Eric Roberts opens the meeting with the Pledge of Allegiance.

CLAIMS – MOTION – Don VonderMeulen made motion to pay the claims (September 7, 2010).  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

REMC GRANTS FOR SHERIFF DEPARTMENT – Jason Lovins of the Sheriff Department had presented (2) New Grants that were received by the Department.  Had applied for $1,225 from each Whitewater Valley REMC and Rush Shelby REMC and was awarded $1,000 and $1,225.  The Grants are for training and equipment for drivers training for the deputies.  Plans are to purchase enough cones to set up 2 to 3 driving stations at once.  Eric Roberts asked if when cones are not in use can 2 to 3 cones be put in the deputy’s cars to put out during an accident.  Jason replied they don’t have enough room in their vehicles, but would look into it.

HUNTERSVILLE ROAD BRIDGE 116 – Drew Barth of Howard J Barth & Associates was present and mentioned a couple of weeks ago discussed reducing the cost for the Huntersville Bridge 116.  Drew had mentioned that Tom Wilson, George Hartman and Rick Fledderman and he himself had met to go over options for the culvert replacement.  Marty Hon of E & H Bridge had presented a quote and numbers were reviewed for a super structure steel bridge with concrete deck and bridge rails and pedestrian rails for a cost of $51,845.78 and for an added cost of $4,820.00 guardrail and post on deck to separate vehicle/walk traffic.  Drew Barth and George Hartman had put figures together for an estimate for the entire project.  Drew came up with $459,000.00 and George figured $419,800.00 and prices are based on average of bids received last December 2009.  Don VonderMeulen asked what the numbers were for the ConSpan Bridge and Drew replied $533,000.00.  Don mentioned the ConSpan has advantages over concrete paved in place, but is costly and asked what happened to the rebidding with the County purchasing materials.  Tom Wilson and Drew Barth didn’t think the price would change a whole lot.  Mayor Fledderman mentioned the ConSpan was discussed that the original quote came in at $80,000 and then came in a whole lot higher.  The cost only reduced $9,000.00 after we talked to ConSpan, then ConSpan thought the actual construction cost would go down, but then felt it probably would not.  Don then mentioned that our attorney thought we could probably get out of the ConSpan purchase order, but may have to pay for some engineering and if anyone knew how much.  Marty Hon had reported could have the beams by the 19th of September and have the plans to Drew Barth next week.  Drew said they would need 2 to 3 days to adjust plans to re-bid.  He would need to file the change of the structure and resubmit hydraulics for the opening of the structure to show the project would not change.  Eric Roberts mentioned it looked like the guardrail is not included.  George Hartman replied that it is included in the superstructure.  Marty Hon explained the guardrail that he has included in the price is for the pedestrian guardrail.   MOTION – Tom Wilson made motion to sign the Contract Proposal with E & H Bridge in the amount of $51,845.78 for the super structure and will add guardrail later.  Don VonderMeulen seconds.  Eric Roberts opposed.  Motion carried 2 -1.  Decision will be made on what type guardrail next week and bids will be presented and opened in Batesville when date is set.  MOTION – Tom Wilson made motion to sign letter to rescind CPI and cancel quote for the Huntersville Road Bridge 116 dated June 10, 2010 for the price of $189,807.19.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

BLUE CREEK BRIDGE 94 CHANGE ORDER 3 – Drew Barth had presented Change Order 3 for Blue Creek Bridge 94 in the amount of $31,556.92 for footing revisions for piers #2 & #3 due to rock elevation.  MOTION – Tom Wilson motioned to sign Change Order 3 for Bridge 94.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.     

BLUE CREEK BRIDGE 94 LPA CLAIM 5 – MOTION – Tom Wilson moved for Eric Roberts to sign LPA Claim 5 for Construction Engineering Services for Bridge 94 in the amount of $9,643.68 100% Reimbursement.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

SNOW HILL COVERED BRIDGE 102 CHANGE ORDERS 1 & 2 – Received Change Orders for the Snow Hill Covered Bridge 102, Change Order 1 in the amount of $1,034.34 is for additional signage for Construction Sign C and Change Order 2 in the amount of $10,855.25 for Cored Hole in Rock 24’ for ‘H’ Piling.  MOTION – Eric Roberts moved to sign Change Orders 1 & 2 for the Snow Hill Covered Bridge 102 Project.  Tom Wilson seconds.  Don VonderMeulen, All in Favor.  Eric Roberts, Motion carried.

