installing inside the existing line.)  MOTION – Eric Roberts moved to award contract to Brackney Excavating in the amount of $14,000.00 pending Council’s approval.  Don VonderMeulen seconds.  Tom Wilson, All in Favor.  Motion carried.  Don VonderMeulen asked for County Council to have a special meeting for their approval of funds to do the project, so the project can be under the same permit as the Town of Brookville is using.  INDOT will be resetting the stop lights soon and the County would then have to pay to have them come back.  MOTION – Don VonderMeulen made motion as body to ask County Council to meet to appropriate funds for the sewer project.  Eric Roberts said he was not going to ask County Council to meet.  Don VonderMeulen’s motion dies for lack of second.

CHANGES TO ZONING TEXT – Don VonderMeulen mentioned last week after the APC Meeting he had talked to Larry Franzman and feels need assistance in making changes to Zoning and suggest Brad Bruening work with him.  Don VonderMeulen had contacted Mr. Bruening and would do it for $5,000.00 to help with the changes to have completed within the 90-days.  It had been brought to Don’s attention that Mr. Bruening had passed away over the weekend.  Don mentioned at the discussion after the APC Meeting that Larry feels good about the work that had been done, but needs to be reviewed by another set of eyes.
