MINUTES – MOTION – Carroll Lanning moved we accept Minutes of July 27, 2010. Kenneth Rosenberger seconds. All in Favor (6). Opposed (0). Tom Linkel absent. Motion carried.
ADDITIONAL APPROPRIATION 2010-24 – Hollie Maxie reads Resolution 2010-24. County General Personal Services $5,000 (Jail – Part-time Jailer) Services and Charges $10,000.00 (Jail – Building Repair). Police Pension Fund Personal Services $5,000.00. Rainy Day Services and Charges $23,000 (Building Repair for Security Center). REX Road Repair Supplies $200,000. (District 3 Bituminus for paving and chip & sealing). Restricted Cemetery Donation Supplies $100. H1N1 Phase I Capital Outlay $5,269. Whitewater Valley Regional Interpretive Park Capital Outlay $689,600. (Formality to put Grant Funds in Appropriation Line). Brad Spurlock mentioned he had a problem with a non-profit organization owning the Interpretive Park and questioned the legality for the County. Once the property goes into the name of a non for profit’s name it out of the County Tax System. Jeff Koch replied he would hate to see money coming into the County and we lose it again. Carroll Lanning asked about repairs to the Jail. Tom Wilson said the repairs to the Jail is to repair the bricks that are leaking. MOTION – Brad Spurlock motions to accept Resolution 2010-24 except the appropriation for the Whitewater Valley Regional Interpretive Park, unless the County’s name is put on the deed. Kenneth Rosenberger seconds. All in Favor (6). Opposed (0). Motion carried.

JAIL ROOF LEAKING – Tom Wilson reported that the roof is leaking on the Jail and some of the prisoners had to be moved to a different location in the Security Center. Tom said he had received a quote today and will be receiving another tomorrow and asked if this could be paid out of Cumulative Capital Development. It was said yes.
HUNTERSVILLE BRIDGE 116 – Tom Wilson reported that he will be meeting with the Mayor of Batesville, George Hartman and CPI Supply on Huntersville Bridge 116. At the start of the process of replacing the culvert CPI had mislead them on the quote. At this time the bridge has not been built and was told by Counsel that the County would be able to get out of the proposal that had been signed. The City of Batesville has the expense of moving the water and gas lines and they have already been moved. The County and City of Batesville also have engineering cost in the project for the project to die.
NON-BINDING REVIEW OF THE FRANKLIN COUNTY TAXING UNITS RESOLUTION 2010-26 – Carroll Lanning reported he had reviewed everyone of the units and looks okay, don’t see anything really out of line. Ray Township doesn’t look to bad this time and seen that Brookville Township is asking for quite a bit more money probably due to the fact he needs more money. Hollie Maxie reads Resolution 2010-26 A Resolution Regarding the Non-Binding Review of the Franklin County Taxing Units. MOTION – Carroll Lanning motioned to accept Resolution 2010-26 Non-Bind Review of the Franklin County Taxing Units makes recommendation to accept as submitted, except Cedar Grove and Mt. Carmel as No Budget was submitted for review. Jeff Koch seconds. All in Favor (6). Opposed (0). Abstained (1) Brad Spurlock, reason being his father Delbert Spurlock is Laurel Township Trustee.
DECLARATION OF COUNTY TAX RATES – Received from the Indiana Department of Revenue the Annual Declaration of County Tax Rates for Fiscal Year October 1 2010 – September 30 2011 for Franklin County. CAGIT Rate for current year 1.00%, proposed rate 1.00%. COIT N/A. CEDIT Rate for current year 0.2500%, proposed rate 0.2500%. Needs to be signed by the President of the Enabling Body, County Auditor and County Attorney. MOTION – Brad Spurlock motioned to approve the proposed CAGIT and CEDIT Rates for October 1 2010 – September 30 2011. Tom Linkel seconds. All in Favor (7). Opposed (0). Motion carried.
HEALTH DEPARTMENT HIRING OF PART-TIME NURSE AND FULL TIME SANITARIAN – Diane Turney said she was here re revisit the hiring a part time nurse and full time sanitarian to be paid for out of the Tobacco Grant Funds, she was here back in December and with the hiring freeze wanted to know if Council will still agree to these two positions. At the time Diane was told to bring in the paper work and the Council would take action to approve, but paper work was never submitted. Diane said she had heard about a hiring freeze and Council did not want to re-do the salary ordinance and never turned in the paper work. Diane has made the request in the 2011 Budget Request that was submitted.
PERSONNEL POLICY HANDBOOK – Jeff Koch went over a list of concerns he had with the Personnel Policy Handbook that had been updated and is ready of adoption. Page 63 5.9 Employee Proof of Insurance and asked why that would need to be provided. Page 2 1.4 Who’s on the Franklin Count Personnel Administration Committee? The Committee has (5) members, County Commissioner or designee appointed by the Commissioners, (2) County Council members or designee appointed by County Council, County Auditor and Sheriff. Page 9 2.9 Why credit check? If handling money and based on job. Page 19 3.17.4 Overtime Approval in Writing and asked what is done now? Page 19 3.18 Emergency Closing has full time no pay and part time with pay, needs to be changed. Page 21 4.1 All vacation time used in year made. Page 22 4.3 Sick Leave. Page 72 6.5 Report of moving violations. Page 75 6.10 Guns Police Officers? It was also requested that the list of holidays be put back into the personnel Policy handbook. Jeff Koch has requested that they meet with Kent Irwin to go over the list of questions and have him clarify.
2011 BUDGET HEARINGS – The 2011 Budget Hearings are scheduled for Monday, August 30th to start at 9:00 A.M., Tuesday August 31st to start at 8:00 A.M. and Wednesday, September 1st to start at 6:30 P.M.
LAW ENFORCEMENT FUND – Brad Spurlock asked how can County Commissioners pass Ordinance for Law Enforcement Fund. Ordinance was presented to Commissioners by Mel Wilhelm, Prosecutor, so funds can be kept in the County and not be sent to the State and then request had to be made to the State for funds.
RECOVERY ZONE BOND – Frank Thompson, Economic Development Director reported had received work that Franklin County had been allotted Recovery Zone Bond Stimulus Funds in the amount of $700,000 Public Funds and $1,300,000 for Private Funds. Mr. Thompson has made contact to get more information on the funding. Franklin County has until December 31 2010 to use these funds, if not County was to pass ordinance by end of August declining so funds could be used elsewhere. He has recommended that the County not sign the ordinance and he will check to see if the County would be able have use for the funds.