HOOSIER HILLS REGIONAL WATER DISTRICT/WTH TECHNOLOGY – Joe Gillespie, County Surveyor had mentioned that he had been contacted by GRW Engineer for Hoosier Hills Regional Water District requesting access to Franklin County’s GIS Program to help them in their overall planning of the future development of their utility.  Any fees that are incurred from WTH will be the responsibility of Hoosier Hills and GRW.  MOTION – Don VonderMeulen made motion authorizing WTH Technology to allow GRW Engineer the use of the County’s GIS information.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

HENNING DITCH BID SPECIFICATIONS – Joe Gillespie reported he had the bid specifications proposals ready to be mail out to contractors.  The project is across from the Rosenberger Property within the Henning Ditch.  Bids are scheduled to be submitted and opened on October 12, 2010 @ 1:00 P.M.

ANDERSONVILLE PROJECT – Joe Gillespie gave update on the Andersonville Project.  The 5th structure had been set today, have a couple of issues, one being ran out of dirt for ground cover and one of the outlets needed to be moved closer to U.S. 52.  Struggling with water running away has only 2% grade ground level.  Joe Gillespie had asked Gary Ladd to look into an alternate option and reported that the project came in under budget, there would be grant funds available for a change order.

CIC – Don VonderMeulen reported after the last APC Meeting he had went and spoken to APC Members with regards to the CIC.  Mentioned the Commissioners sign Resolution for CIC/OC then found out that the APC should have set up.  Don asked if the Commissioners want to direct CIC to work under the direction of the APC.  Joe Gillespie replied does not see it matters if the CIC works under the Commissioners or APC.  It was suggested that the CIC go to the APC for direction, the confusion should be cleared up.  Tom Wilson said the CIC should be finished, they had done their job.  DonVonderMeulen is asking the CIC and APC to work together.  Don said the APC meets tomorrow evening and would be a good topic of discussion.  Joe Gillespie said he will bring up tomorrow evening.

WAIVE BUILDING PERMIT FEE FRANKLIN COUNTY COMMUNITY SCHOOL CORP – MOTION – Tom Wilson motioned to waive the Building Permit Fee for an Announcers Stand at Softball Field for Franklin County School Corporation.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

COMMISSIONERS COUNCIL FOR HISTORIC METAMORA BOARD APPOINTMENTS – Commissioners had received an email from Sherry Chandler for Board Members for the Commissioners Council for Historic Metamora that is needed to be approved by the Board of Commissioners to approve.  MOTION – Don VonderMeulen made motion to approve the appointments of Willie Jo Ball, All Rogers, Jay Davidson, Gary Schlueter and Paul Bartish to the Commissioners Council Historic Metamora Board.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried

APPLICATION FOR CERTIFICATE OF APPROPRIATENESS MILL STREET PIZZERIA – Received a copy of Application for Certificate of Appropriateness that the Commissioners Council for Historic Metamora had approved for the Mill Street Pizzeria.  Mill Street Pizzeria is requesting approval for a door to be added to the front of the building shed.  MOTION – Don VonderMeulen made motion to also approve the application for certificate of appropriateness for Mill Street Pizzeria.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.

LPA CLAIM VOUCHER FOR WHITEWATER VALLEY REGIONAL INTERPRETIVE PARK – Don VonderMeulen reported that the Whitewater Valley Regional Interpretive Park had been purchased (Deed signed by Harold E & Carol L McNeely on August 31, 2010 and recorded on September 7, 2010 Record No. 2010002651) and the next step is to sign the LPA Claim for Reimbursement.  MOTION – Don VonderMeulen made motion for Eric Roberts to sign LPA Voucher in the amount of $509,600.00 for the Whitewater Valley Regional Interpretive Park.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.  Don VonderMeulen also mentioned that he had spoken to Steve Flores of INDOT and said that INDOT requested the easement be included with the agreement and deed, the purpose is so the State would not have to purchase the right-of-way again if needed for some reason.   MOTION – Don VonderMeulen made motion to add addendum to agreement.  Tom Wilson seconds.  Eric Roberts, All in Favor.  Motion carried.  Susan Jones, Auditor suggested that the addendum to the agreement and easement be recorded in the Recorders Office.

LETTER OF SUPPORT MEDICAL RESERVE CORPS GRANT APPLICATION – Carol Monroe, Local Public Health Coordinator had requested the Board of Commissioners to sign a Letter of Support for the Medical Reserve Corps (MRC) Committee for Grant Application for NACCHO-MRC Capacity Building Fund.  The goal of this funding is to support the integration of MRC units into their local public health and emergency response infrastructure.  MOTION – Eric Roberts moved to sign Letter of Support for Franklin County Medical Reserve Corps.  Tom Wilson seconds.  Don VonderMeulen, All in Favor.  Eric Roberts, Motion carried.

RESTORATION OF BRICK & ROCK ON FRANKLIN COUNTY SECURITY CENTER – Tom Wilson reported they had received (3) quotes for the Restoration of Brick & Rock for the Franklin County Security Center for tuck pointing of brick and stone and fill in grout concrete were the water is running down the building.  The quote from Bob Johnson, General Contractor had been submitted for a total of $23,000.00.  Price includes Repair all missing mortar joints, Replace broken brick, Repair rock as needed; replace rock by side step, Seal between rock and concrete, Seal all brick and rock on old building after repairs are completed and, Power wash and clean.  Don VonderMeulen questions the sealing of the brick and rock.  Tom Wilson said he had requested it as he had spoken to Steve Cox who sets on the Historic Preservation Committee.  Don VonderMeulen said everyone he has talked to with the Historic Preservation that it is not a good idea to seal and asked that the sealant be itemized and be separate from the tuck pointing.  Tom Wilson said he would check with Bob Johnson and have available for next Monday’s meeting.

SPYGLASS CONTRACT – The Consulting Firm was here a few weeks ago and keeps on calling if Commissioners had made a decision.  Eric Roberts said we had seen a big cost savings with combing the bills when we went with ETC and E 911 had recovered a lot of fees prior.  Don VonderMeulen said E 911 did recover a lot, but there is probably a lot more to recover.  No one had checked on references on the Counties that they have done work in or is currently working in.  MOTION – Don VonderMeulen made motion to go with SpyGlass to recover cost of Communication Fees, upon Michael Wilhelm looking over the agreement.  Tom Wilson seconds.  Eric Roberts, Not in Favor.  Motion carried 2-1.

MIDWEST TOXICOLOGY – Eric Roberts that Midwest Toxicology was also in a couple of weeks ago to do the drug and alcohol testing for Franklin County Highway Department.  Eric reported that Hollie Maxie, Highway Clerk is in favor of changing companies, but would like to start the 1st of the Year.  There has been a problem with the company the County is currently using.  The Commissioners would like to have Michael Wilhelm to look over the contract. 

PAYROLL – MOTION – Tom Wilson motioned to approve payroll.  Don VonderMeulen seconds.  Eric Roberts, All in Favor.  Motion carried.

 MAVERICK INSURANCE – Kevin Krekeler of Maverick Insurance was present and requested an opportunity to bid on the County’s Property Liability and Workmen’s Compensation Insurance.  Permission was given.

PROPOSED ORDINANCE ON SALE OF SUBSTANCES CONTAINING SYNTHETIC CANNABINOIDS (SPICE) – Susan Jones, Auditor had presented a Copy of an Ordinance in which other Counties in Indiana are adopting on the Sale of Substances Containing Synthetic Cannabinoids (Spice) and asked if the Commissioners had any plans on adopting.  Jason Lovins, Franklin County Sheriff Deputy was still present and reported Spice is a legal and is a synthetic drug that is similar to marijuana and is dangerous.  If the Ordinance is adopted it allows the County to write a citation and fine a person who is caught with the drug.  Deputy Lovins said he would check with the Sheriff and Prosecutor if this is something the County would want to pursue.

PUBLIC COMMENT – JIM SUHRE – Jim Suhre of Brookville Township asked if anything is proceeding with the Zoning Code.  Don VonderMeulen said not tonight.  Jim Suhre asked if the Zoning Code would be discussed at the next meeting.  Don said they were advised to give the public a 48 hour notice to when the Zoning Code would be discussed.  Jim Suhre then asked did you look into the discrepancy in between the code from when it was voted on by the Commissioners and passed on to the Area Plan and then back to the Commissioners on the changed that were recommended by the Commissioners.  Were the changes intentional.   Don VonderMeulen said that it was changed from the list of changes.  Jim Suhre asked of the Commissioners were going to act on the Zoning Code in the near future.  Tom Wilson said to let it die and Don VonderMeulen said he is looking for direction from the APC and asked that they move forward in a positive way.  JOHN STEELE – John Steele said Tom Wilson and Eric Roberts did not see the definition for Subdivision.  Don VonderMeulen said there were discussions, but did not happen during a meeting.  John Steele said the intent of changes of the code was made outside of the meeting.  The code received a 6 – 0 vote from the APC.  John Steele on record hopes to see that this practice does not happen again.
